A RESOLUTION
Creating A "Section 3 Affirmative Action
Plan" Directed Toward The Utilization Of
Lower Income Evanston Residents, Small
Businesses And Minority Owned Businesses
In The Implementation Of The 1977-78
Community Development Block Grant Program
WHEREAS, the City of Evanston did apply for and receive a 1977
Community Development Block Grant from the U.S. Department of Housing and
Urban Development; and
WHEREAS, the City Council did authorize and direct the City Manager
to sign all necessary certifications and assurances in applying for said block
• grant, pledging that Evanston will conduct the program in conformity with
Title VI of the Civil Rights Act of 1964, Title VII of the Civil Rights Act of
1968, Section 109 of the Housing & Community Development Act of 1974, Execu-
tive Order 11246, and Executive Order 11063; and
WHEREAS, the Community Development Block Grant assurances require,
among other things, that the City comply with 24CFR Part 135, Employment
Opportunities for Businesses and Lower Income Persons in Connection with
Assisted Projects; and
WHEREAS, 24CFR Part 135 directs the City to develop -a "Section 3
Affirmative Action Plan" which identifies the maximum feasible use of lower
income Evanston residents and eligible business concerns, which qualify as
small under the small business size standards of the Small Business Adminis-
• tration, in the implementation of its grant program; and
WHEREAS, for the purposes of this resolution and the implementing of
an.affirmative action program, a minority business enterprise is defined as an

• individual or group of individuals representative of a minority group class,

and who own or control 51% or more of the investment capital of an established
business enterprise, and a minority group class shall include Black, Spanish
surname, American Indian, Oriental and Women; and
WHEREAS, the City of Evanston wishes to assure community participa-
tion in the implementation of the "Section 3 Affirmative Action Plan" as a
means of identifying and utilizing the maximum number of lower income Evanston
residents, eligible small businesses and/or minority business concerns.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Evanston, Cook County, Illinois that the following program, referred to as the
Third Year Community Development Section 3 Affirmative Action Plan, is hereby
approved and the City Manager is hereby directed to carry out said program:
THIRD YEAR COMMUNITY DEVELOPMENT
SECTION 3 AFFIRMATIVE ACTION PLAN
I. Employees
The positions to be funded by Evanston's third year Community Development
Block Grant include: a planner to coordinate the City's CDBG Program;.a
student intern and secretary to assist in the overall administration of the
grant; a finance specialist, a rehabilitation specialist and a property stan-
dards inspector who will provide technical assistance to the City's housing
program; and a housing counselor to be added to the Evanston Neighbors -at -Work
staff to provide housing services assistance to residents of Evanston.
Education and/or experience are the primary recruiting criteria for the above
positions, none of which positions will be specifically set aside for lower
• income persons. Recruitment and hiring, however, will continue to be done in
accordance with the City's Affirmative Action Plan and EEOC guidelines.

• II. Projects
Evanston's third year Community Development Block Grant program designates:
(1) Sixty Thousand Dollars ($60,000.00) for the development of Nichols Park;
(2) Twenty -Five Thousand Dollars ($25,000.00) for the development of Mason
Park; (3) Seventy -Five Thousand Dollars ($75,000.00) for the construction of
sidewalks, curbs, gutters and parkway trees at specified locations in Evanston's
target area; (4) Ten Thousand Dollars ($10,000.00) for demolition.of unsafe
structures; and (5) Two Hundred Sixty Thousand Dollars ($260,000.00) for the
rehabilitation of housing units.
III. Businesses
A. The City Manager is hereby authorized to seek the advice, counsel,
and assistance of all qualified agencies, public or private, in the develop-
• ment and administration of Evanston's Section 3 Affirmative Action Plan.
B. All Departments of the City involved in the solicitation of ser-
vices for the Community Development Block Grant (CDBG) Program shall notify
the businesses listed on the registry of small Evanston businesses which is to
be developed by the U.S. Department of Housing & Urban Development along with
the Small Business Administration.
C. In Evanston's third Community Development Program year, it will be
the City's goal to award at.least twenty-five percent (25%) of the City's
Community Development budget for housing rehabilitation to eligible minority
owned and/or small businesses. Each of the other third year projects will be
reviewed for possible inclusion in the program's affirmative action program.
For an affirmative action project, the City may use the negotiated bid process
• whereby a qualified small business would be located and the contract price
would be established through negotiations. Furthermore, the City will make
available copies of specifications and plans for negotiated bid projects to

• community organizations. Any organization may contact a qualified small
business and/or minority owned business and may present said contractor and
the proposed contract amount to the City of Evanston for consideration. No
a
contract above Ten Thousand Dollars ($10,000.00) will be negotiated.
D. The City's commitment, or that of a grant recipient, a participating
contractor, or subcontractor, to this program shall be stated in all bid docu-
ments. In addition, all bid documents shall contain the boundaries of
Evanston's Section 3 project area which are the City's boundaries.
E. The Administrative Departments of the City shall cooperate with all
agencies, public or private, formed for the purpose of assisting eligible
Section 3 business concerns. Said Administrative Departments shall further
give all necessary assistance to eligible Section 3 business concerns in the
preparation and submission of bids for services.
F. The Office of the City Manager of the City of Evanston in conjunction
with the Community Development Committee shall be charged with the responsi-
bility for implementation and procedural development of the aforesaid policy.

Development Block Grant Funds
For Administrative Expenses
In Rehabilitation Department
WHEREAS, the Evanston City Council, with passage of
City Resolution 3-R-77, did approve an application for Community
Development Block Grant Entitlement Funds and did direct the City
Manager to file said application with the U.S. Department of
Housing & Urban Development; and
WHEREAS, the City's application was approved on June
10 27, 1977 by said U.S. Department; and
WHEREAS, the Community Development Committee has re-
ceived a funding request from the Housing Rehabilitation Board
which would require that the City's third year application be
revised; and
WHEREAS, the Housing & Community Development Act Com-
mittee did set aside a meeting to hear public opinion on said
request, which seeks the addition of a general clerk typist for
the Department of Housing and Rehabilitation Services funded by
the 1977-78 Community Development Block Grant funds,
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL
OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS, hereby amends its
