HomeMy WebLinkAboutORDINANCES-1991-037-O-91.3-2--91 • 37-0-91 AN ORDINANCE Granting a Variation and a Special Use at 1700 Payne Street WHEREAS, the Evanston Zoning Board of Appeals (ZBA) conducted a_public hearing on March 19, 1991, upon the application of The Prayer Garden Ministries for a variation from the elimination provisions of the Zoning Ordinance, release from the conditions imposed under Ordinance 81-0-85, and a special use to permit retention of the existing building on the premises and conversion and use of said building for a child care institution on the property located at 1700 Payne Street, in an R5A General Residence District; public hearing having been conducted pursuant to notice and publication thereof in the manner prescribed by law; and WHEREAS, the Zoning Board of Appeals has recommended that the application for said variation and special use be is granted; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That, based upon the evidence and testimony presented at the hearings, and upon deliberations and findings of fact contained in the transcript of the Zoning Board of Appeals Case No. 90-62- V&SU(R), the application of The Prayer Garden Ministries for a variation from the elimination provisions of the Zoning Ordinance, release from the conditions imposed under Ordinance 81-0-85, and a special use to permit retention of the existing building on the premises and conversion and use of said building for a child care institution on the property located at 1700 Payne Street, in an R5A General Residence District and legally is described as follows: The North 33-1/2 feet of Lot 1 in Block 8 in Payne's Addition to Evanston, being a subdivision of the west 1/2 of the south 1/2 of the southeast 1/4 of Section 12, Township 41 north, Range 13, east of the third principal meridian, in Cook County, Illinois. 3 37-0-91 • • 0 is granted, subject to compliance with'all other provisions of the Zoning Ordinance, other applicable laws and the following conditions: 1. The proposed construction and use shall be in substantial compliance with the testimony presented and the plans placed on file in connection with this case; 2. The proposed child care institution shall be limited to a maximum of 40 children between the ages of 2-1/2 to 5 years old; 3. The front 27 feet of the property, measured from the Dewey Avenue lot line, shall be maintained as a landscaped area. SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3: This ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law.
