Alderman Marge Wold presiding. The Committee expresses] sorrow for the death of Alderman Rudy. Item I - Minutes The minutes of January 3. 1991 were reviewed and accepted. Item II - Communications o Citizen Letters: Eight citizens letters were presented. reviewed and accepted. The Committee commented that the letters were very nice. o Mayor Barr's Memorandum to the P.S.C. (January 4. 1991): The items mentioned were referred t(, the upcl)ming Committee (new members of the P.S (- ) for monitoring. o Police Executive Research Forum (PEKE') Letter to President Bush. The Committee said it might be appropriate for the Cou[icil to send a copy to Congressman Yates. at the appropriate time to 1pnrl support for th#-1r lnrt.ative Minutes of the PSC Meeting April 4, 1991 Page 2 o Chief Jacobi's response to Alderman Rudy's request for information on the prioritizing of calls for service: Alderman Wold said she toured the Department's Communications section and it was very informative. She also indicated that there is a need for additional equipment. Alderman Mortnn asked for clarification on some of the points with reference to the operation of the equipment and Chief Jacobi explained the process. Item III - Complaint Reviews o Two citizens appeared before the Committee to express their concerns with the disposition of complaint 490-027. They were advised that there is some concerns about the legality of the Committee releasing information that might be of a confidential nature and that a legal opinion would hp regiested from the Legal Department, The citizens would be advised of the findings. Another citizen appeared before the Committee to express his displeasure with the way his complaint was progressing Alderman Woad commented that it is not the Committee's position to become involved in complaints prior to their completion by the Police Department. Chief Jacobi stated that there would be some literature forthcoming as to the way that citizen complaints are handled and the attempted timeliness of same. Item I - Minutes The minutes of the April 4, 1991 were received and are to be reviewed prior to the next P.S.C. Meeting. Item II - Communications o Citizens Letters Ten citizen's letters were presented, reviewed and accepted. o Overview - Internal Affairs Chief Jacobi, assisted by his staff, presented an overview of the functions of the Internal Affairs Bureau, the internal citizen complaint process, disciplinary procedures, as well as relevant activities of the Police Department. o Memorandum from Chief Jacobi to City Corporation Counsel Herb Hill regarding a reference from the Police Services Committee. Mr. Hill's response to the Committee, detailing issues of confidentiality in respect to personnel matters in Internal investigations, was not ready in time for the meeting. Mr. Herb Hill, City Corporation Counsel, had not yet responded to the requested information. The officer entered the complainant's home without permission. W/M, 24 Years of Age - Uniformed The complainant stated that the accused officer threatened to "shoot his head off". stemming from an incident involving a traffic stop near the complainant's home. The officer also allegedly entered the complainant's house without his permission. The accused officer and a witnessing officer denied the allegations. NOT SUSTAINED Accepted B/M. 19 Years of Age The complainant was physically attacked without provocation. W/M. 39 Years of Age -- Uniformed The complainant alleged that while his car was being towed he was attacked without provocation by the accused officer. The officer and the tow truck operator denied the accusation. The accused officers failed to file a report and to notify the juvenile's parents that he had been in their custody. Accused B/F, 34 Years of Age - Uniformed B/M, 22 Years of Age - Uniformed Sum ary The accused officers took the complainant off a bus for identification in an auto theft. He was not identified and the officers were in the process of taking him to school when the wanted person was observed driving the stolen vehicle. They pursued the stolen vehicle with the complainant still in their auto. SUSTAINED Accepted Alderman Wollin informed the Committee that she had received outside requests from agencies in California and Michigan requesting information about the Committee's responsibilities and current operating policies. Alderman Wollin stated that she has responded to these requests and Mould continue to do so with any other outside requests, with the approval of the Committee. The meeting was adjourned at 9:15 pm. Item I - Minutes The minutes of the May 2, 1991 meeting were approved. Item II - Communications Citizens Letters