1. CALL TO ORDER:
Del Leppke noted that a quorum was not present and called the meeting to order at 7:20
a.m. He acknowledged the presence of Dave Gnunman, William Siegfriedt and Andy
Dickerson.
H. COMMITTEE REPORTS
A. Energy Supply, Transmission Contracts, Liaison Activities and
Innovative and Emerging Energy Opdons
Joel Freeman drew the Commission's attention to one of the pamphlets from the
Illinois Department of Revenue included in their packet entitled "Illinois Gas Use Tax
and Gas Revenue Tax Changes". He pointed out that as of last year there is a tax of
2.4 cents per therm of gas collected by delivering suppliers.
Mr. Freeman reported that in the next month, ComEd would be posting their electric
prices for unbundled electric service. This will give new opportunity to evaluate
unbundled electric pricing compared to bundled electric pricing.
In light of conversations with the Environmental Board and Del Leppke, Mr. Freeman
put together a draft letter as a starting point to outline some of the recommendations
that he thinks would be good for the Energy Commission to represent to the City. He
said the letter centers around the International Energy Code.

Del Leppke commented that the presentation given by the Evanston Electrical Future
at City Council was very well done. He said it was very well organized and made
quite an impact. Mr. Freeman said that the Mayor sent a letter to each of the people
that made a comment regarding the energy code. There were varying interpretations
as to what that letter was supposed to do. He said that that while the letter was a
positive signal from the Mayor to send anything at all, his interpretation of the letter
was that the Energy Commission is one of the official channels as an advisory body
to the City and these kinds of recommendations, while good to be expressed by the
citizens, should come through a body like the Energy Commission.
Mr. Leppke asked what the process is for developing an ordinance, how it is an
initiated, and who initiates it. Dennis Marino replied that in this case it would be
done in concert with the other codes that would be considered by the Planning and
Development (P&D) Committee. The ordinance would then be introduced at one
City Council meeting and adopted at the next City Council meeting. Mr. Leppke said
that the Energy Commission reports to A&PW, but need to have documents go to
P&D also because it is their purview that decides how to move forward with codes.
Commission members discussed Joel Freeman's draft letter of recommendations to
the City Council. The letter was referred back to the Energy Supply, Transmission
Contracts, Liaison Activities and Innovative and Emerging Energy Options
Committee.
B. Governmental Policy and Legislative/Regulatory Actions
No Report.
C. Oversight, Monitoring & Inspection Actions
There will be a meeting of the Technical Review Group (TRG) later in January to
address some of the concerns addressed at the previous TRG meeting. Rudy Wolfson
said that Dave Metz would be attending a meeting in January.

III. COM ED QUARTERLY REPORT 12-31-03/ TECHNICAL REVIEW GROUP
Del Leppke commented that in the ComEd Quarterly Report 12/31/03 page 4, Evanston
is faring well concerning the average number of interruptions per customer. One of the
questions he will ask at the next TRG meeting is what effect the reorganizing is having
on repair teams and maintenance teams readily available.

Mr. Leppke said that the equipment and material failure has a high effect on the number
of interruptions. In the year 2001 there were 49 interruptions due to equipment failure, in
2002 there were 51 interruptions, and through November of 2003 there were 43
interruptions. He felt that this was a high number of interruptions. Commission
members were concerned with the explanations given for the interruptions.
Mr. Leppke pointed out that over the years the number of circuits that have projected
loadings above 90% have increased from only 6 or 7 circuits on this whole list, to 17 or
18 circuits most recently. There is a progression of high loadings. He said that Dave
Metz said that a 3 to 5 year plan should be considered. Paul Morse said that at a TRG
meeting in 2003 ComEd stated that they were not going to do anything about the loading
at this level, that they are within their design criteria and 102% is within their criteria.
IV. MEMBERSHIP
Dennis Marino stated he would inquire about the status of potential new appointments.
V. COMMUNICATIONS
Dennis Marino said that the communications dealt mostly with reliability issue articles
from Public Power Weeklv. He summarized several of the articles for the Commission

Statute, paragraph 42 of the Open Meetings Act, the Energy Commission is eligible to go
into Executive Session to develop a negotiating strategy concerning conveyance of
interest of the City's rights -of -way. Motion seconded by Jackie Brown. Voting Aye:
Paul Morse, Joel Freeman, Rudy Wolfson, Jackie Brown, Delbert Leppke, The
Commission went into Executive Session at 8:24 a.m.
The Commission came back to the open meeting at 9:10 a.m.
VI. RECENT OUTAGES
Max Rubin reported that there was an outage on Circuit C8814 January 6, 2004. The
outages lasted six hours and 191 customers were affected. There was an outage
November 24, Circuit C4711 due to a cable fault.

VIL CONSIDERATION OF ENERGY COMMISSION MEETING DATES FOR 2004
The Energy Commission members accepted the meeting dates into the record. Dennis
Marino said he would not be at the April 1, 2004 meeting. Max Rubin agreed to staff the
April meeting. Del Leppke stated he would not be able to attend the March 5, 2004
meeting.

I. CALL TO ORDER:
Del Leppke noted that a quorum was present and called the meeting to order at 7:20 a.m.

II. COMMITTEE REPORTS
A. Energy Supply, Transmission Contracts, Liaison Activities and
Innovative and Emerging Energy Options
Joel Freeman distributed a draft memo regarding the adoption of an Energy
Conservation Code and asked for the Commission's continents. After much
discussion, Del Leppke said it was his understanding that the Commission wanted
to continue to try to be ready for the next A&PW meeting with respect to their
endorsement of House Bill 4099,
Mr. Freeman said that the overall price of gas is expected to go steadily up. He
said there would be a point where buildings and manufacturing will look to other
ways of doing business when the price of gas gets to a certain point.
B. Governmental Policy and Legislative/Regulatory Actions
Arlene Haas reported that the Energy Efficiency Act is back in a new version.
Ms. Haas moved that the Energy Commission recommend that A&PW
recommend that the City Council endorse the Proposed Illinois Energy Efficient
Building Act (HB 4099). Motion seconded by Paul Morse. Motion passed
unanimously.

C. Oversight, !Monitoring & Inspection Actions
Rudy Wolfson said that the Technical Review Group would be meeting after the
current meeting adjourns. He said the latest ComEd report will be reviewed.
D. Distribution Systems Franchise & Provider Agreements and Liaison
Activities
Paul Morse reported that he and Arlene Haas met with Del Leppke and Rudy
Wolfson to conduct franchise research. He felt that they did achieve a better
understanding and also that they have started a list of provisions that could be
incorporated into a new Letter of Agreement or franchise. Mr. Morse said that a
draft will be completed that can be discussed among the entire Committee. This
draft will consist of a long list of things the Committee would like to get out of a
new Agreement of Franchise and whether it will be in a one or three year
extension.
In reply to a question from William Siegfriedt, Del Leppke said that the current
franchise is very simple. It does not address the issue of separation of supply and
distribution. He felt that this was one of the faults with the current franchise. The
extensions have primarily focused on reliability. Mr. Leppke said that part of the
debate the Negotiating Team deals with is can very limited issues be focused on
or would it be better to go to a completely new franchise where the issue of
separation of supply and distribution could be addressed.
E. Chairman's Report
Del Leppke reported that Debbie Hillman asked that the Energy Commission
schedule some time for the presentation by the team that is working on putting a
wind turbine at the Ecology Center. Commission members agreed to put Ms.
Hillman on the agenda for the March 3, 2004 meeting.
III. CONSIDERATION OF MINUTES OF DECEMBER 2, 2003 AND JANUARY 9, 2004.
Rudy Wolfson moved approval of the December 2, 2003 minutes. Motion seconded by
Jackie Brown. Motion passed unanimously.

