HomeMy WebLinkAboutRESOLUTIONS-1973-027-R-73• As Adopted 4/9/73 (Elderly) 27-R-73 RESOLUTION WHEREAS, the City of Evanston did enter into a cooperation agreement with the Housing Authority of Cook County (hereinafter referred to as HACC) on August 17, 1970 to provide low -rent housing for the elderly in the City of Evanston; and TjHEREAS, the HACC did submit a request for a program reser- vation to the Department of Housing and Urban Development to pro- vide federal funds for such housing and HUD did approve a reserva- tion of 100 units of low -rent housing for the elderly in Evanston; and WHEREAS, the City of Evanston has conducted numerous hearings to determine suitable sites with specific consideration given to the impact on the immediate neighborhood, public facilities, park facilities, public transportation and the general surrounding area; and WHEREAS, the following described Site is considered -a suitable and desirable location meeting the necessary criteria for sites for the construction by HACC of a multi -story building containing ap- proximately 100 units of low -rent housing for the elderly; and WHEREAS,_ the HACC is prepared to enter into negotiations on its behalf of the acquisition and development of said site for the 0 • -2- public use and purpose -of low -rent housing, subject to the tentative site approval by HUD and HUD's approval of a development program; and WHEREAS, the HACC proposes to prepare and submit, with this concurrence of the City Council of the -City of Evanston, the develop -- meet program for the approval of the Mousing Assistance office of HUD; and WHEREAS, the City desires hereby to express more formally its intention in order that HACC may take appropriate steps by way of I preparation of a development program for the required review, ap- proval and appropriation by HUD of the estimated development costs: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE • CITY OF EVANSTON, COOK COUNTY, ILLINOIS: That Site "A",being the seven lots running north from the Northwest corner of Sherman Avenue and Emerson Street, be and is hereby approved as the site of construction by HACC'of 100 units of low -rent housing for the elderly in a multi -story building. That said Site is approved subject to submission to HACC for submission and approval by HUD, and for the development of an appropriate plan by HACC within cost limitations adopted by HUD, which plan may be rejected by the City Council solely because of objections to housing quality, provided, however that the cost limitations of any such plan may be augmented by the Council to improve housing quality within 30 days of its submission. That the conduct of negotiations and possible condemnation proceedings 0 • J -3- required for the acquisition of the site designated for development, in the event that HUD approved the site, and appropriates sufficient funds for that purpose and that HACC develops an appropriate plan, shall be carried on by HACC on behalf of the program and in accord- ance with applicable State and Federal laws and regulations. That prior to conduct of filing ofany condemnation proceeding HACC shall advise the city and shall allow a period of 22 days from date of notification to permit the city to develop reasonable alternatives to condemnation after which time HACC may continue on with its normal acquisition procedures as designated by State and Federal • laws and regulations. That HACC and HUD appropriate sufficient funds prior to the beginning of construction to guarantee completion of the project. That the City of Evanston and its duly authorized agencies, boards, commissions and departments, shall take the reasonably necessary and appropriate action in the implementation of this resolution, upon the development of an appropriate plan for this site, including the granting of zoning variations or special uses for the location approved, where proper and appropriate, within the limitations of the Evanston Housing and Zoning Codes, if, and as, required and it shall waive the usual building permit fees. 0 IVE That certified copies of this resolution shall be submitted r for approval of HACC.
