A RESOLUTION
Relating To Enforcement Of Zoning
Ordinance Against Doctors Occupying
Office Space In Hospitals

WHEREAS, the City Council of the City of Evanston, and specifically
the Planning and Development Committee thereof, has heretofore been consider-
ing under Docket No. 184-8C-73 the zoning problems created by the occupancy
of medical offices by doctors in the various Evanston hospitals; and
WHEREAS, the Planning and Development Committee expects to make
recommendations to the City Council relating to the problems of medical of-
fices in hospitals and is now considering a draft ordinance; and
WHEREAS, the Zoning Board of Appeals has heretofore granted time
extensions to forestall enforcement of the zoning regulations against the
occupants of such medical offices; and
WHEREAS, said time extensions will expire on April 30, 1979; and
WHEREAS, it is the desire of the City Council to refrain from the
enforcement of existing regulations against the use of such offices for pri-
vate medical practice until the City Council has had an opportunity to fully
consider and further legislate in this area.
• NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That the City Manager and the Department of Inspections
and Permits be and they are hereby directed to refrain

from filing complaints or otherwise enforcing the provisions of the Zoning
• Ordinance of the City of Evanston against those private medical practitioners
now occupying offices in Evanston hospitals until either further action by
the City Council or July 31, 1979, whichever first occurs.
SECTION 2: That by this action the City Council does not grant any
vested rights for the continued use and occupancy of
medical office facilities in a manner which would constitute a violation of
the Zoning Ordinance of the City of Evanston and sLch further use and occu-
pancy shall be without prejudice to the rights of the City of Evanston to
proceed in further enforcement action.
SECTION 3: That the passage of this Resolution shall not be con-
strued in any manner to permit additional establishment
of medical offices for private practitioners in Evanston hospitals and the
• further use and occupancy of such offices shall be to the risk of said medical
practitioners and the passage of this Resolution shall not be construed in
any manner to condone any violation of the ordinances of the City of Evanston
nor act to estop the City of Evanston from full enforcement action at any
time.
SECTIO14 4: This Resolution shall be in full force and effect from
and after its passage and approval in the manner pro-
vided by law.