IV. POTENTIAL FRANCHISE DISCUSSION
It was decided that the subcommittee would meet as soon as possible to be ready for
submittal to the Commission at the March meeting and then schedule a Negotiating Team
shortly there after so the process can be started. He said that interplay with ComEd
needed to be started as soon as possible to be ready for the July deadline.

Commission meeting to Wednesday, March 3, 2004. Motion passed unanimously.
V. MEMBERSHIP
Del L.eppke welcomed William Siegfriedt as a new member in the Energy Commission.
Mr. L.eppke stated that he would be meeting with the Mayor to discuss the need of more
Commissioners.

U. CONSIDERATION OF MINUTES OF FEBRUARY 3, 2004
Rudy Wolfson moved approval of the minutes of February 5, 2004. Motion seconded by
Arlene Haas. With minor corrections, the motion passed unanimously.
111. ECOLOGY CENTER WIND TURBINE PRESENTATION
Debbie Hillman and Ross Vagnieres, members of the Evanston's Energy Future,
distributed brochures entitled "A New Wind Generator For Evanston's Ecology Center."
Ms. Hillman said that City money was not being asked for, but that there would be some
administrative time that is estimated to Cost the City approximately $1,0W or $2,000.
Ms. Hillman said that the cost for the project is expected to be $60,000 to $70,000, all of
which will be raised through grants and fund raising. She added that it was hoped that
enough money could be raised to create an endowment that would be used for
maintenance of the wind generator. Ms. Hillman added that this wind turbine would be
put on the same foundation as the current non -working generator.
Replying to a question from a Commission member, Ms. Hillman said that after the
Energy Commission endorses the wind generator, hopefully the Environment Board will
endorse it, and then it goes back to the Ladd Arboretum Committee.

Dennis Marino mentioned that this project would need City Council approval, most likely
through the A&PW Committee. While the land is not City owned it is controlled by the
City under a lease agreement. Del Leppke asked if Ms. Hillman had spoken with the
Water Reclamation District, owners of the land, and if they had made any statement. Ms.
Hillman stated that the lease is in place until 2032, but that the Water Reclamation
District could terminate the lease with a six-month notice.
Mr. Leppke inquired about the noise level and if the neighbors of this project are aware
of it. Ms. Hillman said that the noise level is very low, that a member of their Committee
went to an installation in a western suburb and stood at the base of the wind generator
with a tape recorder. It was very hard to hear any noise of the recording, She added that
they plan to install a weather station on the wind generator.
Joel Freeman moved to recommend the wind generator for Evanston's Ecology Center to
A&PW with the following conditions: (1) That the City provide only the basic
administration of the project; (2) capital expenditures will come from other sources; (3)
the City will review the provisions for accounting for maintenance costs in the future, and
(4) the City will designate someone to be the recipient of grants or donations and set up
an account for that purpose. Rudy Wolfson seconded the motion. Discussion ensued.
Motion passed unanimously.
IV. COMMITTEE REPORTS
A. Energy Supply, Transmission Contracts, Liaison Activities and
Innovative and Emerging Energy Options
Joel Freeman drew the Commission's attention to the literature distributed earlier
regarding the past history and future expectation of gas prices.
B. Governmental Policy and LegisIative/Regulatory Actions
Arlene Haas reported that she had made a presentation on House Bill 4099 to the
A&PW Committee on Monday, March 2, 2004. The two main concerns raised by
members of the A&PW Committee are what is the International Energy Code,
and who is the Capital Development Board. She said that she was looking to
James Wolinski, Community Development Director to provide information on the
International Energy Code.
Del Leppke said that the House would adjourn at the end of this week (March 6,
2004) and not reconvene until about March 20, 2004. Julie Hamos's office said
they expect the HB4099 to came to the floor the sometime between March 20,
2004 and the end of April 2004.
Regarding whether the Northwest Municipal Conference has made any statement
regarding the code, Mr. Marino stated that the 2004 Legislative Program for the

Northwest Municipal Conference has two energy items included, improved
electric service reliability, and the second requires ComEd to account for capital
improvements by municipalities. He mentioned that a legislative priority that is
high on the conference's list is unfunded state mandates. The conference has
introduced legislation themselves to amend the State Mandates Act to create a
mechanism whereby local governments can attempt to recoup costs associated
with implementing mandates by requiring state agencies to review claims
submitted by local government in a timely manner. It also requires a State board
to hear appeals from local governments on the issue of State Mandates.
Del Leppke summarized the Commission's discussion by saying that at this point
the Commission wants to meet with James Wolinski, and would also like a redraft
of Joel Freeman's letter for the Commission to act on at the April meeting.
C. Oversight, Monitoring & Inspection Actions
Rudy Wolfson reported that there was a meeting of the Technical Review Group
(TRG) on February 4 h. Continuing and forthcoming projects in the City were
discussed. Projects pointed out to ComEd included Sherman Plaza, four
condominium buildings (221 units) on Oak, Clark and Ridge, a 20-story building
west on Maple south of Davis, north on Maple across from the YWCA there is a
proposed 150 units. Dennis Marino added that there is a proposal for a 221 unit
building on Evanston's side of Howard Street.
V. COIVIED RELIABILITY REPORT JANUARY 2003 - JANUARY 2004
Del Leppke thanked Max Rubin for sorting this report by various topics. He said it was
very helpful in finding the circuits with the most problems.

into Executive Session to develop a negotiating strategy concerning conveyance of

members voting aye: Arlene Haas, Bill Siegfriedt, Jackie Brown, Rudy Wolfson, Joel
Freeman, Del Leppke. The Energy Commission adjourned into executive session at 8:50
a.m.
The Energy Commission resumed the open hearing at 9:20 a.m. Rudy Wolfson made a
motion to cancel the Energy Commission originally scheduled for Wednesday, April 1
2004 and reschedule it for Tuesday, March 31, 2004. Motion was seconded by Joel
Freeman. Motion passed unanimously.
VIL MEMBERSHIP
Dennis Marino stated that at this point, there are 7 Commission members and that 11 is
considered a full Commission. He said that he had received an email from Alan Kistler

stating he was retiring from the Energy Commission. Joel Freeman mentioned that he
had received a call from Stefano Mereu and said that the Mayor's secretary had called
him. With Mr. Mereu the Energy Commission has 8 mrinbers with 3 vacancies.
EL RECENT OUTAGES
Max Rubin reported that there have been two recent outages. One was a scheduled
outage to clear a tree condition. The second outage was an underground vault failure on
February 25 that lasted approximately 2 hours.
X. COMMUNICATIONS
Dennis Marino directed the Commission's attention to the communications included in
their packet. Communications were accepted into the record. He said that Dave
Grumman had given him a copy of ASHRAE Greenguide and that he would include
some excerpts in the next packet.
M. OTHER BUSINESS
Joel Freeman mentioned that there is a group (League of Women Voters, Chamber of
Commerce and the Evanston Environment Board) that will hold two meetings in April.
One meeting is on Thursday April 22, 2004 at Northwestern University's Harris Hail,
Room 107 titled Envisioning a Sustainable City - a lecture by John Norquist. The second
meeting will be on Thursday, April 29, 2004 at 7:30 p.m titled Creating a Sustainable
Evanston, held at Beth Emet the Free Synagogue at 7:30 p.m. Mr. Freeman moved that
the Energy Commission cosponsor these two events. Rudy Wolfson seconded the
motion. Motion passed unanimously.
XII. ADJOURNMENT
Jackie Brown moved adjournment. Arlene Haas seconded the motion. Motion passed.

