HomeMy WebLinkAboutRESOLUTIONS-1972-051-R-72• • Revised 1-8-73 • 51-R-72 RESOLUTION WHEREAS, the City of Evanston has many parks and other facil- ities available for public use; and WHEREAS, such parks and the facilities upon them were developed for the use of all residents; and WHEREAS, it is the intention of the City Council to encourage and make available the public use of such facilities: NOW, THEREFORE, BE IT RESOLVED that it is the sense of the City Council that all City parks be available to anyone who wishes to use them without need for a permit as long as such use does not inter- fere with an ongoing departmental activity or other activity for which a permit has been granted; and BE IT FURTHER RESOLVED that any group that wishes to ensure the availability of a park or a portion of a park may obtain a permit, and that anyone who wishes to bring in or locate material such as platforms,.tents, speakers, and the like in a park shall obtain a permit; and BE IT FURTHER RESOLVED that in the use of a park by any group holding a permit, the City will, without cost to the permit holder, located or relocate picnic tables and stoves, if available; and BE IT FURTHER RESOLVED that community centers such as Boltwood, Foster, Chandler, and Levy be available, unless otherwise prohibited, to any group at no cost during their regular hours of operation if .'i .• such group can be accommodated within the existing programming at the center, and that if a group wishes to use a center at a time when it cannot be accommodated within the existing programming, the group must pay out-of-pocket expenses; and BE IT FURTHER RESOLVED that shelters and fieldhouses which are generally intended for recreational, cultural, and social activities shall be available to local public and private groups on an occasional basis so long as such facilities are available and the use is tied in with a special event or activity. All out-of-pocket costs for use of these facilities shall be paid by the user; and BE IT FURTHER RESOLVED that whenever the use of a park or facil- • ities involves the sale of commodities, the use of rides or other carnival -type attractions, the construction of facilities such as booths and tents, or any other situation where there is potential liability to the City, the organization holding the permit must provide the City with a certificate of insurance in the amount of $100/$300,000 naming the City as an insured party. In instances where in the judgment of the City Manager a greater amount of insurance is necessary, he shall make such recommendation to the City Council prior to a permit being issued; and BE IT FURTHER RESOLVED that in carrying out its obligation toward recreational programming for residents of the City, the City may assist or cooperate with private organizations in providing recreation- al activities if such activities are open to all residents of the City and are deemed recreational in nature; and -2- 0 BE IT FURTHER RESOLVED that applications for all permits shall be made to the Recreation Department, and that such Department shall maintain a list of all fees which may be charged for use of centers and the like. BE IT FURTHER RESOLVED that any use of parks and other facilities which creates a public nuisance or otherwise violates applicable state statutes or City of Evanston ordinances shall not be permitted. • ATTEST: • City Clerk -3- Mayor
