WHEREAS, NORTHWESTERN UNIVERSITY, in connection with the construction of Searle Hall, their new student health center, needs to provide for underground steam supply line and electrical high voltage system in the area of Emerson Street between Orrington Avenue and Sheridan Road; and WHEREAS, the University shall require an under- ground easement across certain streets and other public property for said underground steam and electric system: NOW THEREFORE, BE AND IT IS HEREBY RESOLVED that NORTHWESTERN UNIVERSITY be granted easements in and to certain • streets and other public property and permission to construct, maintain and operate an underground steam supply and electrical high voltage system, more fully described as follows: Steam Supply and Electrical System - The steam supply system will consist of a 4" steam line and a 2" conden- sate return line encased in 611 of insulating material with a vapor barrier exterior. The electric system will consist of lead or neophrene covered cables encased in 411 transite ducts with 6" of concrete all around the ducts. Easement Granted - An easement 15 feet wide, the center line of which has point of beginning in the west property line of Sheridan Road 7V2 feet north of the south line of Emerson Street and extending west along a line 7VI feet north of and parallel to the south line o: Emerson Street a distance of approximately 580 feet to a point of ending in the east property line of Orrington Avenue. Also, an easement 15 feet wide, the center line of which has a point of beginning 15 feet north of the south line of Emerson Street and 352 feet west of the west line of Sheridan Road and extending north a distance of 17V2 feet to a point 7V2 feet south of the north line of Emerson Street thence west along a line • 7V2 feet south of and parallel to the north line of Emerson Street a distance of 40 feet to the point of ending,, 082 r: 0 BE IT FURTHER RESOLS%cD, that the installation of said steam supply and electrical lines shall be subject to the approval of the appropriate municipal officials and all ordinances pertaining thereto and located in accordance with the Flat hereto attached and made a part hereof. BE IT -URTHER RESOLVED, that any permit issued here- under shall require that Northwestern University replace and repair any sidewalks, pavement or other public improvement injured or disturbed by reason of the construction or main- tenance of the steam pipe and electrical distribution ducts, and shall require that the University, at its own expense, whenever ordered by the ;)-rector of Public 4o.rks shall make adjustments ana relocate its steam mains or electrical distri- bution &-icts in or under said public property as may be reasonable and necessary to avoid interference with utilities owned by the municipality. During construction and after such steam and electrical distribution ducts are completed and ;.he streets, sidewalks and other public areas have been properly surfaced and restored, Northwestern University shall indemnify and hold harmless the ..i.ty of Evanston from any and all loss or oamage or claims for damages arising from or out of the use of the space under said streets, sidewalks or other public areas.
