AN ORDINANCE
Authorizing the Sale of Certain
Municipally -Owned Real Property
WHEREAS, the City of Evanston owns the real property commonly
known as a public parking lot at 100-122 Chicago Avenue, located on the
Northwest corner of Chicago Avenue and Howard\ Street, in the City of
Evanston, legally described as follows and hereinafter referred to as the

"Property":

PARCEL 1: The. North 50 feet of the South 150 feet of that part
of the South 6.25 chains, lying West of the West
line of Chicago Avenue, East of the East line of
Chicago and Northwestern Railroad and North of the
North line of Howard Street of the Northeast quarter
of Section 30, Township 41 North, Range 14, East of
the Third Principal Meridian, in Cook County,
Illinois.
PARCEL 2 The part of the South 6.25 chins of the Northeast
quarter of Section 30, Township 41 North, Range 14,
East of the Third Principal Meridian, described as
• commencing at the intersection of the, North line of
Howard Street, with the East line of the
Right-of-way of the Chicago and Northwestern
Railroad running; thence East, along the North line
of Howard Street to its intersection with the West
line of North Clark Street (formally Chicago
Avenue); thence Northerly along the West line of
said North Clark Street 100 feet; thence West
parallel with the North line of Howard Avenue to the
East line of the right-of-way of the Chicago and
Northwestern Railroad; thence Southerly along said
right-of-way line 100 feet more or less to the point
of beginning in Cook County, Illinois.
commonly known as 100-122 Chicago Avenue.
WHEREAS, the City Council of the City of Evanston has
determined that ownership of the Property is no longer necessary,
appropriate, required or in the best interest of the City of Evanston; and
WHEREAS, the City Council of the City of Evanston has
3etermined that the best interest of the City of Evanston would be served
by the sale of said Property to a qualified party for redevelopment and
private use; and
WHEREAS, pursuant to Ordinance 120-0-89 of the City of Evanston
adopted October 10, 1989, the City Council by a vote of 2/3 of the
alected Aldermen then holding office did direct that the process to sell

said Property shall be by competitive bid; and �I i
fj WHEREAS, pursuant to said ordinance said bid process occurred;
4 and
WHEREAS, the City Manager recommends that a sale between the
City Evanston, as seller, and the Sherwin Management Company, as buyer,
be accepted by the City; and
�I WHEREAS, the City Council finds and determines that the best
interest of the City of Evanston and its residents will be served by the

acceptance of the aforesaid bid on the terms as set forth in attached
Exhibit 1; and
WHEREAS, the notice of intent to sell has been published in a
Iinewspaper of general circulation in the City of Evanston as required by
ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY

OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: The City Council of the City of Evanston finds as
fact the recitals hereinabove set forth
SECTION 2: The conditions of sale to Sherwin Management
Company as buyer, attached as Exhibit 1 hereto,
s hereby accepted by the City Council of the City of Evanston for the
owing described real property:
PARCEL 1: The North 50 feet of the South 150 feet of that part
of the South 6.25 chains, lying West of the West
line of Chicago Avenue, East of the East line of
Chicago and Northwestern Railroad and North of the
North line of Howard Street of the Northeast quarter
of Section 30, Township 41 North, Range 14, East of
the Third Principal Meridian, in Cook County,
Illinois.
PARCEL 2 The part of the South 6.25 chins of the Northeast
quarter of Section 30, Township 41 North, Range 14,
East of the Third Principal Meridian, described as
commencing at the intersection of the North line of
Howard Street, with the East line of the
Right-of-way of the Chicago and Northwestern
Railroad running; thence East, along the North line
of Howard Street to its intersection with the West
line of North Clark Street (formally Chicago
Avenue); thence Northerly along the West line of
said North Clark Street 100 feet; thence West
parallel with the North line of Howard Avenue to the
East line of the right-of-way of the Chicago and

Northwestern Railroad; thence Southerly along said
right-of-way line 100 feet more or less to the point
of beginning in Cook County, Illinois.
Commonly. known as a City -owned parking lot at
100-122 Chicago Avenue, located on the Northwest
corner of Chicago Avenue and Howard Street.
SECTION 3: The City Manager is hereby authorized and
directed to sign, and the City Clerk is hereby
authorized and directed to attest, the contract for the sale of the
Itoresaid real property, and the City Manager is further authorized to
negotiate any change or additional terms and conditions with respect to
the sale of the aforesaid real property as may abe deemed fit and proper.
SECTION 4: The City Manager and the City Clerk,
respectively, are hereby authorized and directed
,:o execute, attest- and deliver such other documents, agreements and
i:ertificates as may be necessary to the sale herein authorized, including
,>ther documents referred to in said contracts.
SECTION 5: All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 6: This ordinance shall be in full force and effect
from and after its passage, approval, and
?ublication in the manner provided by law.

EXHIBIT 1
1) The Sherwin Management Company shall develop the land, in
' accordance to plans already submitted to the City of
Evanston and/or additional plans which are in accordance
with applicable City codes and in accordance with the
general plan.
2) The Sherwin Management Company shall develop the land
within one (1) year of the date of closing.
3) The Sherwin Management Company shall provide an
irrevocable easement to the City of Evanston for the
placement of a "Welcome to Evanston" sign.

4) In the event the Sherwin Management Company does not
develop the land within the aforementioned one-year
period, the City shall have the option of repurchasing
the land for the same amount paid by Sherwin Management
Company to the City of Evanston.
5) The Sherwin Management Company shall be prohibited from
reselling the property, without the prior approval of the
City of Evanston.