Jackie Brown moved approval of the minutes of March 3, 2004. Motion seconded by
Paul Morse. The motion passed unanimously.
III. COMMITTEE REPORTS

Innovative and Emerging Energy Options
Joel Freeman drew the Commission's attention to the two articles he handed out
before the meeting. To illustrate the significance of one of the articles "ComEd
Gets FERC OK To Complete Integration Into PJMlnterconnection, " Mr.
Freeman described an unnamed client that had a utility bill of $800,000 or
$900,000 a year.
The second artile discussed was: "Energy Conservation Squeezed " Demand
Side Management: DSM In A Deregulated Market. Mr. Freeman stated that the
Demand Side Management is, in essence, reducing peak demand by any means at
all. The article has two main points: if you reduce demand on the system your
reliability will improve, and you may not have to build generator facilities.

B. Governmental Policy and Legisla dve/Regulatory Actions
Del Leppke said he understood that House Bill 4099 has not yet been called up
for a vote. It is thought that the Bill would go to the floor sometime in April.
C. Oversight, Monitoring & Inspection Actions
Rudy Wolfson said that one of the issues for the TRO is to clarify ComEd's
statement that loading may not relate to the size of the conductors on any
particular feeder but more to the substation's transformer size.
When asked if Dave Metz had reached any conclusion about circuit design and
loading criteria, Paul Morse mentioned it would be helpful for Mr. Metz to
address the Commission on these issues. Del Leppke said it would be a good idea
for Mr. Metz to present his analysis and conclusions to the Commission. Dennis
Marino said he would ask Mr. Metz to be at the May 4 Energy Commission
meeting.
D. Distribution Systems France & Provider Agreements
and Liaison Activities
Dennis Marino reported that tbene would be a meeting of the Negotiating Team
on Friday, April 16, 2004.
IV. MEMBERSHIP
Del Leppke welcomed Stefano Mereu as a new member of the Energy Commission
V. ENERGY CODES
Del Leppke announced that there was a training seminar covering the New Energy
Efficiency Commercial Code today sponsored by the Metropolitan Mayors Caucus at
Oakton Community College. Dennis Marino mentioned that that dames Wolinski,
Community Development Director, Carolyn Brzezinski, Assistant Director for Building
and Walter Hallen, Plans Examiner would also be attending this seminar. Mr. Leppke
stated that there is a residential code seminar on April 7 at Oakton Community College
VI. RECENT OUTAGES
Dennis Marino reported that he was not aware of any significant outages reported by Max
Rubin.
VII. COMMUNICATIONS
Dennis Marino drew the Commission's attention to the communications included in their
packet. Regarding one of the communications entitled Report Faults Industry Tree -
Trimming Practices, Says Blackout Could Have Been Prevented, Del Leppke asked if
there was anything that Mr. Marino saw in this article that could impact the City's
franchise. Mr. Marino replied that vegetation management has been a significant issue in

the past. Paul D'Agostino, Superintendent of Parks and Forestry is the liaison to ComEd
for any permits related to this issue. He added that tree trimming is something the
Commission may want a report ofwben it goes into the next round of negotiations.

and Emerging Energy Options
*State of Illinois Energy Conservation RFP
Joel Freeman distributed several articles to the Commission members regarding
deregulation and a combined news release from PJM Interconnect and ComEd
announcing the integration of ComEd into the PJM Interconnect. He said that two
advantages of this integration were wholesale electricity and organization electric
transmission.
Mr. Freeman mentioned that the deadline for the Department of Commerce and
Economic Opportunities to receive applications for their grant is Friday, May 21,
2004. He handed out diagrams he had made regarding how this grant would be
administered and elaborated on this list for the Commission members. Discussion
among Commission members ensued. It was the consensus of the Commission to
encourage Mr. Freeman to proceed with this application for a grant.
B. Governmental Policy and Legislative/Regulatory Actions
Arlene Haas said that in following the Efficient Energy Commercial Building Act
it has passed the House and passed a committee in the Senate but has not passed
the full Senate. She added that there has been a number of addendums to the bill,
including requiring the Capitol Development Board to consult with the Board of
Commerce and Economic Opportunity. The bill was to take effect a year after
being passed by the Senate, but now when passed it will become effective
immediately.
Dennis Marino drew the Commissions attention to a model ordinance included in
their packet. It deals with the International Energy Conservation Code and the
amendments related to that.
C. Oversight, Monitoring & Inspection Actions
Rudy Wolfson said Dave Metz would be discussing this later in the meeting.

M. DISCUSSION OF ELECTRIC SERVICE RELIABILITY WITH DAVE METZ
Dennis Marino explained that Dave Metz has been the Commission's consultant since
1998 and has been important in the Commission's understanding the distribution system.
Mr. Metz wrote the Stanley Report which has been referred to by this Commission many
times.
Mr. Metz gave an overview of what has occurred in the time he has been involved with
the Energy Commission. When he was first retained by the City of Evanston, 37% of the
outages were classified by ComEd as unknown causes. He referred the Commission to
the Stanley Report of March 29, 1999 and The Liberty Report of .tune 2000 which was a
scathing report on ComEd and their dereliction of duty to maintain items. The latest
report from ComEd showed unknown outages as 2% or 3%. At meetings ComEd has
gone from being aloof to the problems expressed by Evanston citizens to responding to
these problems. When ComEd was before the Illinois Commerce Commission, ComEd's
representative stated that ComEd was focused on reliability from the consumers'
perspective. Mr. Metz said that when that presentation was given, ComEd had
completely changed their attitude. The City was getting good information, ComEd was
sensitive, and there were many changes in personnel. Mr. Metz said that he thought
Evanston had a lot to do with the fact that ComEd has changed its attitude toward
Evanston consumers by not settling and requiring ComEd to be accountable.
Mr. Metz recommended that a three-year franchise is in order and suggested that the
Commission get a three-year planned projected load on all the feeders in Evanston and a
projection of what ComEd might do to fix them. Mr. Metz's overview was followed by a
question and answer period.
V. MEMBERSHIP
Dennis Marino stated that there were no new memberships to report.
VI. ENERGY CODES
Del Leppke said that he went to the seminars sponsored by the Mayors Council on the
International Energy Conservation Code. He said he received the code book and some
power point slides of a review of the code. The Code is structured in two parts, one part
covers commercial buildings and the other covers residential buildings. Mr. Leppke gave
an overview of the seminars.
VII. RECENT OUTAGES
Dennis Marino reported that he had not had a report from Max Rubin's office. He did
hear that a contractor digging up a ComEd line had caused some outages.
VIII. COMMUNICATIONS
Dennis Marino drew the Commission's attention to the Communications included in their
packet. Communications were accepted into the record.
IX. POTENTIAL FRANCHISE DISCUSSION
Rudy Wolfson reported that at the last Negotiating Team meeting the proposed franchise
was discussed. A meeting with ComEd is being considered for Thursday, May 27, 2004.
Del Leppke stated that Arlene Haas and Paul Morse have been working on some
elements of the franchise. In addition to that, some overall objectives for franchise
extension are being considered.

