HomeMy WebLinkAboutORDINANCES-1991-002-O-912-0-91 AN ORDINANCE Granting a Variation and Special Use at 1316 Oakton Street • WHEREAS, the Evanston Zoning Board of Appeals (ZBA) conducted a public hearing on October 16, November 7, and December 4, 1990, upon the application by the ABT Corporation, owner and Alan J. Goldberg and Carolyn Goldberg, contract purchasers for a variation from the off-street parking regulations of the Zoning Ordinance to permit conversion of the existing building and possible expansion within said building to provide dwelling units and/or business spaces, and for a special use to permit dwelling units below the second floor on the property located at 1316 Oakton Street, in a B1 Business and R1 Single-family Residence District; said public hearings having been conducted pursuant to notice and publication thereof in the manner prescribed by law; and • WHEREAS, the Zoning Board of Appeals has recommended that the application for said variation and special use be granted; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That, based upon the evidence and testimony presented at the hearings, and upon deliberations and findings of fact contained in the transcript of the Zoning Board of Appeals Case No. 90-41- V&SU(R), the application by the ABT Corporation, owner and Alan J. Goldberg and Carolyn Goldberg, contract purchasers for a variation from the off-street parking regulations of the Zoning Ordinance to permit conversion of the existing building and possible expansion within said building to provide dwelling • units and/or business spaces, and for a special use to permit dwelling units below the second floor on the property located at 1316 Oakton Street, in a B1 Business and R1 Single-family Residence District and legally described as follows: 1 2-0-91 Parcel 1: Part of the East Half of the North Half of the North Half of the North East Quarter of the North East Quarter of Section 25, Township 41 North, Range 13, East of the Third Principal Meridian, described as follows: Commencing at • the Intersection of a Line 33.0 Feet South of and Parallel with the North Line of the North East Quarter of said Section 25, with a Line 40 Feet West of and Parallel with the East Line of the North East Quarter of said Section; Thence South along said North -South Parallel Line to the South Line of said North Half of the North Half of the North East Quarter of the North East Quarter of Section 25; Thence West along said South Line to the Point of Beginning, being the North West Corner of Lot 1 in Block 3 in Kelly and O'Brien's South Evanston Subdivision of the South Half of the North Half of the North East Quarter of the North East Quarter of said Section; Thence North Along the West Line of said Lot 1, extended North, to a point on a line 16.0 feet North of and Parallel with the North Line of said Lot 1; Thence East along said Parallel Line to.a Point on a Line 201.02 Feet (as Measured along said Parallel Line) West of and Parallel with the East Line of the North East quarter of said Section; Thence North along said Parallel line to a Point on a Line 185.014 Feet (as measured along said Parallel Line) South of and Parallel with the North Line of the North East Quarter of said Section; Thence East Parallel with the North Line of the North East Quarter of said Section, 30.65 Feet; Thence North Parallel with the East Line of the North East Quarter of said Section, 65.20 Feet; Thence West Parallel with the North Line of the North East Quarter of said Section, 1.65 feet; Thence North Parallel with the East Line of the North East Quarter of said Section to a Point • on a Line 33.0 Feet South of and Parallel with the North Line of the North East Quarter of said Section; Thence West along said Parallel Line 59.91 Feet; Thence South to a point on the said South Line of the North Half of the North Half of the North East Quarter of the North East Quarter of Section 25, being 18.66 Feet West of the Point of Beginning; Thence East along said Line 18.66 feet to the point of beginning; Parcel 2: That Part of Lot 15 in Block 3 in Kelly and O'Brien's South Evanston Subdivision of the South Half of the North Half of the North East Quarter of the North East quarter of Section 25, Township 41 North, Range 13, East of the Third Principal Meridian, Described as follows: Beginning at the South East corner of said Lot 15 and running West Along the South Line of said Lot 15, 20.00 Feet, Thence North along a Line parallel with the East Line of said Lot 15, 10.00 Feet; Thence East on a Line Parallel with the South Line of said Lot 15, 18.08 feet; Thence North 23.32 feet more of less to a Point on the North Line of said Lot 15, 2.66 Feet West of the North East Corner of said Lot 15; thence East on the North Line of Said Lot 15, 2.66 Feet to the North East Corner, thence South along the East Line of said Lot 15 to the South East Corner thereof all in Cook County, Illinois. • is granted, subject to compliance with all other provisions of the Zoning Ordinance, other applicable laws and the following conditions: 1. The proposal shall be in substantial compliance with 2 2-0-91 • the testimony presented and the plans placed on file in connection with this case; and 2. No use or uses or combination thereof within said building shall exceed a total off-street parking requirement of 14 off-street parking spaces. SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3: This ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law.
