1. Call to Order
The Chairman called the meeting to order at 6:72 p.m, lacking a quorum.

Approval of the minutes was tabled due to lack of a quorum.
Ill. Staff Report
M11V EBE Participation Report
Mr. Shepard reported that the bids W.E. O'Nril received for the Sherman Plaza garage carve in
over budget. W.E. O'Neil is consequently value engineering the project to reduce costs.
Meyne Company is performing finish work at the Levi Center that stands at a to -date cost of
construction of S".588.071. Mevne Company is claiming an unaudited MAVIEBE participation
credit of S 1.817.003 or 24%. The %I W EBE breakout is MBE S634,406 or 8.4%, WBE
S 1,003.440 or13?°a and EBE 179.1:7 or 2.41°.
Optittta Views has an approximate project,alue of S20 million. The unaudited M 1V EBE
participation reported by Matthew Cis -on. Project Manager is S3.798.688 or 190%, The NtW EBE
breakout is EBE $341.188 or L'°. WBE S3,368,600 or 16.810 and MBE S88,900 or 0.4%.
Mr. Dick Peach that Optima Inc is planning a new 36 story condo development in the TIF District
in the parking lot I footprint) behind I S Xj Sheraton. The ado tson Committee needs to determine
if such a project comes under the M W EBE Program.
Glenbrook Excavating Company was apparent Iou bidder for the Phase Vill-Contract B. Sewer
Relief Project. The apparent low bid was S3 248.323. Glenbrook Excavating met the 1511'b
MY'WBE requirement with a utilization plan of $487 249 supported by required M,'WBE
Schedules.
The question was raised by a Committee member as to %%hy targeted group participation was
required for Just M WBEs for the Sewer Relief project. 11r. Shepard indicated that the City is
working with )EPA that dictates the ripe of targeted group participation that is required. EBEs
and SBEs can be added for an additional 10°a but is not an enforceable requirement of IEPA. Mr.
Shepard added that the City has two additional bid openings for Sewer Relief Projects this Friday
and next Wednesday.
IV, Old Business
Mr. Peach reported that Mr. Jonathan Pemtan. Executive Director. Evanston Chamber of
Commerce and he met with Dr. Hardy Murphy. Superintendent. District 65 to lobby for a new
policy at District 65 which enables a business parmership between the District and EBEs.

Additionally, Mr. Peach discussed District 65 having a formalized specification to gui&reinforee
the any new policy. Mr. Peach indicated that the Board should propagate its ownership of a new
poltcy and consequential EBE program
Mr. Peach related that Mr. Jeff Taggam Business Manager. District 202, is moving toward much
improved participation of \f lit' EBEs.
V. Ne% Business

Mr. Peach indicated that he is pondering how to strengthen the language of the Employment
Program beyond its imposition of voluntary hiring. Mr. Peach would like to use the racial makeup
of the City to determine the percentage of hiring from various ethnic groups. Mrs. Tolston-Brown
suggested using census data for determining racial makeup of the City. Mrs. Natalie Birk
suggested that federal guidelines could be used as a predicate for starting the revised language.
Mrs. Tolston-Brown added that Alderman Baptiste has requested information regarding what
training programs exist in the City under various departrnental projects, Mr. Bill Stafford,
Director, Finance and Mrs. Tolston-Aroun are researching what the City has (Sewer Relief Project
Training Program) and drafted a strategic plan to approach improving the language of the general
specification governing employment in City construction projects.
fir. Peach gave an overview of the Christmas retail results that were generally good both in
downtown Evanston and Central Street.
Mr. Peach conveyed that it is time replace Committee members that have been continuously
absent from meetings. It was suggested that Mayor Morton be apprised of this need so that she
can expcdite the process.

