WHEREAS, the City of Evanston is currently the owner of property at 1013 Sherman Avenue; and WHEREAS, said property is presently used for temporary emergency housing consisting of a lot approximately 55 ft. x 133 ft. and improved with five units including a free-standing cottage in rear; and WHEREAS, in the opinion of the corporate authorities of the City of Evanston, said real estate no longer serves the original purpose intended, appropriate, profitable to, or in the best interest of said City; and WHEREAS, the corporate authorities of the City of Evanston Determined that the best interest of the City of Evanston would be served by the conveyance of said property to parties who will re- habilitate the property and agree with the terms and conditions here- inafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Evanston, Cook County, Illinois that the City Manager be and is hereby authorized and directed to give notice of a proposal to sell real estate legally described as: Lot 3 in Nicholas Mersch's Addition to South Evanston, beginning at a point south line of Lee Street produced from a west inter- sect of the east line of Sherman Street and running east 332 ft., then in a northwesterly direction 351.2 ft. along the west line of the Chicago and Northwestern Railroad right-of-way, then west 269 ft. to the east line of Sherman Avenue, then south 345.6 ft. to the place of beginning, Section 19, Township 41, Range 14, East of the Principal Meridian, Cook County, Illinois, commonly known as 1013 Sherman Avenue, Evanston, Illinois. BE IT FURTHER RESOLVED THAT said notice of a proposal to sell shall be published for three successive weeks in a newspaper of general circulation which circulates no less frequently than weekly in the City of Evanston. The first publication shall be not less than 30.days before the date provided in said notice for the opening of bids for We real estate. The corporate authorities may accept the high bid or any other bid determined by them to be in the best interest of the City of Evanston. The City Council may reject any and all bids. BE IT FURTHER RESOLVED THAT the notice of proposal to sell real estate shall be in substantially the following form: "Notice of Proposal to Sell Real Estate. "Public Notice is hereby given that the City of Evanston proposes to sell the following described real estate, to wit: "Lot 3 in Nicholas Mersch's Addition to South Evanston, beginning at a point south line of Lee Street produced from a west inter- sect of the east line of Sherman Street and running east 332 ft., then in a northwesterly direction 351.2 ft. along the west line of the Chicago and Northwestern Railroad right-of-way, then west 269 ft. to the east line of Sherman Avenue, then south 345.6 ft. to the place of beginning, Section 19, Township 41, Range 14, East of the Third Principal Meridian, Cook County, Illinois, commonly known as 1013 Sherman Avenue, Evanston, Illinois. 'This property is presently improved with two structures. The primary structure consists of four units; two units on the first floor, one unit on the second floor, and one unit on the third floor. The second- ary structure, a rear cottage, is a one -unit structure. "The property proposed to be sold is presently utilized for temporary emergency housing. "The City proposes to sell said property subject to the following terms and conditions: 1. That bids may be submitted on the provision that both structures will be rehabilitated and additionally, the number of units now in the primary structure will be reduced from four units to either two or three units. Bids submitted must specify the number. of units in the primary structure as the basis for said bid. If dual bids are submitted, they must clearly indicate the number of units as the basis for each bid. 2. The real estate shall be rehabilitated at least to minimum code regulations of the City of Evanston within a period of 180 days after title is transferred. -2- • • • 3. Each dwelling unit shall be made clean, safe and sanitary. 4. The plumbing heating, and electrical systems will conform to the proper codes of the City of Evanston. New forced air heating units will be installed in each dwelling unit. Bids submitted based on two units in the primary structure must have installed one new electrical service box. Bids submitted based on three units must provide two new electrical service boxes in'the primary structure. New electrical wiring will be installed throughout the primary structure. New kitchen sinks and cabinets will be installed in all dwelling units in addition to replacement of all piping wherever necessary. New washbasins and bathtubs will be installed in all dwelling '-Units. New flooring will be installed throughout the dwelling units where necessary. 5. The apartment now occupied by the existing tenants will be offered for occupancy under the Section 23, National Housing Act Rent Supplement Program, for a period of not less than one year, if at any time during the next three years such an allotment becomes available. 6. The,exterior of the building shall be painted and the lot shall be suitably landscaped. 7. There shall be submitted a bid bond or check in the amount of 10% of the bid price together with a completion bond or other security acceptable to the City to guarantee performance of the agreement. 8. Floor plans must be submitted with the bid, indicating how conditions of this Resolution will be met and any other con- templated changes. 9. Working drawings must be submitted 30 days after acceptance of the bid; such drawings must comply with the specifications stated in the Resolution, the Building Code, Zoning Ordinance, and all other applicable laws of the City of Evanston before closing of the real estate transaction. -3- 10. The present tenants shall be allowed to continue occupancy of the present apartment or another apartment within • 1013 Sherman Avenue under new ownership for at least one year at the present rent level of $105.00 per month; except that in the event they must be relocated while rehabilitation is completed, suitable relocation housing in Evanston meeting minimum Housing Code standards will be provided by the success- ful bidder at a cost to said tenants of no more than $105.00 per month. 11. That an agreement to the above conditions shall be made a covenant running with the land and shall be submitted., in "recordable form, by the purchaser. "The City of Evanston hereby solicits bids for the purchase of said real estate. All such bids shall be accompanied by preliminary proposals indicating the manner in which the bidder proposes to rehabilitate the real estate and should be addressed to: Edward A. Martin, City Manager, City of Evanston, Municipal Building, 1501 Oak Avenue, Evanston, Illinois, 60204. Such bids should be in writing and filed in the office of the ity Manager of the City of Evanston on or before Monday, June 17, 1974, at the hour of 2 p.m. "The corporate authorities of the City of Evanston may accept the high bid or any other bid determined to be in the best interest of the City. The corporate authorities may reject any and all bids. Maurice F.