Jackie Brown reported that she will not be at the June 9, 2004 Energy Commission
meeting.

Joel Freeman elaborated on the materials he included in the Energy Commission
Commissioners packet. Those articles included: ", Issue Alerts: "Demand

Relations. A Cinderella Story," Issue Alerts; "Hybrid Cars on Fast Track," Issue

ASHRAE; "California Energy Commission OK's New Building Standards to Cut
State Energy Use" GreenBiz.Com and an excerpt of the City of Evanston's
Community Development Budget as it pertains to energy.
B. Governmental Policy and Legislative/Regulatory Actions
Arlene Haas reported that she spoke to Nanay Wagner of the Environmental and
Policy Center (the bil. passed both houses and is waiting for the Governor's
signature) who said that they have 30 days to get the bill to the Governor and he
has 90 days to sign the bill. The Environmental and Policy Center is asking
citizens to write a letter to him recommending he sign the bill. Ms. Haas added
that the language of the bill has been changed to "upon its passage into law it
would become immediately effective." It is envisioned that communities will
actually have one year from the time the bill is made law to start to implement it
and that the enforcement is up to local communities. The Department of
Commerce and Economic Opportunity is going to be doing training in different
communities.
When Ms. Haas asked Ms. Wagner if there is a possibility that a residential
efficiency bill could be passed, she said it would take at least two years for the
Environmental and Policy Center to start working on that because they want to
oversee how the commercial bill is working.
Ms. Haas reported that she, Del Lcppke, Joel Freeman and Dennis Marino met
with James Wolinski. Mr. Wolinski was glad that the bill would be signed
making it easier for his department than trying to get an ordinance passed. Also
discussed was the possibility of getting something in the works for a residence
bill, but some of Mr. Wolinski's staff thought it best to wait and see how the
commercial energy efficiency requirements are implemented before we suit
trying to do something about the residential area. Paul Morse asked if the bill that
is about to be signed addressed the large multiunit residential. Ms. Haas replied
that it includes three stories and above. Ms. Haas said that Mr. Wolinski
suggested the City write a letter to the Governor recommending the passing of the
current bill. Ms. Haas moved that the Evanston City Council send a letter to
Governor Blagojevich requesting his approval of House Bill 4099. Motion
seconded by Paul Morse. Motion passed unanimously. Joel Freeman volunteered
to draft a memorandum to attach to this letter. Ms. Haas stated she would be
unable to attend the June 28, 2004 meeting of the City Council.
C. Oversight, Monitoring & Inspection Actions
Rudy Wolfson reported that the Last Technical Review Group (TRG) meeting, at
which Mike Radziewicz from Com Ed and Dave Metz, the City's consultant were
in attendance, was held after the last Energy Commission meeting. Topics
discussed included the April 30 report from ComEd. Through March 2004, the
average number of interruptions per customer was 0.62 versus an overall ComEd
average of 1.26, the target is a maximum of one outage per customer. The
average length of outage was 99 minutes and our target is an average of 60
minutes.
They discussed the timing and the fact that in most cases it takes Com
Ed longer to get to the fault than it does to fix the problem. The TRG would like
the duration and frequency curve to be based on Evanston and not the entire
system. He said that all in all the TRG asked ComEd for more specifics in
loading. In 2003 trees were the highest cause of failure. Mr. Wolfson added that
the Lt. Governor is setting up a task force to evaluate tree trimming methods
CotnEd has developed a four year cycle of trimming and also has increased the
surveillance and trimming in the area of substations.
Del Leppke said that in reviewing his notes, the three worst performing feeders in
Evanston were C661, C47I6, and C615. This was presented to ComEd and asked
for criteria on how they determine the worst Circuits.
IV. MEMBERSHIP
Dennis Marino reported that there was nothing new to report.
Bill Siegfriedt reported that he is now employed with Stanley Consultants, and Dave
Metz (the Commission's consultant) is employed by Stanley Consultants. However, Mr.
Siegfiiedt saw no conflict of interest because he is not in the position to hire or fire a
consultant and Mr. Metz is not in the position to gain from Mr. Siegfriedt's position on
the Energy Commission.
V. ENERGY CODES
Joel Freeman mentioned that James Wolinski, Director of the Community Development
Department expressed that he would be willing to meet once the commercial code bill is
signed.
VI. RECENT OUTAGES
Dennis Marino commented on several outages that occurred during the past month.
Details of these outages can be found on the City of Evanston website.
VII. EXECUTIVE SESSION
Rudy Wolfson made a motion to go into executive session under Chapter 102, Illinois
Revised Statute, paragraph 42 of the Open Meetings Act, to develop a negotiating
strategy concerning conveyance of interest of the City's rights -of -way. Motion seconded
by Paul Morse. The following Commission members voted aye: Rudy Wolfson, Joel
Freeman, Del Leppke, Paul Morse, Bill Siegfriedt, Arlene Haas, and Stefano Mereu. The
Commission went into Executive Session at 8:42 a.m.
Meeting resumed at 9:25 a.m.
VIII. MEETING DATE CHANGE
Rudy Wolfson moved that the July 1, 2004 meeting be moved to Wednesday, June 23,
2004. Paul Morse seconded the motion. Motion carried.

*State of Illinois Energy Conservation RFP
Joel Freeman distributed an article entitled "Nuclear Powers On Promise Of A Given
Environment." He said that one of the interesting things about this article is the
financing side -getting a loan and the level of risk that will be taken by the nuclear
power provider. Mr. Freeman saw this as the biggest hurdle of nuclear power. Mr.
Freeman also distributed an article about the fact that the City of St. Charles has opted
to go with the Illinois Municipal Electric Agency for its electricity beginning June 1,
2007 to September 30, 2035. According to the article St. Charles didn't go with
ComEd because ComEd didn't want to give them a fixed price.
B. Governmental Policy and Legislative/Regulatory Actions
Arlene Haas was not present at the meeting. Del Leppke said that he spoke with Ms.
Haas on June 26 and as of that date the Governor had not signed HB4099.

Del Leppke reported that the producers of the "Our Town" television program on
community television are interested in putting together an interview on energy
conservation codes and probably on the franchise. He said that he has agreed to be
interviewed and asked Joel Freeman to be interviewed also.

