AN ORDINANCE
Granting a Variation and Special Use
at 355 Ridge Avenue
WHEREAS, the Evanston Zoning Board of Appeals (ZBA)
conducted a public hearing on February 18, 1992 upon the
application by the Sisters of St. Francis Health Services, Inc.,
d/b/a St. Francis Hospital, to permit 1) a special hospital use
for construction of a proposed child care institution and
accessory play lots on the premises and 2) variations from the
rear yard, side yard and yard obstruction regulations of the
Zoning Ordinance to permit construction of the proposed child
care institution without supplying the required 25 foot rear yard
• and 25 foot south side yard setbacks, and installation of a
proposed play lot for older children, partially located in the
required south side yard on the property located at 355 Ridge
Avenue, in an R6 General Residence District; public hearing
having been conducted pursuant to notice and publication thereof
in the manner prescribed by law; and
WHEREAS, the Zoning Board of Appeals has recommended
that the application for said special use and variation be
granted;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That, based upon the evidence and
testimony presented at the hearing, and upon

• deliberations and findings of fact contained in the transcript of
the Zoning Board of Appeals Case No. 91-33-V&SU(R), the
application of The Sisters of St. Francis Health Services, Inc.,
d/b/a St. Francis Hospital, to permit 1) a special hospital use
for construction of a proposed child care institution and
accessory play lots, on the premises and 2) variations from the
rear yard, side yard and yard obstruction regulations of the
Zoning Ordinance to permit construction of the proposed child
care institution without supplying the required 25 foot rear yard
and 25 foot south side yard setbacks, and installation of a
proposed play lot for older children, partially located in the
required south side yard on the property located at 355 Ridge
Avenue in an R6 General Residence District; and legally described
as follows:

is granted, subject to compliance with all other provisions of
the Zoning Ordinance, other applicable laws and the following
conditions:
1. The proposed construction shall be in substantial
compliance with the testimony presented and the
plans placed on file in connection with this case.
2. The child care institution will have a maximum of
148 (one hundred forty-eight) positions. Of these,

• eighteen (18) are to be reserved for children of
neighborhood residents on a full -pay basis and ten
(10) are to be reserved for children of neighborhood
residents through Title XX. Ten (10) Title XX
positions are to be reserved for Hospital employees.
Of these, any not utilized are to be made available
to children of neighborhood residents.
3. The "Neighborhood" is defined as that area between
the north side of Howard Street on the south, the
Chicago and Northwestern Railroad tracks on the
east, the south side of Washington Street on the
north, and the east side of Asbury Avenue on the
west.
4. Neighborhood positions not filled are to be
available for Hospital use. A neighborhood resident
who applies for a neighborhood position filled by a
Hospital employee's child will receive first
preference for the next available neighborhood
position.
5. Tuition charged to Hospital employees is to be no
more than 20% (twenty percent) less than that
charged to neighborhood residents, except where the
Hospital gives a new employee a lower rate as an
inducement to employment. Such an inducement is to
• be offered only to persons whose area of expertise
is in short supply.
SECTION 2: All ordinances or parts of ordinances
in conflict herewith are hereby repealed.
SECTION 3: This ordinance shall be in full force
and effect from and after its passage,
approval and publication in the manner provided by law.