It was moved and seconded that the above minutes be approved as drafted. The motion carried.
111. Staff Report
M W'EBE Partic vaiion lemon
Mr. Shepard reported that Optima Views Condominium. Church Street Plaza. has and MAV/EBE
participation of 1211G. The total project cost is S37.345,727 and MAV. EBE is $4,526,445. This
falls well below the 25", minimum M A%* EBE requirement of 25%. Mr. Peach suggested that
when the Optima Views M NV EBE participation report is presented to the Evanston City Council
it should reflect that Optima Inc. did not demonstrate the effort to achieve the 25% MAV/EBE
participation. Mr. Peach's statement was made in light of the fact that other general contractors
working under the Cir% of Evanston .\l W EBE requirements have met or have come very close to
the 25% M NV EBE minimum goal.
Mr. Shepard reported in contrast that the Me}ne Company has achieved a 24°b S1AV/EBE
participation for the Levy Center. Mr. Shepard added that both companies had the same Mctro
area M.AV EBE construction companies and suppliers to solicit from.
Mr. Peach reiterated that %%hen the M W EBE Advisory Committee makes it's final report to the
Evanston City Council regarding Church Street Plaza. he wants to emphatically point out the
difference in the effort of the various general contractors. 41r. Peach added that general
contractors need to understand that the Cup of Evanston is serious with its intent for such
contractors to meet the 24 ,, minimum .11 fit,' EBE participation goal. Further. the maximurn fine
that can be applied to Church Street Plaza for general contractors not meeting a combined 25%
minimum M W EBE participation should be levied.
.Mr. Shepard added that Bov:s Lend Lease had achieved the highest M W EBE participation for
construction of the Pa-, Ilion at 21 °io. The hotel was 13%, the parking garage was 7.25%, and the
McDougal Littel Building was 16%.
Mr. Shepard next reported on the three Sewer Relief Projects that all met the 150,6 minimum
WWESBE compliance requirement. Two of the three projects have had their loans approved by
IEPA. The Sewer Relief Projects met M %\' EBE participation as follows:

Total City Council contract awards. S15.000 and above, total $9.868.086. Total M'W"EBE
participation is S2.405.802 or 24.4%,Mr. Shepard explained that the under S 15.000 purchases will
not be reported until after the first quarter ending Niay 31. 2003. to build data. Mr. Shepard
reported that the new J.D. Edwards system would only retrieve vendor data classified as
M W EBE. The Access program mixed all purchases even the post office and utilities. Alderman
Baptiste has requested that data be retrieved in the runonty classification in sub -categories based
on race.
Mr. Shepard reported that W.E. O'Neil, general contractor for the Sherman Plaza Project, will
build the condo tower shell. the garage and the north and south retail buildings. O'Neil had to
perform value engineering for the condominium. Lakeshore Development and Focus
Development the condominium owners are currently evaluating O'Neill bid. The interior build
out of the condo tower will be done by Focus De►elopment's construction company Focus
Construction,
Mr. Shepard added that the drawings for the retail components were released today for bidding.
The garage drawings will be released this Friday for bidding. The bidding process w711 take
approximately 3 weeks and another 2 weeks to analyze bids. O'Neil is projecting mid May for
completion of the total budgct for the project. The project owners will seek financing once the
budget is approved.
The demolition of the garage will not take place before June. The garage demolition will take 2
months. However, construction will start as soon as there is room to place caissons and drive
sheeting for soil retention and water containment.
Next. Mr. Shepard reported the M W'EBE Program will conduct its second Emerging Business
Financing Seminar. The seminar will again be cosponsored with the Small Business Development
Center of Evanston. Rick Holbrook. Director. The Can will sponsor its annual vendor fair
sometime between August and October. The City u all cosponsor with Northwestern C. its annual
Vendor Fair in November. Preliminary discussion regarding the City N.U. Vendor Fair is to
expand it by including private sector corporations as buying organizations.
IV. Old Business
District 65
fir. Dick Peach reported that Mr. Jonathan Perman. Executive Director, Evanston Chamber of
Commerce and he met with Mr. Greg Klaiber. Chairman. Finance Committee, District 65 to
express their concerns regarding the absence of meaningful business relationships between District
65 and Evanston businesses. Mr. Peach indicated that Northwestern University is doing an
excellent job in expanding businesses opportunities for Evanston companies. Northw'esterrt did
S 12 million in 2001 and is headed for S 17 million in 2003. The amount of money District 65
spends pales in comparison to Northwestern L'.