Ten citizens letters were presented, reviewed and accepted. Alderman Wallin made special mention of the Summer Camp Program correspondence from Officer Cook. The Committee reviewed the memorandum from the Law Department relative to the authority of the Committee to disclose information under review. Chief Jacobi was directed by Alderman Wallin to be prepared to provide both identities and level of discipline, orally, on request by the Police Services Committee. Item III - Community Concerns A. Alderman Wollin stated that many citizens are pleased with the Department's Summer Plan. B. Alderman Esch voiced some concerns with reference to the frequency of patrol by officers in the Main and Dodge area. C. Alderman Kent voiced some concerns with reference to the problems in the 1800 block of Simpson and asked some questions with reference to the City's Ordinance on trucks parking in residential neighborhoods. Chief Jacobi responded to the questions posed by Aldermen Esch and Kent. PSC Meeting of July 11, 1991 Page 2 D. Drugs: Chief Jacobi passed out some literature on drugs. Alderman Wollin asked what confiscated funds could be used for. Item IV - Can /Dru Conference Chief Jacobi and Alderman Kent stated that they would be attending a Gang/Drug work shop in Champaign, Illinois. Other Community members would also be in attendance from July 29, 1991 - August 2, 1991. Item V - Annual Report The Committee and Staff discussed several of the items mentioned in the Report. Item VI - Other Business The Committee inquired if anything could be done about so many people loitering in certain areas of the City. Chief Jacobi responded that the City does not have a loitering Ordinance and the problems are handled in other ways, through other ordinances. Jacobi Lieutenant Ron Pryor Sergeant Richard Ayers Presiding Official: Alderman: Cheryl Wollin The meeting of the Police Services Committee convened in room 2403 of the Evanston Civic Center at 7:35 pm, Alderman Cheryl Wollin presiding. Item I - Minutes The July 11, 1991 minutes, were approved. Item II - Communications Citizens Letters Two citizens letters were presented, reviewed, and accepted. Correspondence from Mr. J. Margolis Discussion on this matter was tabled until the next PSC meeting on October 2, 1991. Chief Jacobi provided a written response to the Committee. Correspondence from Mr. D. Helms Mr. Helms appeared before the Committee and voiced his concerns with reference to the way his case is being handled by the Police Department. He also presented she Committee with correspondence concerning the Los Angeles Police Department. The Committee deferred any discussion of Mr. Helms's case, pendinq their raview of the information. Chief Jacobi's recommendation and the Law Department's discussion on fine provisions for Dogs, Cats, Animals, and Fowl Ordinance. The Committee moved approval of the amendments to the Ordinance and asked that it be introduced to the AP & W Committee. Chief Jacobi's report on Gang/Drugs Conference held in Champaign, Illinois July 29 - August 2, 1991. Chief Jacobi said there were ten (10) delegates from Evanston represented at the Conference. He also supplied the Committee with literature about the conference and said additional information would be forthcoming. Item III - Citizen Complaints Two citizens appeared before the Committee with reference to C.R. =91-015 and C.R. #91-017. The Committee listened to the concerns presented by both citizens and then went into Executive Session for discussion on the 8 Item III - Citizen Complaints (cont'd) complaints. The Committee then advised both complainants that they concurred with the Chief's recommendations of dispositions in both cases. Item IV - Other Business Pending Federal legislation affectinq local internal Procedures Chief Jacobi discussed the Federal Police Officers' Sill of Rights recently passed by the Senate and now pending in the House of Representatives. The Chief said the bill, if passed, could seriously impact the Department's complaint process. Item V - Complaint Reviews a 91-009 0 91-010 Complainant W/M 31 Years of Age Charge Refusal to provide name and badge number Accused W/M 28 Years of Age -Uniformed Patrol Summary The complainant said that he and fits wife were driving in the vicinity of Dempster and Chicago Avenue and were stopped by the accused officer for a traffic violation. During the incident the accused officer failed to provide his name and badge number when requested to do so. Summary The complainant stated that he was at the hospital to investigate an attempted suicide by his sister and became embroiled to a =ignt with his sister's boyfriend. He was arrested by the accused officer and accused the officer of using excessive force to effect the arrest. The complainant also said the officers illegally searched her vehicle during the incident. Item I - Minutes The September 5. 