V. ENERGY CODES
Dennis Marino said that Ordinance 77-0-04 would be an item for consideration of the
Administrative and Public Works Committee at its June 28 meeting. Since this is an
action by City Council by motion, it can be done in one night. Included with the packet
is the memorandum addressing A&PW and the City Council Committee from the Energy
Commission encouraging them to send the letter to the Governor encouraging him to sign
H134099. After discussion, it was the consensus of the Commission to present this
memorandum to City Council at its June 28 meeting.
VI. RECENT OUTAGES
No new outages were reported.
VIL COMMUNICATIONS
Communications were accepted into the record.
Del Leppke said that a memorandum included in the communications reported that the
Evanston Township High School (ETHS) was shutting their co -generator down. In the
memo written to Dr. Allan Alson by Steve Z. Grbavac, it was recommended that ETHS
sign a contract with Constellation New Energy for 12 months starting with June 2004.
VIII. EXECUTIVE SESSION
Rudy Wolfson moved to go into executive session under Chapter 102, Illinois Revised

Del Leppkc noted that during the Executive Session the Energy Commission reviewed items that
had been taken up with ComEd during the sessions that the Negotiating Team had with ComEd.
ComEd will prepare a draft Letter Of Agreement to the Negotiating Team in the near future and
that will be reviewed by the Negotiating Team and accepted or rejected for further revision. Mr.
Leppke said the general content has been reviewed with ComEd and a three year extension of the
existing franchise would be appropriate to get us to the year 2007. Members present agreed
unanimously that a 3 year extension with an appropriate letter of agreement was desirable. At
that time consideration for a longer tern franchise agreement will be undertaken that has been
satisfactory both to the City and to ComEd. Dennis Marino and Del Leppke added that 2007 is a
particularly important year because that is the first year after the transition is completed winding
out of the deregulation process in Illinois.

Joel Freeman reported that according to some articles he read, Wisconsin
Governor Doyle's task force recommended that Wisconsin utilities boost their

environmentally friendly generated electricity by 6%. This is after the Governor
had asked the utilities to commit voluntarily to generating 10% of their electricity
from renewable sources. He said that apparently, Wisconsin already generates
4% of their power from green sources.
Evidently, Wisconsin has to deal with their budget, so money taken in that was
going to be used for energy conservation efforts is being diverted to balance the
budget. He added that Wisconsin Public Service Corp will buy 70 megawatts of
wind power from the proposed Forward Energy wind project in Brownsville and
three of Wisconsin utilities are going to buy 130 megawatts from a wind farm that
will be developed by Invenergy Wind of Chicago. Madison Gas & Electric plans
to buy 40 megawatts from the project, while Wisconsin Public Power Inc. of Sun
Prairie plans to buy 20 megawatts.

Arlene Haas stated that HB4099 is still on Gov. Blagojevich 's desk.
C. Oversight, Monitoring & Inspection Actions
Rudy Wolfson reported that there has not been a meeting of the Technical Review
Group since the last Energy Commission meeting. Del Leppke mentioned that
ComEd would send the Energy Commission an outage report on August 15,
quarterly report September 30, 2004, and January 31, and an annual report May
31, 2005.
D. Distribution Systems Franchise & Provider Agreements
and Lisbon Activities
No report.
E. Chairman's Report
Del Leppke reported that he did an interview with Our Town Evanston which was
shown on the Evanston Community Television station on July 20 and 24, 2004.
He said a tape will be available and one can be obtained from Evelyn Schrodt at
847-491-9190 or 847-328-3775. They discussed the franchise, the Electricity
Smart Pricing Program, and the energy conservation codes.
IV. NEW 3 YEAR FRANCHISE EXTENSION WITH COMED
Del Leppke reported that most everything the Energy Commission had hoped to
accomplish had been agreed to by ComEd including receiving the data on the substations.
ComEd committed, in the annual report, that they will provide suitable representatives to
describe their annual and three year plan for improvement.

In reply to a question from Paul Morse, Del Leppke said that he thought that ComEd was
willing to discuss energy supply and energy conservation, but that it would be associated
with the distribution system.
V. ENERGY CODES
Del Leppke said that since HB4099 will be passed and applies to commercial
construction only, should the Energy Commission now try to get residential construction
included. After discussion by Commission members, Mr. Leppke asked if publicity
should be the first thing to focus on. He asked Dennis Marino to follow up with staff on
getting an article included in the City's Highlights. Stefano Mercu suggested giving
energy conservation information when a permit is filed.
VI. RECENT OUTAGES
Dennis Marino reported that the only outage he was aware of was one that occurred last
week and occurred in and around the Howard Street corridor. The outage happened
overnight and lasted approximately 2 hours. In tracking those outages, it seemed to be
related to tree contact.
VIL MEMBERSHIP
Dennis Marino reported that with Jackie Brown's resignation, there are now four
vacancies on the Energy Commission.
The motion was moved and seconded that the Commission thank Ms. Brown for all her
work and dedication and to wish her well in her future endeavors. Motion passed
unanimously.
Del Leppke informed the Commission that his second term will end in May of 2005.
Since discussion for the franchise should start moving forward, he thought that he
should resign from the Chairmanship now so a new Chair could be elected to lead the
discussions. Because of this he tendered his resignation. Rudy Wolfson said that Mr.
Leppke would be very hard to replace and asked that Mr. Leppke remain Chair until the
first of the year. He said that he thought the Commission should continue as Mr. Leppke
had organized them with Committee of the Whole with subcommittees. Paul Morse
suggested making this an agenda item for September.
VIII. COMMUNICATIONS
Dennis Marino directed the Commission's attention to the communications included in
their packet. He pointed out the franchise extension and the letter to the Governor. An
article on distributed energy that discussed the benefit in Allen Town Pa and an editorial
from Public Power Weekly that debated whether deregulation is a good idea or not
and what the future holds.

IX. OTHER BUSINESS
Paul Morse said that this is the fourth year of the Renewable Energy Fair Workshop. It
will be held in Oregon, south of Rockford and is sponsored by the Illinois Renewable
Energy Association. He added that Hans Detweiler, one of our former members, is a
featured speaker. Del Leppke said that the brochure listed five pages of workshops.
Del Leppke stated that on next Tuesday the Community Energy Cooperative is reporting
to the ICC on the Energy Smart Pricing Plan. He said he was intending to attend this
meeting and invited other Commission members to attend.
Paul Morse mentioned it would be nice to have Hans Detweiler give his presentation to
the Commission. Del Leppke thought that a good idea and asked Dcnnis Marino to invite
Mr. Detweiler for the October Energy meeting.

Corp's proposed S2.3 billion purchase of Illinois Power Co. of Decatur, IL, articles
about a grant for LED Traffic Signals and a list of recipients, how some cities are
allowing electricity customers to purchase renewable energy in blocks of 200, 400, 600,
or 800 kilowatt hours each month, and an article regarding an off -shore wind project.