Further, Mr. Peach asked both Districts 65 and 202 if they could duplicate the City of Evanston's
5% purchasing preference for Evanston corr*unies. The Districts could not duplicate such a
preference policy citing the fact that the City of Evanston is a hoax rule entity. The discussion
then focussed on Districts 65 and 202 leveltrtg the playing field for Evanston businesses by
offering opportunities in all areas where there are capabilities and particularly in the discretionary
purchases under S10 thousand. In response. Mr. Klaiber. District 65. indicated that he would
pursue a directive for purchasing from local ►endors under the S I0 thousand ceiling.
Mr. Peach added that Mr. Pemmn and be would make a presentation March 28, in follow up with
the Klaiber meeting, with all members of District 65's Finance Committee as well as other Board
members.
The Major criticism of District 65 is it built a S 14 million building and only S 100 thousand went
to Evanston businesses. This reflects a very minimal effort by District 65 to do business Iocally.
It was added that District 65 used a company from Schaumburg to move to the new administration
building.
Additionally, Dr. Hardy Murphy is to have Principals meet with the business community on a
personal basis to develop a working relationship for doing business as well as having businesses
support schools.

It was moved and seconded that the above minutes be approved as dratted. The motion

III. Staff Report
4L'ti%'/EBE Particination Report
Mr. Shepard reported that there was little change from the previous month's report.
There Were two Council awards. The Harbert Park Bike Path Project for S105,000 and
the Dempster Street Beach Office Project for S82.940. The bike path project was
awarded to an MBE and the Beach Office project will have a 36616 M/W1EBE
participation at S30,200.
ti1(r. Shepard reported that Optima Views MAV EBE participation remains the same as
previously reported at 12%. Additionally, Mr. Matt Cison. Optima Views Project
:Manager, conveyed that 9W/EBE participation could be increased between this
reporting period and the project completion date of February 2004. Mr. Shepard
indicated that Mr. Cison was unable to support how the increase would be achieved.
Mr. Shepard reported that W.E. O'Neil Construction Company has received bids for the
Sherman Plaza Project's condominium tower and subsequently submitted a budget to the
owners Lakeshorc/Focus Development.
The bids for the north and south retail buildings are being evaluated and will be
submitted to the owners KlutznickFischer in two weeks.
The garage drawings were received by O'Neil last week and are going out to bidders
Thursday or Friday of this week. Bids will be due April 291s. There will be a two week
review and the final budget will be submitted to the owner (City of Evanston) by mid
May. The demolition of the municipal garage has been moved from June to July.
Demolition will take two months.
O`tieil will do the core and shell work on all structures. Focus Development will have its
construction company build out the condominiums.

Mr. Shepard conveyed that DiPaolo Construction Compan} has completed the classroom
training component of the Phase 6 Contract C Sewer Relief Training Class. The program
required a training class of 6 Evanston residents and a minimum of 3 graduates. Of the 6
trainees. 3 were deemed unable to participate in the employment component at the job
site after undergoing physical tests. Two were evaluated with irregular heartbeats and
one unable to lift 95 pounds. The trainees' doctors disagreed with the heart tests and
indicated the individuals were capable of project site work. These three trainees have
gone to the City's Human Relations Department to file dis.-nmination complaints.
DiPaolo is to follow up with.Mr. Shepard with a written explanation of what transpired.
Mr. Shepard reported that Belmontee Kaplan Development Company, the general
contractor for Fleetwood Jourdain Locker Room Rehab Project, was found in
noncompliance after beginning the project. Belmontee had initially submitted an
\i-' IEBE Utilization Plan over 3010 then reduced the percentage to a 5014 utilization by
changing subcontractors. Belmontee was brought back into compliance by holding their
progress payment until \i W/EBE participation was increased to 25%.
Old Business
District 65
Mr. Dick Peach indicated that Mr. Jonathan Perman and he met with the District 65
Finance Committee and Dr. Murphy. Superintendent, and \fr. Lutauf Dhanidina, Chief
Financial Officer. The meeting focussed on how District 65 could begin to increase
spending with local businesses particularly for purchases under S10.000. Additionally,
District 65 was asked to implement a full-blown policy for such a purchasing process.
The District agreed to implement such a policy. District 65 was also urged to become
more involved in the economic development decisions of Evanston given the fact that
property taxes impact District revenue.
Mr. Peach added that the Chamber of Commerce is requesting that W.E. O'Neil, Rozack
and other contractors and developers respectively, provide a working list of areas that
nonunion contractors can participate. It is envisioned that such information would
increase local participation in construction projects. The idea is to eventually use the
City's M/nv/EBE office as a clearinghouse for construction industry opportunities.
