AN ORDINANCE
VACATING A PORTION OF PITNER AVENUE
NORTH OF CLEVELAND STREET, AND SOUTH OF WASHINGTON STREET
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That all of the portion of Pitner Avenue
North of Cleveland Street, and South of
Washington Street, legally described as:
THE WEST 21.09 FEET OF PITNER AVENUE, LYING SOUTH OF
THE CENTERLINE OF WASHINGTON STREET AND NORTH OF THE
CENTERLINE OF CLEVELAND STREET IN THE NORTHWEST QUARTER
OF THE SOUTHWEST QUARTER OF SECTION 24, TOWNSHIP 41,
NORTH, RANGE 13 EAST OF THE THIRD PRINCIPAL MERIDIAN,
IN COOK COUNTY, ILLINOIS.
as indicated by the words "hereby vacated" on the Plat of
Vacation attached to and incorporated into this ordinance, be and
• the same is hereby vacated and closed, inasmuch as the corporate
authorities of the City of Evanston have determined that the
public interest will be served by the aforesaid vacation,
provided that said vacation shall be subject to the following
terms and conditions:
(a) That said vacation shall be subject to the
usual easements for public utilities,
including, but not limited to, such rights -
of -way, license and easement rights to such
equipment as is presently installed and
located on those portions of the public
right-of-way hereby closed and the rights of
ingress and egress for the maintenance,
renewal and reconstruction thereof.
(b) That the following conditions be satisfied
prior to recording of the Plat of Vacation:

(1) LaSalle Trust No. 107664 must have
acquired title to the property adjoining
Pitner Avenue to the west.
(2) Near North National Title Corporation
shall be in possession of the following
fully -executed documents, and shall be in a
position to record each of said documents:
i) Plat of Subdivision;
ii) First Amendment to Deed of Declaration;
iii) First Amendment to Construction, Operation,
Maintenance and Reciprocal Easement
Agreement;
iv) Trustee's Deed from LaSalle Trust No. 107664
to Wal-Mart Stores, Inc.,; and
v) New Construction, Operation, Maintenance and
Reciprocal Easement Agreement.
SECTION 2: All ordinances or parts of ordinances
in conflict herewith are hereby repealed.
SECTION 3: This ordinance shall be in full force and
effect from and after its passage,
approval, and publication in the manner provided by law, subject
to the conditions outlined in Section 1(b) of this Ordinance.
