HomeMy WebLinkAboutORDINANCES-1991-004-O-9112-27-90 4-0-91 AN ORDINANCE Granting a Special Use and a Variation at 2126-28 Ashland Avenue • WHEREAS, the Evanston Zoning Board of Appeals (ZBA) conducted a public hearing on December 18, 1990, upon the application of The Evanston Congregation of Jehovah's Witnesses, Inc. for a special use and a variation for the off-street parking regulations of the Zoning Ordinance to permit construction of a Church with 24 off-street parking spaces on the property located at 2126-28 Ashland Avenue, in an C1 Commercial District; public hearing having been conducted pursuant to notice and publication thereof in the manner prescribed by law; and WHEREAS, the Zoning Board of Appeals has recommended that the application for said special use and variation be granted; • NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That, based upon the evidence and testimony presented at the hearings, and upon deliberations and findings of fact contained in the transcript of the Zoning Board of Appeals Case No. 90-49- V&SU(R), the application of The Evanston Congregation of Jehovah's Witnesses, Inc. for a special use and a variation for the off-street parking regulations of the Zoning Ordinance to permit construction of a Church with 24 off-street parking spaces on the property located at 2126-28 Ashland Avenue, in an C1 Commercial District; and legally described as follows: Evanston Congregation of Jehovah's Witnesses Consolidation of Lots 1 and 2 in Thayer's Resubdivision of Lots 1 to 8, Inclusive, in Block 7 • in Payne's Addition to Evanston, a Subdivision in the Southeast Quarter of Section 12, Township 41 North, Range 13, East of the Third principal Meridian, in Cook County, Illinois. is granted, subject to compliance with all other provisions of the Zoning Ordinance, other applicable laws and the following conditions: 4-0-91 1. The proposed construction shall be in substantial compliance with the testimony presented in the plans placed on file in connection with this case; 2. The combined occupancy of the auditoriums shall not exceed 10 persons for each off-street parking space which is supplied in conformity with the off- street parking regulations of the Zoning Ordinance to serve the premises, except that said combined occupancy may be exceeded on 5 religious holidays of the applicants choosing in each calendar year. SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3: This ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law. Introduced Adopted:6%/W.
