HomeMy WebLinkAboutORDINANCES-1991-019-O-912/06/91 1 19-0-91 AN ORDINANCE Providing for a Special Assessment Rebate WHEREAS, the City of Evanston, has heretofore adopted several ordinances providing for the making of local • improvements by special assessment in the City; and i I WHEREAS, pursuant to such ordinances, special assessments have been confirmed in the courts of Cook County and all requisite statutory steps as required by law have been taken in such proceedings, including the entry of a judgment of confirmation, construction of the improvements, and the issuing I of bonds and vouchers; and WHEREAS, there has been final settlement with the contractor and full payment of all vouchers, bonds and interest issued on account of the improvements in the warrants hereinafter set forth; and WHEREAS, there are surplus funds remaining in the warrants as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL • OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That there be a rebate upon each of the lots, blocks, tracts or parcels of land as contained in the warrants as hereinafter set forth as assessed of its pro rata proporation of the surplus of said assessment. I i SECTION 3: That the Board of Local Improvements shall cause to be kept an appropriate record of the above declared rebates and shall repay, after deducting for the costs and expenses for declaring and making such rebate, five per cent (5%) of the amount hereby declared to be rebated. The Board of Local Improvements shall keep and exhibit publicly in its office an index of all warrants upon which rebates are due and payable and, on proper proof, the warrants shall be repaid to persons entitled thereto. -3- 2/06/91 i 19-0-91 • • • i SECTION 4: That the Board of Local Improvements shall give notice to each of the property owners of record and, upon receipt of proof of ownership, shall issue a check payable to said property owner f and upon the return, if any, of the checks issued remaining unclaimed, that they be redeposited in a special unclaimed rebate fund and held accordingly as required by statute. SECTION 5: This ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law.
