RESOLUTION CONFIRMING AND
RATIFYING PROCEDURE RESPECTING
CONVEYANCE OF ALEXANDER PARK
WHEREAS, this City Council desires to convey to the
General Board of Pensions of the Methodist Church all of its
right, title and interest in the following described property
known as Alexander Park and legally described as:
and
Lot four (4) (exce t the west One Hundred Ei ht
(108) feet thereof and the south thirty (30?
feet of Lot five (5) (except the west One Hundred
Eight (108) feet thereof).in Block sixty (60) in
Evanston, Cook County, Illinois,
WHEREAS, in consideration thereof, the General Board
of Pensions of the Methodist Church, without cost to the city,
will cause to be conveyed to the City of Evanston for park
purposes, free and clear of all Hens. and has agreed to pay
the 1960 general real estate taxes, the following described
property:
and
The south Two Hundred (200) feet of Lots One (1),
Two (2) and Three (3), taken as a tract, (except
the west One Hundred Eight (108) feet of saod lots)
in Block sixty (60) in Evanston, Cook County,
Illinois, the westerly line of said premises being
measured along a line One Hundred Eight (108) feet
east of and parallel to the west line of said lots,
WHEREAS, present Alexander Park is now restricted for
park purposes due to a covenant running with the land; and
WHEREAS, it appears that in the event the exchange of
these properties is effected, the citizens of the city will be
materially benefited inasmuch as the city will receive a parcel
of land twice as large as that of the present Alexander Park
and more ideally located for park purposes, and without cost; and
WHEREAS, as a result of the filing of a complaint in
Chancery in the Circuit Court of Cook County, Illinois,
entitled - City of Evanston, a municipal corporation vs.
Grenville Beardsley, Attorney General of the State of Illinois,
et al, --ase No. 60 C 6116, and by virtue of stipulation of
facts, stipulation for immediate hearing upon answers filed
by all of said defendants, decree was entered by the Honorable
Daniel A. Roberts, judge of said Circuit Court, on May 5, 19600
ordering and directing the transfer of said properties and the
abrogation of the aforesaid covenant running with the land,
as it pertains to the present Alexander Park under and by virtue
of the Doctrine of cy pres.
THEREFORE. BE IT RESOLVED by the City Council of the
City of Evanston, Cook County,.Illinois, that this City Council
confirm, ratify and approve all of the acts of the Corporation
Counsel in and about the preparation, filing and entry of Decree
in said Circuit Court proceedings; and
BE IT FURTHER RESOLVED that the City of Evanston accept
• delivery of a Warranty Deed from the General Hoard of Pensions
of the Methodist Church conveying to the City of Evanston all
of its right, title and interest in its aforesaid real estate;
and
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be and they are hereby authorized to execute a deed for and on
behalf of the City of Evanston conveying the aforesaid parcel
of land heretofore described and.known as Alexander Park, to the
General Board of Pensions of the Methodist Church, all in accord-
ance with the Decree of the Circuit Court heretofore mentioned.
