RESOLUTION
WHEREAS, the corporate authorities of the City of Evanston
have determined that in their opinion the real-estate herein-
after described is no longer necessary, appropriate, required
_for the use of, profitable- to, or- for -the best interest of the
-- - ---City; and
-.--WHEREAS-, it -is the --intention of the City_ Council to en-
courage and make available for use to School Districts real
-estate-no.longer required for the use of the City; and
WHEREAS, School District No. 65 has need for the herein-
after described real estate; and
WHEREAS, Chapter 30, Sec. 157(a), Ill. Rev. Stats., 1971,
authorizes the transfer of real estate between municipal cor-
porations by.a resolution passed by the vote of two-thirds of
__the members of the legislative body of the transferor munic-
ipality then holding office.
NOW, THEREFORE, BE IT RESOLVED that the transfer of the -
real estate legally described as -
That portion of vacated Florence Avenue twenty-five
(25) feet east to the center line of vacated Florence
_ Avenue, from a line fifty-eight (58) feet west of,
parallel, equal and opposite to the west lines of
Lots -sixteen (16) to twenty-one (21), inclusive, and
the seventy-one (71) feet of Lot fifteen .(15) and the
south forty-eight (48) feet of Lot twenty-two (22),
together with the vacated sixteen (16) foot alley
lying between Lots fifteen (15) and sixteen.(16), all
in Bloc: 4 in the Ridge Subdivision of the South half
of the Southeast quarter of the Norchez_st quarter and
the South 217.90 feet of the North ha.1f of the Sc,_i.'n-
_east._-quarter of the Northeast quarter of Section 24,
Township 41 North, Range 13, East of the Third Prin-
cipal Meridian in the City of Evanston, Cook County,
Illinois,

to the Trustees of Schools, To,Y-nship 41 North, Range 14, East
of the Third Principal Meridian, Evanston Township, Cook CounI:y,

Illinois, is hereby directed, and the Mayor and the City Clerk
by proper -deed of conveyance, shall convey the aforedescribed
property to the Trustees of Schools., Township 41 North, Range 14,
East of the.Third Principal Meridian, Evanston Township, Cook
County, Illinois, subject to the following terms and conditions:
1. That rights -of -way and easements for public service
facilities are reserved to the City of Evanston
and/or the public utilities.
2. That the conveyance shall be made upon the express
condition that the real estate shall remain open
space, free of structures and, in the event of a
violation of this condition, the real estate shall
revert to the City of Evanston.
3. That the conveyance shall be made upon the express
condition that the real estate shall be owned, con-
trolled and used solely by the Trustees of Schools,
Township 41 North, Range 14, East of the Third
Principal Meridian, Evanston Township, Cook County,
Illinois, and that said Trustees shall not convey,
sell or dispose of the real estate in any manner
whatsoever, and in the event of a violation of
this condition, the real estate shall revert to
the City of Evanston.
4. That the conveyance shall be made upon the express
condition that if the Trustees of Schools, Township
41 North, Range 14, East of the Third Principal
Meridian, Evanston Township, Cook County, Illinois,
acquires clear legal title to the afterdescribed
property in the presently pending court litigation
involving that property, the said Trustees, in con-
sideration of the conveyance of the aforedescribed
Florence Avenue property to them by the City of Evan-
ston, shall i-mnediately convey by quitclaim deed said
afterdescribed property to the City of Evanston for
public street purposes:
The east twenty (20) feet of Lots thirteen (13)
to twenty-four (24), inclusive of Block 4 in
Grant's Addition to Evanston, a subdivision of
the East two-thirds (2/3) of the South half (1!2)
of the Northwest quarter'(1/4) of Section 24,
-- Township 41 North, Range 13, East of the Third
Principal ;Icridian all in the City of Evanston,
Cook County, Illinois.

5. That the conveyance shall be made upon the express
• condition that the School Districtsshall agree to
the valuation of the aforedescribed property hereby
conveyed as established by an independent real es-
tate appraiser which valuation shall take into
---- account the conditions of paragraphs 1, 2, 3, and
4 above.
6. That in the event the City of Evanston wishes to
purchase property from the School Districts in
the future, the valuation established by the afore-
said appraisal may be used by the City as a credit
towards the acquisition of such property.
