A RESOLUTION
Creating An "Affirmative Action Plan"
Directed Toward The Utilization Of
Lower Income Evanston Residents, Evanston
Small Businesses And Minority Businesses
In The Implementation Of The 1978-79
Community Development Block Grant Program
WHEREAS, the City of Evanston did apply for and receive a 1978
Community Development Block Grant from the U.S. Department of Housing and Urban
Development; and
WHEREAS, the City Council did authorize and direct the City Manager
to sign all necessary certifications and assurances in applying for said block
grant, pledging that Evanston will conduct the program in conformity with
Title VI of the Civil Rights Act of 1964, Title VII of the Civil Rights Act of
1968, Section 109 of the Housing and Community Development Act of 1974;
Executive Order 11246, Executive Order 11063, and Executive Order 11625; and
WHEREAS, the Community Development Block Grant assurances require,
among other things, that the City of Evanston comply with 24 CFR Part 135,
Employment Opportunities for Businesses and Lower Income Persons in Connection
with Assisted Projects, and Utilization of Minority Businesses; and
WHEREAS, 24 CFR Part 135 directs the City to develop a "Section 3
Affirmative Action Plan" which identifies the maximum feasible use of lower
income Evanston residents and eligible business concerns, which qualify as
small under the small business size standards of the Small Business Administra-
tion, in the A mplementation of its grant program; and
WHEREAS, Executive Order 11625 mandates increased utilization of
minority business; and the U.S. Department of Housing and Urban Development

has recommended the adoption of goals for participation by minority business
enterprises in the implementation of the Community Development Block Grant
Program; and
WHEREAS, the City of Evanston in an effort to assure community par-
ticipation in the development and implementation of the Affirmative Action Plan
did schedule a public meeting as a means of identifying and utilizing the max-
imum number of lower income Evanston residents, eligible small business con-
cerns and minority businesses;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Evanston, Cook County, Illinois that the following program, referred to as the
Fourth Year Community Development Affirmative Action Plan, is hereby approved
and the City Manager is hereby directed to carry out said program:
FOURTH YEAR COMMUNITY DEVELOPMENT
SECTION 3 AFFIRMATIVE ACTION PLAN
I. EMPLOYEES.
The positions to be funded by Evanston's Fourth Year Community
Development Block Grant include: a planner to coordinate the City's
CDBG program; a planner and a part-time student intern and full-
time secretary to assist in the overall administration of the grant;
a finance specialist, a rehabilitation specialist.and a property
standards inspector who will provide technical assistance to the
City's housing programs; and a housing counselor to provide housing
services assistance to residents of Evanston. The work programs of
all the aforementioned positions require highly trained individuals
so that education and/or experience must be the primary recruiting
criteria. As,a result, none of the aforementioned positions will be
specifically set aside for lower income persons; however, recruit-
ment and hiring will continue to be done in accordance with the
City's affirmative action plan and EEOC guidelines.

*Activity to be let for contracts and/or purchase of
goods and services. Total activities to be let for
contracts and/or purchase of goods and services =
$1,391,755.00.
In an effort to meet the recommended goal as suggested by HUD by
which the:
Minority business participation level equals (=) the
percentage of minorities in the general population of
the City, times (x) the estimated total dollar amount
to be let by contracts and/or used to purchase goods
and services,
it is recommended that the City of Evanston establish a.minimum goal
of $250,515.00 by which minority businesses will participate in the
Community Development Block Grant Program for the 1978-79 program
year.

III. BUSINESS UTILIZATION.
In order to reach the goals and objectives of Evanston's Affir-
mative Action Program the following steps will be taken:
A. The City Manager and/or his designate is hereby
authorized to seek the advice, counsel and assis-
tance of all qualified agencies, public or private
in the administration of Evanston's Affirmative
Action Program.
B. All departments of the City involved in the solici-
tation of services for the Community Development
Block Grant (CDBG) Program shall notify the Evanston
Review, the Chicago Tribune, the Dodge Reporter, and
the appropriate businesses listed on the registry of
small Evanston businesses; and those listed in the
Greater Chicago Metropolitan Resource Book; and any
additional resources which become available.
C. The City shall also seek qualified businesses through
a general recruitment statement to be published in
the Evanston Review, Dodge Reporter, and the Chicago
Tribune.
D. In Evanston's fourth Community Development program
year, it will be the City's goal to award at least
twenty-five percent (25%) of the City's Community
Development funds allocated for housing rehabilita-
tion to eligible small businesses.
E. Each activity will be reviewed to determine if the
total activity or a component could be designated
for a small and/or minority business enterprise.
For a set -aside project, the City may use the nego-
tiated bid process whereby a qualified small and/or
minority business would be located and the contract
price would be established through negotiations.
The City will make available upon request copies of
plans and specifications for negotiated bid projects
to community organizations. Any organization may
contact a qualified small business and may present -
said contractor and the proposed contract amount to
the City of Evanston for consideration. No contract
above Ten Thousand Dollars ($10,000.00) shall be
negotiated.
F. The City's commitment, or that of a grant recipient,
a participating contractor, or subcontractor, to '
this program shall be stated in all bid documents.
In addition all documents shall contain the boundaries
of Evanston's Section 3 project area which are the
City's boundaries.

G. Contractors shall include copies of their Affirma-
tive Action Program in all bids and document the
potential utilization of lower income Evanston
residents.
H. The Administrative Departments of the City shall co-
operate with all agencies, public or private, formed
for the purpose of assisting eligible Evanston small
and/or minority business concerns. Said Administra-
tive Departments shall further give all necessary
assistance to eligible Evanston small and/or minority
business concerns in the preparation and submission
of bids for services.
I. The Office of the City Manager of the City of Evanston
in conjunction with the Housing and Community Act
Committee shall be charged with the responsibility for
implementation and procedural development of the afore-
said policy.
