Amending Sections 8-4-6-3 and 8-5-3
of the Evanston City Code
Providing For Raking of Leaves to Curbside
October 15 through November 30.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That Section 8-4-6-3 of the City Code of
the City of Evanston, 1979, as amended, be
and it hereby is further amended to read as follows:
8-4-6-3: PROHIBITED ACTS:
(A) It shall be unlawful for any person to throw or deposit
litter in or upon any street, alley, sidewalk or other
public place within the City except in public
receptacles or authorized private receptacles.
• (B) No person shall sweep into or deposit in any gutter,
street, alley or other public place in the City the
accumulation of litter from any building or lot or from
any public or private sidewalk and driveways, provided
that leaves may be raked to the curb from October 15
through November 30. Persons owning or occupying
property shall keep the sidewalk and parkway in front
of their premises free from litter.
(C) No person, while a driver or passenger in a vehicle,
shall throw or deposit litter upon any street, alley
or other public place within the City, nor upon private
property.
(D) No person shall drive or cause to be driven any truck
or other vehicle within the City upon any public street
or way unless such vehicle is so constructed, loaded or
covered as to prevent any load, contents or litter from
being blown or deposited upon any street, alley or
other public place. Nor, except as provided in Section
8-5 1/2-5 of this Code, shall any person drive or move
any vehicle or truck within the City, the wheels or
tires of which carry onto or deposit in any street,
alley or other public place, mud, dirt, sticky
substances, litter or foreign matter of any kind.

(E) No person shall throw or deposit litter on any private
property within the City, whether owned by such person
or not, except that the owner or person in control of
private property may maintain private receptacles for
collection in such a manner that litter may be
prevented from being carried or deposited by the
elements upon any street, alley, sidewalk or other
public place or upon any private property.
SECTION 2: That Section 8-5-3 of the City Code of the
City of Evanston, 1979, as amended, be and it hereby is further
amended to read as follows:
8-5-3: GENERAL DISPOSAL REQUIREMENTS:
(A) All refuse must be stored in a bag or container or
wrapped or bundled in such a manner as to preclude
blowing or scattering during the storage period.
(B) All garbage must be stored in clean, leakproof,
nonabsorbent containers covered with tight -fitting lids
and maintained in good repair. All wet garbage so
stored must be drained and wrapped in such a manner
• that moisture cannot spill when the material is
removed.
(C) Refuse need not be separated based on whether it is
combustible, noncombustible, or putrescible; provided,
however, that when any garbage is part of the refuse,
the provision of this Chapter pertaining to garbage
materials shall apply and when any recyclable materials
are part of the refuse, the provisions of this Chapter
pertaining to recyclable materials shall apply, and
when yard waste materials are part of the refuse, the
provisions of this Chapter pertaining to yard waste
materials shall apply.
(D) Brush or tree branches which are tied in bundles shall
be no more than four feet (41) in length and tied with
cloth ties. Bundles tied with plastic, wire or rope
will not be accepted. All other materials shall be
containerized as appropriate in a manner to facilitate
easy handling by one person and in accordance with the
requirements for yard wastes.
(E) Yard wastes shall be placed in either 1) City of
Evanston Kraft paper bags imprinted with the Seal of
the City and distributed under the direction of the
Director of Public Works and sold at a cost established

by City Council; 2) ninety (90) gallon roll -out carts
purchased through the office of the Director of Public
Works and sold at a cost to be established by City
Council; or 3) thirty (30) gallon Kraft paper bags,
comparable in size and construction to the City bags to
which has been affixed a City sticker purchased through
the City Collector's office and sold at a price to be
established by City Council.
(F) No refuse shall be deposited, be thrown away, or be
permitted to accumulate or remain in any street, alley
or other public place or in any place where its
presence would constitute a nuisance to others or a
potential or actual hazard to health, sanitation or
safety, provided that leaves may be raked to the curb
from October 15 through November 30.
SECTION 3: All ordinances or parts of ordinances
in conflict herewith are hereby repealed.
SECTION 4: This ordinance shall be in full force
and effect from and after its passage,
approval and publication in the manner provided by law.