IV. REVIEW OF 6 MONTH OUTAGE REPORT (JULY 2004-FEBRUARY 1, 2004)
After reviewing the 6 Month Outage Report, Rudy Wolfson said that in looking at the
circuit sort of the 6 Month Outage Report, it appeared that ComEd has improved its
reliability. Paul Morse asked if it was possible to do a comparison with last years 6
month report. Dennis Marino said that it should be possible and he would attempt to
attain such a report for the Commission and the TRG..
V. ENERGY CODES
Arlene Haas mentioned that at the last Energy Meeting there was a discussion about
an energy residential bill. Dennis Marino added that there was also discussion about
getting more information available to the public involving placing articles in the
Evanston Highlights and displaying material at the permit desk.
VI. RECENT OUTAGES
Dennis Marino reported that according to David Cook, Facilities Management Assistant
Director there were no substantial recent outages.
VII. MEMBERSHIP
Dennis Marino reported that the Commission is 4 members short of having a full
Commission. Several Commission Members suggested ways to let citizens know that the
Energy Commission was looking for new members including placing an article in the
City's Highlights.

PRIORITIES
Rudy Wolfson told the Commission that Del Leppke has agreed to stay on as chair until
January 2005. Mr. Wolfson said that the offices that needed to be filled are chairman,
vice-chairman, and secretary. Arlene Haas suggested Rudy Wolfson for Chair of the
Energy Commission. There was not a quorum at this time so discussion ensued.
Mr. Wolfson said that his priorities were energy conservation and alternative sources. He
said that a subcommittee was needed to concentrate on those two issues. Mr. Wolfson
added that oversight and reliability issues with ComEd through the TRG also has to be
one of the Commission's priorities. He asked other Members for their thoughts. Bill
Siegfriedt agreed but added that the Commission would also have to take a hard look at
what it can do and how much it will cost. Commission members discussed what they
could do to help the public with energy decisions.
Mr. Wolfson referred the Commission to the communication in their packet submitted by
Del Leppke regarding real time pricing.
Mr. Wolfson summarized the discussion by saying "We would continue with the energy
supply and transmission contracts liaison activities, but we should make a new
subcommittee on conservation and alternative energy sources. The Commission should
continue with Governmental Policy and Legislative/Regulatory Actions subcommittee,
the Oversight, Monitoring & Inspection Actions subcommittee. The Distribution
Systems Franchise should be put on hold for several months while continuing to collect
information about a future franchise."
Paul Morse said he would like to add consumer education and asked what subcommittee
that would fall under. Mr. Siegfriedt said he thought that would fall under energy
supply. Mr. Wolfson replied that he thought that what Mr. Morse and Mr. Siegfriedt
wanted was to be able to emphasize and present to people alternatives to what is offered
in the way of deregulated energy. Mr. Morse said that he just wanted to explain to
residents what is out there in common language. Mr. Siegfriedt said that when the
choice becomes available, the Commission needs to help the Evanston consumer
understand the energy supply choices. Mr. Wolfson thought that this should be covered
by the Energy Supply Choices Subcommittee.
IX. COMMUNICATIONS

Because of scheduling conflicts, the Commission elected to cancel the October 6, 2004
meeting of the Energy Commission and hold the meeting on Wednesday, October 13,

Dennis Marino said it was his understanding that the Commission wanted to invite Hans
Detweiler to the October meeting. The Commission agreed that Mr. Marino should
invite Mr. Detweiler.

Paul Morse asked if Hans Detweiler was invited to attend today's meeting. Mr. Marino
said that he would invite Mr. Detweiler to the November meeting as there was a TRG
meeting right after a shorter than normal Energy Commission meeting today.

B. Governmental Policy and Legislative/Regulatory Actions
Paul Morse referred the Commission Members to the Executive Summary
of the "Final Report of the Special Task Force On The Condition And Future Of
The Illinois Energy Infrastructure" included in their packet. He said that many
topics addressed in the report have been discussed in the Commission meetings
and thought that there would be a lot of legislation that would spring from this.
Arlene Haas said that she found some information regarding a legislative
committee hearing between Senate and House Committees. The Lieutenant
Governor is recommending that there be new standards for tree trimming. She
added that there is a bill that would require universities to use renewable energy
sources.
C. Overslght, Monitoring & Inspection Actions
Rudy Wolfson stated that there would be a TRG meeting today and Dave Metz
(Energy Commission's consultant) and Michael Radziewicz of ComEd would be
attending.
D. Distribution Systems Franchise & Provider Agreements
and Liaison Activities
Dennis Marino said that the first quarterly report on the new three-year franchise
extension was included in the Commission's packet. As requested at the last
Commission meeting, the Franchise Committee was put in abeyance for six
months. He added that the Innovative and Emerging Energy Options was
relabeled Conservation and Alternative Energy Sources. Mr. Marino suggested
that this be formalized when the Commission considered its officers later in the
meeting.
E. Chairman's Report
Del Leppke said that he and Joel Freeman have agreed to be interviewed by the
Our Town Television show on ECTV. It will be taped this Saturday morning.
The whole show will be on energy conservation and energy conservation codes
for commercial buildings. He was not sure when it will be aired.
IV. COMED QUARTERLY REPORT
Dennis Marino drew the Commission's attention to the ComEd Quarterly Report. In
discussing the report, Rudy Wolfson asked if the Commission was supposed to get a copy
of the graph of the northeast region. Mr. Marino said that would be in the yearly report
and that the TRG could ask Mr. Radziewicz to include it more frequently.
V. ENERGY CODES
Del Leppke said that the bill (HB4099) has been passed and that one year from now
commercial buildings must be in compliance. Mr. Leppke asked if the Commission

wanted to discuss prompting the City Council and others to consider requiring the Energy
Code to apply to residential. Arlene Haas said she talked to someone in the Environ-
mental Law and Policy Center and they wanted to wait a few years before they tried
pushing residential. The original bill did require residential but so much opposition was
met with that they dropped it from the bill. Mr. Leppke said that one of the reasons he
agreed to be interviewed by Our Town was to get information to Evanston residents.
Members discussed ways to get information to potential buyers.
VI. RECENT OUTAGES
Dennis Marino said that Max Rubin was planning to do a comparison over time in terns
of outage data and will compare 03 with 04 and what the Commissioners have before
them is a first cut. Commissioners agreed that the comparison is very helpful.
VII. MEMBERSHIP
Del Leppke said he had talked with the Mayor and she has several candidates she is
looking into for the Energy Commission.
VIII. ELECTION OF OFFICERS
Bill Siegfriedt nominated Rudy Wolfson for Chair of the Energy Commission. Paul
Morse moved nominations be closed. Motion seconded by Stefano Mereu. Motion

