HomeMy WebLinkAboutRESOLUTIONS-1976-064-R-76A IL 64-R-76 RESOLUTION A Resolution Creating a "Section 3 Affirmative Action Plan" directed toward the Utilization of Lower Income Evanston Residents and Small Businesses in the Implementation of Community Development Block Grant Program. WHEREAS, the City of Evanston did apply for and receive a 1976 Community Development Block Grant from the U.S. Department of Housing and Urban Develop- ment; and WHEREAS, the City Council did authorize and direct the City Manager to sign all necessary certifications and assurances in applying for said block grant, pledging that Evanston will conduct the program in conformity with Title VI of the Civil Rights Act of 1964, Title VII of the Civil Rights Act of 1968, Section 109 of the Housing and Community Development Act of 1974, Executive Order 11246, and Executive Order 11063; and WHEREAS, the Community Development Block Grant assurances require, among other things, that the City comply with 24CFR Part 135, Employment Oppor- 10 tunities for Businesses and Lower Income Persons in Connection with Assisted Projects; and WHEREAS, 24CFR Part 135 directs the City to develop a "Section 3 Affir- mative Action Plan" which identifies the maximum feasible use of lower income Evanston residents and eligible business concerns, which qualify as small under the small business size -standards of the Small Business Administration, in the implementation of its grant program; and WHEREAS, the City of Evanston wishes to assure community participation in the implementation of the "Section 3 Affirmative Action Plan" as a means of identifying and utilizing the maximum number of lower income Evanston residents and eligible small business concerns: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVANSTON COOK COUNTY, ILLINOIS, that the following program, referred to as the Second Year Community Development Section 3 Affirmative Action Plan, is -hereby • approved and the City Manager is hereby directed to carry out said program: 64-R-76 -2- • Second Year Community Development Section 3 Affirmative Action Plan I. Employees The positions to be funded by Evanston's second year Community Development Block Grant include a planner to assist in the overall administration of the grant and a rehabilitation specialist who will provide technical assistance to the City's housing rehabilitation program. The work programs of both these positions require highly trained individuals so that education and/or experience must be the primary recruiting criteria. As a result, neither of the afore- mentioned positions will be specifically set aside for lower income persons; however, recruitment and hiring will continue to be done in accordance with the City's affirmative action plan and EEOC guide- lines. II. Projects Evanston's second year Community Development program designates: (1) four thousand dollars ($4000) for installation of lighting fix- tures and recreational equipment in Larimer Park; (2) thirty thou- sand dollars ($30,000) for site preparation work in the development of Nichols Park; (3) eleven thousand dollars ($11,000) for installation of lighting fixtures at Perry and Mason Parks; (4) fifty six thousand dollars ($56,000) for the rehabilitation of a building at 1817 Church Street into a neighborhood center; (5) fifty- I three thousand dollars ($53,000) for construction of sidewalks, i curbs, gutters and parkway trees at specified location in Evanston's� target area; (6) fifteen thousand dollars ($15,000) for demolition I of unsafe structures, (7) one hundred eighty five thousand dollars ($185,000) for the rehabilitation of housing units. • III. Businesses A. The City Manager is hereby authorized to seek the advice, counsel, and assistance of all qualified agencies, public or private, in the development and administration of Evanston's Section 3 Affirmative Action Plan. 1 64-R-76 -3- B. All Departments of the City involved in the solicitation of services for the Community Development Block Grant (CDBG) Program shall notify the businesses listed on the registry of small Evanston businesses which is to be developed by the U.S. Department of Housing and Urban Development along with the Small Business Administration. C. In Evanston's second Community Development program year, it will be the City's goal to award at least twenty-five percent (25%) of the City's Community Development budget for housing rehabilitation to eligible small businesses. Each of the other second year ' projects will be reviewed for possible inclusion in the program's set aside program. For a set aside project, the City may use the negotiated bid process whereby a qualified small business would be located and the contract price would be established through negotiations. Furthermore, the City will make available copies of specifications and plans for negotiated bid projects to community organizations. Any organizatioi may contact a qualified small business and may present said contractor and the proposed contract amount to the City of Evanston for consideration. No contract above ten thousand dollars ($10,000) will be negotiated. D. The City's commitment, or that of a grant recipient, a partici- pating contractor, or subcontractor, to this program shall be stated in all bid documents. In addition all bid documents shall contain the boundaries of Evanston's Section 3 project area which are the City's boundaries. E. Tile Administrative Departments of the City shall cooperate with • all agencies, public or private, formed for the purpose of assisting eligible Section 3 business concerns. Said Administrative Departments shall further give all necessary assistance to eligible Section 3 business concerns in the preparation and submission of bids for services. 64-R-76 • -4- F.
