HomeMy WebLinkAboutORDINANCES-1992-104-O-9210-29-92 104-0-92 AN ORDINANCE Granting a Variation at 501 Sherman Avenue WHEREAS, the Evanston Zoning Board of Appeals (ZBA) conducted a public hearing on October 20, 1992 upon the application by Diane Martin for variations from the accessory use, nonconforming structure, floor area ratio and side yard regulations of the Zoning Ordinance to permit construction of a two story addition, a detached garage, and an open off-street parking space on property located at 501 Sherman Avenue, in an R3, Two-family Residence District; public hearing having been conducted pursuant to notice and publication thereof in the manner prescribed by law; and WHEREAS, the Zoning Board of Appeals has recommended that the application for said special use be granted; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That, based upon the evidence and testimony presented at the hearing, and upon the deliberations and findings of fact contained in the transcript of the Zoning Board of Appeals Case No. 92-29-V(R), the application by Diane Martin for variations from the accessory use, nonconforming structure, floor area ratio and side yard regulations of the Zoning Ordinance to permit construction of a two story addition, a detached garage, and an open off-street • 1 104-0-92 parking space on property located at 501 Sherman Avenue, in an R3, Two-family Residence District; and legally described as follows: THE SOUTH 38 FEET OF LOTS 10 AND 11, IN INGELHART'S ADDITION TO EVANSTON, A SUBDIVISION OF 12.5 ACRES IN THE SOUTHWEST QUARTER OF SECTION 19, EAST OF RIDGE ROAD, KNOWN AS LOTS 5 TO 7 OF ASSESSOR'S DIVISION BY G.N. HUNTOON, A PART OF THE SOUTH HALF OF THE SOUTHWEST QUARTER OF SECTION 19, TOWNSHIP 41 NORTH, RANGE 14, AND A PART OF THE NORTHWEST QUARTER EAST OF RIDGE ROAD OF SECTION 30, TOWNSHIP 41 NORTH, RANGE 14, EAST OF THE THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS. is granted, subject to compliance with all other provisions of the Zoning Ordinance, other applicable laws and the following conditions: 1. The proposed construction shall be in substantial compliance with the testimony presented and the plans placed on file in connection with this case. 2. No bathtub or shower stall shall be installed in the • garage; and 3. Neither the ground floor nor the loft of the proposed garage shall be used for living space. SECTION 2:' All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3: This ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law.