V. COMMITTEE REPORTS
A. Energy Supply, Conservation & Alternative Energy Sources
Joel Freeman pointed out the rc%iew of the ComEd news release "Customer Choice
Reaches Five -Year Mark in Illinois Electric industry." He said it was a good summary
of the issues and history that shows where things started in 1999 compared to where
they are now.
Regarding the article from "Grain's" about Nicor raising their delivery charges, he said
it points out that whoever is in charge of the utility the price is not going to go down, it
is just a matter of time before prices will have to be raised. Mr. Freeman pointed out
that Nicor's delivery rates makes up a small portion of the total gas cost. Most of the
gas cost is the actual commodity cost.
The "ProLiance" article states the futures price for winter's gas is over 90 cents per
therm. This winter's gas is forecast as being very expensive and the contradiction is
that storage is almost at an all time record high.
Mr. Freeman distributed copies of the results of the energy survey conducted at the
Evanston Farmers Market. Dennis Marino suggested that "the City of Evanston is
obligated to adhere to the State Energy Code for buildings over three stories" be added
to #9 on the Energy Survey. Committee members suggested this survey be taken at
grocery stores and churches.
Bill Siegfriedt told the Commission of his visit to the Mendota Hills Wind Farm near
Paw Paw, Illinois, a little over an hour from O'Hare. The turbines are visible along I-39
south from US 30, but Chicago -area residents rarely see theta because I-39 is
perpendicular to Chicago's spoke highways. He said that this was Spanish technology
and a Spanish investment. He also visited Crescent Ridge, which is under construction
south of Princeton, Illinois. That project will have 34 1,200 kW turbines for a total of
about 39 MW.
Mr. Siegfriedt said that two 100 MW + Illinois wind farms are currently under
permitting: Camp Grove (about 10 miles south of Crescent Ridge) and another one in
the Freeport area. Also, the PJM ISO lists seven wind farms anticipated in the next two
years for connection to ComEd. He said that individual residents can be a designated
wind energy user either by signing up with ComEd or by signing up directly with the
Wind Farm; however, you will pay a premium for that electricity.
Mr. Wolfson asked if these wind farms were subsidized in any way. Mr. Siegfried
replied that there is a Federal Tax incentive that is necessary to make it possible. He
added that the key with wind power is that it is not dispatchable you can't get it when
you want it, only when the wind is available, and that means that in no case is the wind
turbine going to replace a capital charge for dispatchable energy source.
B. Governmental Policy and Legislative/Regulatory Actions
Arlene Haas reported that she had spoken with Dan Persky and he shared that
there is a task force called North American Electric Reliability Council (NAERC). She
said it seems like something important the TRG should be monitoring. They have
representatives from the various regional councils, but they are developing their own
reliability standards.
C. Oversight, Monitoring & inspection Actions
Paul Morse reported that there was a meeting of the TRG with ComEd following the
October 13, 2004 meeting. the discussion focused on ComEd's quarterly report. Mr.
Morse thought that TRG members should write down some of the highlights of that
meeting to be presented more comprehensively to the Commission. He said he is
attempting to do that. At that meeting, ComEd produced a map of feeder circuits in the
City. He said that this would be helpful to those of the Commission that want to attach
geographical significance to some of the troublesome circuits. There was discussion at
that meeting regarding Circuits C661 and C615. Mr. Morse asked Del Leppke and
Rudy Wolfson for their view of what ComEd promised. Mr. Leppke said it was his
understanding that ComEd would investigate that circuit and report back to them at the
next meeting. Mr. Wolfson agreed with Mr. Leppke. ComEd stated that they would
look at those circuits and report back to the TRG at the next meeting.
Mr. Morse asked if ComEd still gave the City quarterly reports. Dennis Marino said
that ComEd is obligated to provide the TRG with periodic reports three times a year on
the performance on each of the projects, and they will furnish reports twice a year that
itemizes each outage cause and what the corrective action was. Mr. Morse asked if he
could have a schedule of those reports. Mr. Marino said that there is a schedule in the
Franchise Agreement Letter of Exhibit.
Paul Morse said that all he is intending to do regarding writing notes of the TRG
meetings is to write down the significant items; however, he had not succeeded in doing
that yet, but would make another attempt. He asked whether the report submitted in
October fulfilled completely ComEd's obligations. Mr. Wolfson said that on certain
technical grounds (substation capacities & the curves) it did not. He said that the
Commission was going to get a set of additional curves given to the Commission once
as a sample of the number of interruptions and the duration of interruptions of the
whole North Shore versus ComEd. These will be provided by ComEd. Dennis Marino
commented that this first report is in substantial compliance with the requirements, but
not yet complete compliance.
Discussion ensued regarding Dave Metz's role in the meetings with ComEd. Del
Leppke suggested the Commission focus Mr. Metz's attention on the substation
adequacy issue. He said he thought more review was needed on that than has been
done in the past. ComEd is now providing more data on substations which relates to
backup capability on individual circuits.
D. Chairman's Report
Rudy Wolfson reported that Hans Detweiler could not make the originally scheduled
Energy Commission meeting of December 4, 2004, but could attend a meeting on
December 10. It was the consensus of the Commission to cancel the meeting on
December 4 and reschedule for December 10, 2004.
VI. OUTAGES
Mart Rubin reported that there was a planted outage on 4710 to connect a new customer.
On October I4, 2004 C201 affecting Wilmette, Evanston and Highland Park had an
outage due to wildlife. An outage of approximately 37 minutes occurred on feeder C532
on October 13, 2004 (Davis to Reba, Sherman to Maple) due to a vehicle that struck a
pole. September 17, Feeder C202 had an outage affecting Evanston and Wilmette at 6:45
a.m. that was fixed in 45 minutes. There was a wire down affecting C201 on September
15, 2004. Mr. Rubin said that the outages are listed on the City's website.

one about developing wind and one about development against wind. Rudy Wolfson
said that it was interesting that some environmentalists are for wind power and some
against.
Del Leppke pointed out an article in the November 25, 2004 Evanston Review
entitted "Managing Home Energy Cost While Maintaining Comfort." He said it
contained the same language as the Energy Code while not written up as part of a
code.

Rudy Wolfson mentioned a symposium "Greening the Heartland 2005" that has to do
with a series of conferences/meetings in June of 2005. He asked that it be on the
agenda for the January meeting.
B. Governmental Policy and Legislative/Reguiatory Actions
Dennis Marino said that Public Power Weekly reported that Congress attempted to
attach the Energy Bill to the Appropriations Bill and failed. Now the Energy Bill which
Is now called the Electricity Rider will come up again after the first of the year.
The Omnibus spending bill for $388 billion did pass and included money for
renewable energy production incentive program amounting to $5 million with a $1
million increase over 2004. There is also money for research and development
Including $82 million for Biomass, $95 million for hydrogen, $42 million for solar, $26
million for geo-thermo, and $55 million for super conductivity R&D.
C. Oversight, Monitoring & Inspection Actions
Dennis Marino said that the next meeting of the Technical Review Group will be in
February of 2005 after the Commission receives a report form ComEd at the end of
January.
Commission members discussed the handouts "Evanston Reliability Indices' and
"Northbrook DMC Reliability Indices."
D. Distribution Systems Franchise Agreements
Del Leppke reported that there was nothing new to report.
E. Chairman's Report
Rudy Wolfson asked if any of the Commission members had suggestions for articles
for the upcoming Highlights. Paul Morse mentioned that the Commission had
discussed submitting something in the way of guidelines for new construction.
Dennis Marino remembered a discussion regarding conservation issues in particular
In terms of the timing of that Issue. Del Leppke mentioned that the Commission may
want to summarize Hans Detweiler's report and submit it for the Highlights
magazine.
Mr. Wolfson said that in all probability the January 1, 2005 deadline for submission of
articles to the Highlights could not be met and suggested that the Energy Supply,
Conservation & Alternative Energy Sources Sub -Committee meet to put something
together in relation to all the things that could be done for conservation for Insertion
In the Highlights. The deadline for submission Is April 1, 2005.
Joel Freeman suggested that a few lines could be put in the January Highlights
regarding websites and also that future items would be forthcoming in the summer
and fall Issues.

