AN ORDINANCE
Granting a Special Use to Permit
Construction of a Church
• at 2041-49 Brown Avenue
WHEREAS, the Evanston Zoning Board of Appeals
conducted public hearings on December 4, 1990, January 2, 1991,
and February 5, 1991 upon the application of the Christ Temple
Missionary Baptist Church, contract purchaser, for a special use
to permit construction of a church on the property located at
2041-49 Brown Avenue, Evanston, Illinois in an R5 General
Residence District, and for a variation from the off-street
parking regulations of the Zoning Ordinance to permit the
proposed church to be served by eleven off-street parking
spaces; said public hearing having been conducted pursuant to
notice and publication thereof in the manner provided by law;
and
WHEREAS, the Zoning Board of Appeals has recommended
• that the application for the aforesaid special use be granted
and has found that the off-street parking variation request is
moot because the applicant proposes to lease from the Ecology
Center the twenty-nine off-street spaces required by the Zoning
Ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That, based upon the evidence and
testimony presented at the hearings, and
upon deliberations and findings of fact contained in the
transcript of the Zoning Board of Appeals Case No. 90-48-V &
SU(R), the application of the Christ Temple Missionary Baptist
Church, contract purchaser, for a special use to permit
• construction of a church on the property located at 2041-49
Brown Avenue, Evanston, Illinois, in a R5 General Residence
District; and legally described as follows:
"LOTS 47, 48, 49 and 50 IN BLOCK 1 IN CULVER'S ADDITION TO
EVANSTON, BEING A SUBDIVISION OF THE EAST HALF OF THE
NORTHEAST QUARTER OF THE NORTHWEST QUARTER OF SECTION 13,

MERIDIAN, IN COOK COUNTY, ILLINOIS.
is granted, subject to compliance with all other provisions of
the Zoning Ordinance, other applicable laws and the following
• conditions:
A. The proposed construction shall be in substantial
compliance with the testimony, exhibits, and plans
placed on file in connection with this case;
B. The occupancy of the main assembly hall shall not
exceed ten (10) persons for each off-street parking
space which is supplied in conformity with the off-
street parking regulations of the Zoning Ordinance to
serve the premises; and
C. The applicant shall be responsible for providing
direction to the congregation of the church to use
the twenty-nine required off-street parking spaces to
serve said church which are located in the Ecology
Center Parking Lot.
SECTION 2: That the aforesaid application, for
variation from the off-street parking
regulations of the Zoning Ordinance to permit the proposed
church to be served by eleven off-street parking spaces, is moot
in that the applicant proposes to lease from the Ecology Center i
• the twenty-nine off-street spaces required by the Zoning
Ordinance.
SECTION 3: All ordinances or parts of ordinances
in conflict herewith are hereby repealed.
SECTION 4: This ordinance shall be in full force
and effect from and after its passage,
approval and p blicati/on in the manner provided by law.
