A RESOLUTION
Creating An "Affirmative Action Plan"
Directed Toward The Utilization Of
Lower Income Evanston Residents,
Evanston Small Businesses And Minority
Businesses In The Implementation Of The
1979-80 Community Development Block
Grant Program

j! WHEREAS, the City of Evanston did apply for and receive a 1979
jCommunity Development Block Grant from the U.S. Department of Housing and I
Urban Development; and
I

WHEREAS, the City Council of the City of Evanston did authorize and
. direct the City Manager to sign all necessary certifications and assurances I
j! in applying for said block grant, pledging that Evanston will conduct the
program in conformity with Title VI of the Civil Rights Act of 1964, Title VII
of the Civil Rights Act of 1968, Section 109 of the Housing & Community
ij Development Act of 1974, Executive Order 11246, Executive Order 11063, and

—_. Executive Order 11625; and
ii
!; WHEREAS, the Community Development Block Grant assurances require,
among other things, that the City of Evanston comply with 24 CFR Part 135,
Employment Opportunities for Businesses and Lower Income Persons in Connec-
tion with Assisted Projects, and Utilization of Minority Businesses; and
WHEREAS, 24 CFR Part 135 directs the City of Evanston to develop
• a "Section 3 Affirmative Action PlarL'_' which identifies the maximum feasible
use of lower income Evanston residents and eligible business concerns, which
j qualify as small under the small business size standards of the Small
Business Administration, in the implementation of its grant program; and

WHEREAS, Executive Order 11625 mandates increased utilization of
li minority business; and the U.S. Department of Housing & Urban Development has
'i recommended the adoption of goals for participation by minority business en-
terprises in the implementation of the Community Development Block Grant
Program; and

i WHEREAS, the City of Evanston in an effort to assure community

jj participation in the development and implementation of the Affirmative Action
Plan did schedule a public meeting as a means of identifying and utilizing
i
the maximum number of lower income Evanston residents, eligible small busi-
ness concerns and minority business;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
EVANSTON, COOK COUNTY, ILLINOIS, that the following program, referred to as
• the Fifth Year Community Development Affirmative Action Plan, is hereby ap-
proved and the City Manager is hereby directed to carry out said program:

AFFIRMATIVE ACTION PLAN
I. Employees
The positions to be funded by the City of Evanston's Fifth
j! Year Community Development Block Grant program shall be to

The recruitment and hiring of the aforementioned personnel
small be done in accordance with the City of Evanston's
Affirmative Action program and EEOC guidelines. In addition,
those other agencies receiving the City of Evanston's CDBG
funds shall be required to develop an affirmative action
program in their recruitment and hiring in accordance with
Resolution 24-PR-79 adopted by the Evanston City Council
on May 14, 1979.

• In an effort to meet the recommended goal as suggested by
HUD, by which the:
Minority business participation level equals (_)
the percentage of minorities in the general pop-
ulation of the City, times (x) the estimated
i total dollar amount to be let by contracts and/
or used to purchase goods and services,
it is recommended that the City of Evanston establish a
minimum goal of $294,351.00 by which minority businesses
will participate in the Community Development Block Grant
Program for the 1979-80 program year.
III. BUSINESS UTILIZATION
In order to reach the goals and objectives of Evanston's
Affirmative Action Program the following steps will be taken:
A. The City Manager and/or his designate is hereby
authorized to seek the advice, counsel and assis-
tance of all qualified agencies, public or private
in the administration of Evanston's Affirmative
Action Program.

B. All departments of the City involved in the
solicitation of services for the Community De-

velopment Block Grant (CDBG) Program shall notify
the Evanston Review, The Chicago Tribune, The
Dodge Reporter, and the appropriate businesses
listed on the registry of small Evanston busi-
nesses; and those listed in the Greater Chicago
Metropolitan Resource Book; and any additional
resources which become available.

C. The City shall also seek qualified businesses
through a general recruitment statement to be
published in the Evanston Review, Dodge
ll .
Reporter, and the Chicago Tribune.

D. In Evanston's Fifth Community Development pro-
gram year, it will be the City's goal to award
i;
at least twenty-five percent (25%) of the City's
Community Development funds allocated for
housing rehabilitation to eligible small busi-
nesses.
E. Each activity will be reviewed to determine if
the total activity or a component could be des-
ignated for a small and/or minority business
enterprise.
• For a set -aside project, the City may use the
negotiated bid process whereby a qualified
small and/or minority business would be located
and the contract price would be established
through negotiations.

The City will make available upon request
• ;
copies of plans and specifications for negoti-
ated bid projects to community organizations.
Any organization may contact a qualified small
business and may present said contractor and
the proposed contract amount to the City of
Evanston for consideration. No contract above
Ten Thousand Dollars ($10,000) shall be

negotiated.
F. The City's commitment, or that of a grant re-
cipient, a participating contractor, or sub-
contractor, to this program shall be stated in
all bid documents. In addition all bid docu-
ments shall contain the boundaries of Evanston's
I!
Section 3 project area which are the City's
boundaries.
G. Contractors shall include copies of their
Affirmative Action Program in all bids and
document the potential utilization of lower in-
come Evanston -residents.

H. The Administrative Departments of the City shall

cooperate with all agencies, public or private,
formed for the purpose of assisting eligible
Evanston small and/or minority business concerns.
Said Administrative Departments shall further

give all necessary assistance to eligible

Evanston small and/or minority business concerns
in the preparation and submission of bids for
services.
I. The Office of the City Manager of the City of
Evanston in conjunction with the Housing &
Community Development Act Committee of the City
Council of the City of Evanston shall be
charged with the responsibility for implementa-
tion and procedural development of the afore-

said policy."
