' 29-R-76 RESOLUTION Supporting Passage of House Bill'1333 WHEREAS, House Bill 1333, currently pending before the House Committee. , on Revenue of the Seventy -Ninth Illinois General Assembly, would increase pro- tection to property owners liable to lose property for unpaid taxes; and WHEREAS, adoption of this legislation by the General Assembly should re- sult in increased numbers of property owners becoming aware of the potential auction and sale of their property; and WHEREAS, House Bill 1333 requires the County Clerk to give notice of tax sale.of property within 30 days and to include in said notice the method of redemption; and WHEREAS, House Bill 1333 extends the right of redemption from 30 days to 180 days after service of summons for hearing served in accordance with Article III of the Civil Practice Act; and WHEREAS, the City Council of the City of Evanston wishes to provice its. residents with safeguards such as those presented in House Bill 1333; and WHEREAS, the City Council of the'City of Evanston is familiar.with the need for additional safeguards, due to a previous tax sale action affecting an Evanston resident; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Evanston that it supports passage of House Bill 1333 or similar legislation providing ad'• ditional time and notification to persons so affected. AND BE IT FURTHER RESOLVED that the City of Evanston opposes the present, tax deed system which permits a.tax buyer to .confiscate the total value of an .;> owner's residence for a tax delinquency, and favors legislation which provides f, that: y � k, •t'kh• �t� 29-R-76 4 . . -2- (1) the owner receive adequate prior notice of a tax sale; (2) at least sixty days prior to expiration of the owner's redemption - rights there be a judicial hearing'at which the owner is represented by counsel and in which the owner is apprised of the dangers of losing his property; and (3) the present system which fosters property confiscation be replaced by a foreclosure sale system in which the property is sold at auction with the county.receiving in ful.l.the delinquent taxes, interest, penalties and costs, and the owner receiving any surplus above those amounts and (4) a copy of this Resolution be sent to each of the legislators in Districts I and 11: Senator Bradley M. Glass, Representative Brian B. Duff, RepreSentative Harold A. Katz, Representative John E. Porter, Senator Michael Brady, Representative Arthur L.
