HomeMy WebLinkAboutORDINANCES-1991-110-O-9111-6-91 • 110-0-91 AN ORDINANCE AN AMENDMENT TO A JOINT CITY-STATE AGREEMENT FOR A WIDENING & RESURFACING PROJECT IN THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS WHEREAS, the CITY OF EVANSTON, hereinafter referred to as the "LA", and the STATE OF ILLINOIS, acting by and through its Department of Transportation and hereinafter referred to as the "STATE", entered into an agreement on August 6, 1991 for widening and resurfacing of Greenbay Road from the north edge of pavement of Emerson Street to the south edge of pavement of Livingston St., said improvement designated as LA Section 90-00192-00-WR, STATE Job No. C-91-410-90, Project No. M-6003(892); and WHEREAS, the LA and the STATE are desirous of updating the "CITY AGREES" portion of the Joint Agreement (Section II, • paragraph 10) and Exhibits "A", "B" and "C" in accordance with • the State's policies and procedures approved and/or required by the United States Federal Highway Administration, hereinafter referred to as "FHWA": NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the "City Agrees" portion of the aforementioned agreement is revised to read as follows: (10) On December 4, 1991, at 12:01 A.M. the CITY will assume jurisdiction and maintenance of Greenbay Road from the north edge of pavement of Emerson Street to the south edge of pavement of Isabella Street, and also agree to maintain or cause to be maintained, in a manner satisfactory to the STATE and FHWA, their portion of the improvement previously under their established jurisdictional authority. The CITY will adopt and put 110-0-91 1� 1P into effect an appropriate ordinance adding the portion of roadway of Greenbay Road aforementioned to the CITY system as required in Exhibit B (BLR 1600) which is attached hereto and made a part hereof. A copy of said ordinance is also attached hereto as Exhibit C and made a part hereof. For location Map of the improvement see attached Exhibit A. BE IT FURTHER AGREED that this AMENDMENT shall inure to the benefits of the parties hereto, their successors and assigns. SECTION 2: That ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3: That this ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law.
