HomeMy WebLinkAboutORDINANCES-1992-026-O-923-20-92 • 26-0-92 AUTHORIZING ACQUISITION OF CERTAIN REAL ESTATE WHEREAS, the City Council of the City of Evanston has considered the acquisition of real estate described in Exhibit A attached hereto and incorporated herein by reference, in connection with a tax increment financing redevelopment project; and WHEREAS, the City Council has determined that it is necessary to acquire said real estate for redevelopment purposes . pursuant to the provisions of Section 11-74.4-4 of Chapter 24 of the Illinois Revised Statutes; and WHEREAS, the acquisition of said real estate will be for a public purpose in accordance with state statute as • hereinabove set forth; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That it is necessary, required, desirable and for the best interest of the City of Evanston that the real property legally described as set forth on Exhibit A attached hereto and incorporated herein by reference, and commonly known as 646 Pitner Avenue, Evanston, Illinois, which said property lies wholly within the boundaries of the City of Evanston, shall be acquired for redevelopment purposes, pursuant to Illinois Revised Statutes, Chapter 24, Section 11- 1 1 ] 9 26-0-92 • 74.4-1 et seq. and the City of Evanston Southwest Tax Increment Redevelopment plan and project. SECTION 2: That the City Manager of the City of Evanston or his designee be and are hereby authorized, empowered and directed to negotiate for and on behalf of the City of Evanston with the owner or owners of the real property described in Exhibit A attached hereto and incorporated herein by reference, for the purpose of acquisition thereof by the City of Evanston. SECTION 3: That in the event that the City Manager or his designee are unable to agree with the owners of the real property described in said Exhibit A as to the compensation to be paid therefor, the City Manager be and is hereby authorized to institute condemnation proceedings in the • name of the City of Evanston for the purpose of acquiring title to and possession of said real property hereinabove described in accordance with the eminent domain laws of the State of Illinois. SECTION 4: All ordinances or parts of ordinances in conflict herewith are hereby repealed.
