A RESOLUTION
Agreeing To Indemnify Cook
County As A Prerequisite To
Obtaining CETA Grants
WHEREAS, it would be beneficial for Evanston Township General
Assistance to enter into agreements with the County of Cook for grants of
funds which the County of Cook has obtained from the United States of America
pursuant to Title VI of the Comprehensive Employment and Training Act of 1973
(hereinafter referred to as "Act"); and
WHEREAS, the purpose of the Act and the grants to be obtained by
Evanston Township�General Assistance from.the County of Cook is the creation
or extension of public service employment for persons eligible under applica-
ble Federal Regulations; and
WHEREAS, the proposed grants to be made to Evanston Township General
Assistance shall end not later than September 30, 1979 and are intended to
provide employment for Evanston Residents; and
WHEREAS, the County of Cook demands that all Governmental entities,
including Evanston Township General Assistance, receiving grants under the
Act maintain adequate insurance and that they execute an agreement guaranteeing
to indemnify the County of Cook in the event that liability should arise from
the Township's Acts concerning the expenditure of these funds; and
WHEREAS, it has been determined that in the interest of obtaining
these grants .to enhance employment opportunities in the Township, the Evanston
Township General Assistance should resolve to indemnify the County of Cook for
damages arising from the actions of Evanston Township General Assistance and
its employees concerning the expenditure and administration of these funds;

NOW, THEREFORE, BE IT RESOLVED BY THE TOWN TRUSTEES OF THE TOWNSHIP
OF EVANSTON, COOK COUNTY, ILLINOIS:
That the Township of Evanston shall indemnify, keep, and save harm-
less the County of Cook, its agents, officials and employees, against all in-
juries, deaths, loss, damages, claims, patent claims, suits, liabilities,
judgments, costs and expenses, which may in anywise accrue against the County
of Cook in consequence of the granting of contracts pursuant to Title VI of
the Comprehensive Employment and Training Act, by which may in anywise result
therefrom, whether or not it shall be alleged or determined that the Act was
caused through negligence or omission of the Township of Evanston or its em-
ployees, the subcontractor or his employees, if any, or of the County of Cook
or its employees, and the Township of Evanston shall, at its own expense,
appear, defend, and pay all charges of attorneys and all costs and other ex-
penses arising therefrom or'incurred in connection therewith, and, if any
judgment shall be rendered against the County of Cook in any such action, the
Township of Evanston shall, at its own expense, satisfy and discharge the
same. The Township of Evanston expressly understands and agrees that any per-
formance bond or insurance protection required by this contract, or otherwise
provided by the Township of Evanston shall in no way limi.t the responsibility
to indemnify, keep and save harmless and defend the County of Cook as herein
provided. This indemnification agreement specifically excludes responsibility
for unemployment compensation, which shall be provided by the United States
pursuant to the terms of the Emergency Jobs Program Extension Act.
BE IT FURTHER RESOLVED that the City Manager transmit a copy of this
Resolution to.the appropriate offices.