VI, PRESENTATION BY HANS DETWEILER, DEPUTY DIRECTOR, BUREAU OF
ENERGY RECYCLING, STATE OF ILLINOIS AND DEPARTMENT OF
COMMERCE AND ECONOMIC OPPORTUNITY
Rudy Wolfson introduced Hans Detweiler, Deputy Director of the Bureau of Energy
Recycling, and said that Mr. Detweiler would be reporting on the new Energy
Conservation Code and statewide efforts for energy conservation.
Mr. Detweiler said that under the law the Capitol Development Board (CDB) has the
statutory responsibility for implementing the actual code. They adopt the code and his
agency is always strictly non -regulatory, so they do not have any enforcement role. The
CDB will be implementing the rule and the Bureau of Energy Recycling will be providing
education both to local code officials and to any of the architects, engineers, lighting
designers, or any of the contractors that are involved. There is a good amount of
educational material that is not yet Illinois specific and will need a fair amount of
tweaking to make it specific enough. They will be developing forms and materials that Is
useful to the local planning officials. His understanding is that sometime In March of
2006 the final code will take effect. The CDB will take action at their Board meeting in
March 2005 and that will start the 12 month clock ticking. The Statute requires that after
the CDB adopts the code it takes one year to come into effect.
Mr. Freeman asked about the COB's enforcement capability. Mr. Detweller said that
CDB will promulgate the rule, but all actual enforcement will fall to the local
governments. There will not be any appeals to CDB.
Mr. Freeman asked if a local authority Isn't very interested in doing enforcement, does
the state have any higher mechanism. Mr. Detweller replied "not really". At the same
time, even from down state communities where they don't want and don't like the code,
they say if it Is a state law we will comply. He said that he has been working with the
National Building Code Assistance project and one of the things they say is that the first
year is crucial and doing the educational work upfront so that everyone understands
what they need to do to get the first year of the process rolling well.
Del Leppke asked what flexibility the CDB has as far as the design details of the code.
Mr. Detweller said that they have considerable design flexibility. In reply to a question
from Mr. Leppke, Mr. Detweiler said that he doubted they would go anywhere the code
doesn't go. CDB is realty understaffed to do a lot of things, it is the entity that deals with
the disability codes, it is responsible for enforcing the ADA in Illinois and for those
functions it is the entity that takes the appeals and permits. One of COB's dominant
concerns is that it would be taking on that role for Energy. So at this point he does not
see CDB tweaking the code very much. Mr. Leppke asked who is the final arbitrator.
Mr. Detweller said that the CDB Is a state agency but is independent of the governor, it
Is appointed by the governor, but it does not report directly to the governor.
Mr. Wolfson asked if Illinois has a State Statuary Energy Code. Mr. Detweller said that
Illinois has a statue that creates a code, but does not yet have a code until the CDB

adopts something and the rules are in place. He added that this is a commercial code
which would apply to commercial, industrial and any residential building over four units.
Mr. Detweiler explained that there are three areas the Energy Commission might want to
discuss: One is codes; the other is one of CDB's business efficiency programs; and, the
other is a brief conversation of blofields. One of CDB's new business efficiency
programs relates nicely to codes. The Small Business/Smart Energy program (SB/SE)
Is a design assistance program for new commercial structures and gut rehab on existing
commercial structures that works with the University of Illinois School of Architecture and
a subcontractor that is In the National Ground Source Heat Pump Consortium. SB/SE
provides design assistance for people building a new hotel somewhere and they have
their standard idea for a standard heating and cooling system and standing building
efficiency. Then they have extension conversations with the team that they put together
over at the School of Architecture that will in fact provide detailed drawings and design
assistance in terms of a whole building perspective of improving the energy efficiency of
the building -- the goal generally speaking is to make sure that the buildings are roughly
30% or more efficient than code a cut above really. The thinking behind the program is
not that the program will absorb any of the higher capital costs that will come from the
capital costs of constructing some of these facilities, but rather it will provide design
assistance and good financial analysis. This will enable the property owner to determine
what the energy savings are projected to be. It has been quite successful; we are only
in the pilot stages and doing about 10 so far out of 20 copies. We are hoping to get up
to a stage of doing 100 per year. There are a number of really good examples of
businesses that are willing to spend an additional $50,000 or $100,000 with the good
Information that we provide in that if you build a more efficient building what the long
term savings will be. To the extent that there are other significant construction projects
that are going on, we'd be very interested in providing technical assistance to any
facilities that might be done in Evanston or anywhere else in the State of Illinois. Del
Leppke asked if that part of the program also includes load management within these
buildings. Mr. Detweller replied that it doesn't yet, but that CDB wants to include that in
the future.
The other element is the Building Operator Certification program which is a program
CDB launched with Midwest Energy Efficiency Alliance strictly for the public sector and
Is trying to expand that Into the private sector as well.
A few weeks ago the Governor announced a new partnership with the Hewlett
Foundation and the Governor's Ethanol Coalition to accelerate the commercialization of
ethanol production from non-traditional cellulosic biomass resources. Cellulosic
feedstocks span a potentially enormous resource base, including common agricultural
residues such as com stover (stalks) and fiber, wheat straw, rice husks, nutshells, wood
chips, and more. Cellulosic ethanol Is a large potential energy resource for the nation,
complimentary to traditional corn ethanol. Our Governor is currently Chair of the
Governor's Ethanol Coalition, but that will change in February to Governor Pawlenty of

Mr. Detweller said that in the Quad Cities there is a coal plant that is being used as the
feed stock. He said that the environmental community would like to see a lot of the
existing coal plants shut down, especially where there Is a large population living around
the coal plant. There is hope that there can continue to be a compromise between the
environmental community and the coal community.
Mr. Freeman asked about the Small Business Smart Energy threshold. Mr. Detweiier
said that they were thinking of renaming it. It was named the Small Business Smart
Energy because the broad sectors of the economy that will probably be helped the most
with those kinds of programs are small businesses. That was sort of differentiated from
the Manufacturing Energy Efficiency program which is rnost useful to businesses that
are spending at least $500,000 to $1 million or more on their energy.
Joel Freeman asked who was providing the technical design systems. Mr. Detweiler
replied that it was a partnership of the School of Architecture at UIUC and National
Downsource Heat Pump Consortium.
Dennis Marino stated that there are three not -for -profits here in Evanston that do a very
good job of rehabbing distressed apartments into high quality affordable housing and
asked if that was a program that could benefit from the Illinois Energy Efficient
Affordable Housing Construction Program (IEEAFCP) on CDB's web site. Mr. Detweiler
replied that it is and that CDB provides grant dollars (approximately
$1 per sq ft.) He mentioned that Paul Knight (contractor) administers that program for
CDB