1991 minutes were approved. Item II - Communications Citizens Letters Ten citizens letters were presented, reviewed, and accepted. Correspondence from Mr. J. Margolis Mr. Margolis appeared before the Committee and discussed his concerns about how he was treated during the internal investigation process when he filed a complaint in September, 1990. Mr. Margolis presented the Committee with a comprehensive written statement, also reading the entire document. He detailed his observations and drew analogies to the Los Angeles "Christopher Report". Mr. Margolis also presented his recommendations for improving the citizen complaint process. Among his recommendation was one asking that the Evanston Police Department discontinue using a "not sustained" disposition and substituting it with a "not resolved" disposition. Chief Jacobi responded the EPD already uses a "not resolved" designation, but also "not sustained" to better categorize dispositions. Alderman Wollin indicated the statement and recommendations would be reviewed. The Committee asked Chief Jacobi to respond. in writing, to Mr. Margolis's presentation. Chief Jacobi had presented a written response and explanation regarding Mr. Margolis's questions to the Committee during its September meeting. PSCM 10-Z-91 Page 1 of 3 J Correspondence from Mr. D. Helms Mr. Helms appeared before the Committee and chose not to pursue his appeal to the Committee for a review of his complaint C.R. #91-032. Mr. Helms felt he had not been supplied with sufficient information regarding the complaint to adequately respond. Mr. Helms said he had been found "not guilty" in court, thereby negating the probable cause assertion of police officers who stopped Mr. Helms, which precipitated his complaint. He also asserted the officers testified giving information other than what they represented during the internal investigation process. The Committee went into "Executive Session". Chief Jacobi commented on Mr. Helm's oral argument and also said information would be sought from the court. The Committee engaged in a discussion whether a finding of "not guilty" had any significance. The prevailing opinion was that it did not in the context of a traffic violation. Alderman Wollin stated that she had asked the City's Corporation- Counsel for a legal opinion on some of the issues brought forth by Mr. Margolis and Mr. Helms and was awaiting a response. Alderman Newman noted that the minutes were not being taken, in what he felt was a proper manner, and suggested that the Committee look into the possibility of getting a Staff person to take the minutes or recording them and having them transcribed. Alderman Wollin said that she would ask the City Manager for his thoughts on the matter. Chief Jacobi presented the Committee with some information with reference to Disparate Racial Data in respect to Arrests, Citizens Complaints, Demand for Services, and Victimization. Item III - Complaint Reviews 91-026 Complainant B/M 30 Years of Age Charges Refusal to let the complainant speak with the Chief of Police. Refusal to let the complainant drive his vehicle after he had been issued a ticket unjustly for speeding. Accused W/M 36 Years of Age - Uniformed Patrol W/M 49 Years of Age - Uniformed Patrol Sergeant PSCM 10-2-91 Page 2 of 3 i r f a. Smeary The complainant stated he was stopped by the uniformed patrol officer and given a ticket for speeding. He told the officer he was not speeding and an argument ensued when he was told he could not drive his vehicle from the scene without proof of insurance. The Sergeant arrived on the scene and also told the complainant he could not drive his car without proper insurance. He also refused to make the Chief accessible to the complainant when requested to do so. Disposition by Chief Not sustained against the officer. Sustained against t-he Sergeant. Review by the Committee ACCEPTED 91-032 Held over until the next PSC meeting for a disposition. November 7. 