AN ORDINANCE
Amending Title 2 by Adding Chapter 12,
"Emergency Telephone System Board"
• WHEREAS, the citizens of Evanston, at an election on
November 6, 1990, approved the imposition of a surcharge of up
to seventy-five cents ($0.75) per month, per network connection,
which surcharge expense will be added to the monthly bill which
residents receive for telephone service; said charge
exclusively for the purpose of installing or improving a 911
Emergency Telephone System; and
WHEREAS, the City Council pursuant to ordinance
43-0-90, adopted on June 11, 1990, did impose a surcharge at a
rate of seventy-five cents ($0.75) per month per in-service
network in the event a majority of the votes cast upon the
referendum question are in the affirmative.
WHEREAS, the "Emergency Telephone System Act," Ill.
Rev. Stats., Ch. 134, Sec. 30.01, et sea., requires, inter alia,
• that any municipality imposing a surcharge for 911 emergency
service must establish an Emergency Telephone System Board and
provide, in the ordinance of creation, its powers and duties
(Ill. Rev. Stats., Ch. 134, Sec.•45.4).
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That Title 2 of the City Code is hereby
amended by adding the following Chapter
12, Emergency Telephone System Board:
2-12-1: ESTABLISHMENT:
There is hereby established the City of Evanston Emergency
Telephone System Board. The word "Board" when used in this
Section shall be construed to mean the Emergency Telephone
System Board, also known as the "ETSB".
2-12-2: COMPOSITION OF THE BOARD:
• The Board shall consist of seven (7) voting members
including the Chief of Police, the Fire Chief, the
Emergency Services and Disaster Agency Coordinator, Police
Commander of Technical Services, the Chairman of the
Police Services Committee, an Alderman who is a member of
the Administration and Public Works Committee and one
resident of Evanston as a non public safety agency
representative. All Board members shall be appointed by

the Mayor with the advice and consent of the City Council.
The mayor shall designate one voting member as chairman.
2-12-3: TERM OF APPOINTMENT:
The term of office for the aldermanic member from the
Administrative and Public Works Committee and the non
Public Safety Agency representative, shall be for two
years or until their successors are appointed and
confirmed.
2-12-4: VACANCY:
In the event of the death or resignation of a member, the
Mayor, with the advice and consent of the City Council,
shall appoint a replacement member to serve the remainder
of the unexpired term of the member who is being
replaced.
2-12-5: NO COMPENSATION, EXCEPT COSTS:
Members of the Board shall serve without compensation;
members shall be reimbursed by the Fund for their actual
and necessary expenses, incurred in their duties as
members of the Board, provided that a) the expense is
authorized by a majority of the Board prior to being
incurred; b) payment thereof is approved by a resolution
of a majority of the Board.
2-12-6: MEETINGS:
All meetings of the Board shall be conducted pursuant to
Robert's Rules of Order, and the Board and its members
shall, at all times, be subject to the Illinois Open
Meetings Act, Ill. Rev. Stat., Chapter 102, Section 41, et
seq. ,
2-12-7: POWERS AND DUTIES
The powers and duties of the Board shall be as follows:
A. Planning a 9-1-1 telephone system.
B. Coordinating and supervising the implementation,
upgrading or maintenance of the system, including the
establishment of equipment specifications and coding
system.
C. Receiving monies from the surcharge imposed pursuant
to the results of the referendum election and Ill.
Rev. Stats., Chapter 134, Section 30.01, et sea., and
from any other source for deposit into the Emergency
Telephone System Fund.
D. Authorizing all disbursement from the Fund, subject to
Section 2-12-11.
E. Hiring on a temporary basis, any staff necessary for
the implementation or upgrade of the system.
2-12-8: CREATION OF AN EMERGENCY TELEPHONE SYSTEM
FUND:
An Emergency Telephone System Fund shall be established by
the Board. All monies received by the Board, pursuant to
the aforesaid surcharge, shall be deposited into this
fund.

2-12-9: CUSTODIAN OF FUND:
The Finance Director shall be custodian of the fund.
2-12-10: INTEREST ON THE FUND:
• All interest accruing on the Fund shall remain in the
Fund.
2-12-11: EXPENDITURES MUST BE MADE BY THE BOARD:
No expenditures may be made from such Fund except upon the
direction of the Board by resolution passed by a majority
of all voting members of the Board, and upon approval by
City Council pursuant to Council Rules.
2-12-12: ALLOWED EXPENDITURES:
Expenditures may be made from the Fund only to pay for
costs associated with the following:
A. The design of the Emergency Telephone System.
B. The coding of in Initial Master Street Address Guide
data base and update and maintenance thereof.
C. The repayment of any monies advanced for the
implementation of the system.
D. The charges for Automatic Number Identification and
Automatic Location Identification equipment and
maintenance, replacement and update thereof.
E. The nonrecurring charges related to installation of
• the Emergency Telephone System and the ongoing network
charges.

F. Other products and services necessary for the
implementation, upgrade and maintenance of the system
and any other purpose related to the operation of the
system, including costs attributable directly to the
construction, leasing, or maintenance of any buildings
or facilities or costs of personnel attributable
directly to the operation of the system. Costs
attributable directly to the operation of an emergency
telephone system do not include the costs of public
safety agency personnel who are and equipment that is
dispatched in response to an emergency call.
SECTION 2: All ordinances or parts of ordinances
in conflict herewith are hereby repealed.
SECTION 3: This ordinance shall be in full force
and effect from and after its passage,
