HomeMy WebLinkAboutRESOLUTIONS-1976-017-R-76• 3-19-76 17-R-76 A RESOLUTION Resolving to Authorize the City Manager to Sign an Amendatory Contract Between the United States Department of Housing and Urban Development.and the City of Evanston WHEREAS, the City of Evanston has applied for a grant of funds from I the United States Department of Housing and Urban Development to acquire land for park purposes generally known as the Deering property; and i WHEREAS, the City of Evanston and the Department of Housing and Urban Development are desirous of amending said contract to reflect the exclusion of certain unfulfillment of the contract entered into costs between the City i of Evanston and the Department of Housing and Urban Development on August i 27, 1969; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: That the City Manager is hereby authorized to execute the second amendment to the contract executed August 27, 1969 known as contract • ILL- £ OSC-179(G) to reflect such changes, a copy of which amendment is attached hereto and made a part hereof. UNITED STATES OF AMERICA DEPARTPETT OF HOUSING AND URBAN DEVELOPMENT AMENDATORY CONTRACT AMENDING CONTRACT FOR GRANT TO ACQUIRE AND/OR DEVELOP OPEN -SPACE LAND UNDER TITLE VII OF THE HOUSING ACT OF 1961, AS AMENDED Project No. ILL-OSC-179 •THIS AMENDATORY CONTRACT made and entered into on the date hereinbelow specified by and between the City of Evanston, Illinois, (herein called the "Public Body"') and the United States of America (herein called the "Government'% WITNESSETH: WHEREAS, the parties hereto. entered into that certain Contract for Grant to Acquire and/or Develop Open -Space Land No. ILL-OSC-179(G), dated the 27th day of August, 1969, as amended by Amendment No. 1 dated June 5, 1972, (herein called the "Existing Contract"), and it now appears that the Existing Contract should be amended: NOW, THEREFORE, in consideration of the mututal covenants, promises and representations contained herein and in the Existing Contract, the parties hereto do hereby amend the Existing Contract as follows: 1. Delete "park shelters" where it appears in Section 2(c) of the existing contract. 2. Delete the figure "$134,023." where it appears in Section 3 of the existing contract and substitute "$128,523." in lieu thereof. 3. Exhibit A of the Existing Contract is deleted and the legal description of.Exhibit A attached hereto is substituted in lieu thereof. 4. Compliance With the Provisions of the Clean Air Act Notwithstanding any other provisions of this contract; the Public • Body agrees to comply with the Clean Air Act, as amended (42 U.S.C. 1857, et seq.), and the standards issued thereto, in connection with the activities receiving assistance hereunder.