1991. Item IV - New Business Citizen information on police misconduct. Chief Jacobi presented the Committee with some information on police misconduct and supplied a draft of a Brochure that will be presented to citizens when it is finalized. The Committee thought the Brochure was a good idea and expressed an interest in seeing the finished product. The Committee discussed some changes in the wording. Reference from Alderman Newman on Bicycle enforcement. Alderman Newman voiced his concerns about citizens biking on the sidewalks in the downtown area and said he has hid many complaints from citizens in his ward about the problem. He advocates stronger enforcement of the laws relating to bicycling. He is especially concerned for the safety of Senior citizens. The Committee agreed to review the ordinance. Alderman Cheryl Wollin presiding. Item I Minutes The October Z, 1991 minutes were approved. Alderman Warshaw requested that the record reflect that she had an inadequate amount of time to read through the PSC Packet because it was delivered late. Alderman Wollin said she would like for the Committee members to receive the packets, which were delayed pending a legal opinion for the City's Corporation Counsel, at least on the Friday proceeding a scheduled meeting. Chief Jacobi said that his staff would make every effort to distribute the PSC materials in a timely manner. Item_1I Commun_ica_tions__ Six citizen's letters were presented reviewed and accepted. Item III Other Business a Committee's response to Alderman Newman's request for a review of the Bicycle Ordinance. The Committee discussed ways of enforcing the current Ordinance. Chief Jacobi said there has been no program for enforcement for many years because of budget constraints and other problems. Alderman Newman said the Ordinance should be revoked if it is not enforceable. He reiterated his concerns for the senior citizens in the areas of the North Shore Home, Sherman Gardens, and the Georgian Home as being major problems of concern for the safety of senior citizens from bicycle riders in the business Districts and the areas of the senior citizen's domes. The Comittee agreed that senior citizens in the areas mentioned might be contacted via letters, etc. for input into the solution of the problem. The Committee agreed to review the Ordinance and place discussion of the problem on a future Agenda. PSC Meeting/11-19-91 Page 1 of 6 o City Corporation Counsel, Kathleen Brenniman's response to Alderman Nollin's request for a legal opinion was reviewed. Ms. Brenniman appeared at the meeting and discussed her memorandum to the Committee dated November 18, 1991. Ms. Brenniman responded to the following questions: 1. Can the complainant receive the same case summary that the Committee receives? Ms. Brenniman stated that in the event the complainant requests a review of higher complaint of the Committee, the complainant should receive the same summary that the Committee receives. The Committee agreed to provide a complainant requesting a review by the Committee with a copy of the same summary the Committee receives. 2. May members of the Police Services Committee review randomly selected files of the Evanston Police Department's Internal Affairs investigations to insure that the Evanston Police Departme;nt's summaries of statements and facts are accurate and complete? Ms. Brenniman said she feels the Committee is empowered by Resolution 68-R-75 to review the files if a complainant has requested a case review by the Committee. The Committee could review selected IAB investigations labelled as C.R.'s (Complaint Registers filed by a citizen). IAD reports and investigations labelled as A.R.'s (Administrative Reviews) initiated by the Department itself and not predicated on a citizens complaint would not be subject to this same random review by the Police -'ervices Committee. Ms. Brenniman advised the Committee that her response was narrowly related to the specific questions asked by the Committee and said, if questions are asked by citizens about reports which would result in a discussion of issues that could be subject to litigation (civil service hearings on discipline given to police officers), that discussion could appropriately take place in executive session under the Open Meetings Act. Alderman Wollin summarized the Committee's agreement thusly: The Complaint Reviews are within the purview of the Committee and the file of a complainant who has requested a review can be reviewed at the Police Station. PSC Meeting 11-19--91 Page 2 of 6 ;' Alderman Warshaw asked for explanations of the definitions of a C.R., A.R.. and D.I. she was provided with the definitions by the staff. Chief Jacobi advised the Committee that he would advise them after six months of how the summary information supplied to the citizens is affecting the process. The Committee agreed the; process should be closely monitored for any possible problems. especially those that might lead to possible liability issues. Example of a "worst case" scenario: The Committee agreed to hold comments on this item until the next meeting so that they could have sufficient time to read and make comments.
