RESOLUTIQN
WHEREAS, the fair and equitable enforcement of local
zoning ordinances and building and housing codes requires that
th-e owners of property have accurate information as to the law-
ful use or condition of their property under applicable ordi-
nances and codes; and
WHEREAS, many instances have occurred wherein purchasers
of property have been misled or not informed as to the lawful
use or condition of the property purchased by them because the
sale and transfer was made without the assistance of licensed
• and knowledgeable real estate brokers, or of any lawyers; and
WHEREAS, prospective purchasers ought to be made aware
of the lawfully permitted uses and of any illegal uses or non-
conforming aspects of the property which they are being offered,
in consideration of their receiving a fair.return on their
purchase price.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Evanston, Illinois, does hereby respectfully petition
the General Assembly of the State of Illinois that it enact
enabling legislation which would permit cities and villages to
require that the owner who proposes to sell or transfer any
property or parcel of real estate within the city or village,
furnish to any and all prospective buyers a certificate, attested

by an official or officials of the city or village, accurately
describing the lawfully permitted uses and conditions of the
subject property under applicable zoning ordinances and building
and housing codes then in force, and specifically listing any
illegal or non -conforming aspects of such•property or real
estate; to permit said cities and villages to charge a fee
reasonably related to the cost of investigation and inspection
of the property and the issuance of the said certificate; and
to permit said cities and villages to impose appropriate pen-
alties for violations or failure to comply with the foregoing
requirement; and
�. BE IT FURTHER RESOLVED, that the Mayor and City Manager
are hereby authorized and requested to transmit a certified
copy of this resolution to Governor Otto Kerner and each member
of the General Assembly, and to take all other practicable steps,
in cooperation with the Illinois Municipal League, to encourage
the passage of the requested permissive legislation.
