HomeMy WebLinkAboutORDINANCES-1992-064-O-926/29/92 • 7/17/92 64-0-92 AN ORDINANCE Granting a Special Use at 836 Dodge Avenue WHEREAS, the Evanston Zoning Board of Appeals (ZBA) conducted a public hearing on June 2, 1992 and June 16, 1992 upon the application by Dodge Associates, Inc., as beneficiary under the American National Bank, Trust #0670947-05, and Sammy's Red Hots, Inc., prospective tenant, for a special use to permit establishment of a type 2 restaurant on property located at 836 Dodge Avenue, in a B1 Business District; public hearings having been conducted pursuant to notice and publication thereof in the • manner prescribed by law; and WHEREAS, the Zoning Board of Appeals has recommended that the application for said special use be granted; .01 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That, based upon the evidence and testimony presented at the hearings, and upon deliberations and findings of fact contained in the transcript of the Zoning Board of Appeals Case No. 92-7-SU(R), upon the application by Dodge Associates, Inc., as beneficiary under the American National Bank, Trust #0670947-05, and Sammy's Red Hots, Inc., prospective tenant, for a special use to permit establishment of a type 2 restaurant on property located at 836 Dodge Avenue, in a B1 Business District; and legally described 64-0-92 t • as follows: LOTS 1 TO 8, BOTH INCLUSIVE, TOGETHER WITH VACATED 40 FT. ALLEY LYING SOUTH OF AND ADJOINING SAID LOTS 1 AND 2 IN BURTON'S RESUBDIVISION OF LOTS 1 TO 5, BOTH INCLUSIVE IN BLOCK 1 IN HARBERT AND RICHARD'S ADDITION TO SOUTH EVANSTON, A SUBDIVISION OF THE EAST 1/3 OF THE NORTH HALF OF THE SOUTHWEST QUARTER OF SECTION 24, TOWNSHIP 41 NORTH, RANGE 13, EAST OF THE THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS." is granted, subject to compliance with all other provisions of the Zoning Ordinance, other applicable laws and the following conditions: 1. The installation and operation of said type 2 restaurant shall be in substantial compliance with the testimony presented and the plan placed on file in connection with this case. 2. Food, fruit, vegetables, beverages and other similar items sold in said type 2 restaurant shall be limited to those items included in the proposed menu submitted and identified as exhibit number 4; • 3. Additional signage to promote legal use of the frontage road parking along -Dodge Avenue, so as to prevent cars from exitipg onto Main Street, shall be installed, subject to feview and approval by the City Traffic Engineer; 4. Access to the parking area serving the subject type 2 restaurant shall be chained off at 10:00 P.M., each evening, with signage installed to prohibit loitering when said parking area is closed. 5. Illumination on the site shall be so shielded as to protect adjoining properties or the right-of-way from direct light or glare; 6. The owner of the subject premises and the owner of the proposed type 2 restaurant shall comply with the following litter control plan: a. Collection of all litter within a 150 foot radius of the property line of the subject premises (exclusive of streets and alleys) and this collection program shall include, but not be limited to, the collection of litter from the "bleachers" located at the northeast corner of the intersection of Main Street 2 0 • EXHIBIT C ENVIRONMENTAL INDEMNITY AGREEMENT • • jdk .#11-11/19/91 E This Indemnification Ag= eement ( ffA.; Bement' ) is nade t.is day of 1991 by and bet«een the City of Evanston, Illinois, a ('City'), and Joseph J. A portion of the Property consists of a parcel of land legally described on Exhibit ?_ .attached hereto and hereby made a part hereof, which is privately owned and currently operated as a scrap yard ("Scrap Yard^'). B. In connection with said redevelopment plan, the City intends to exercise its eminent domain powers to acquire the Scram Yard and Freed has agreed to enter into this Agreement with t_* City. Prior to the commencement of the eminent domain proceedings, the City and Freed shall agree upon the action to be taken by the City to determine the environmental condition of the Scrap Yard, including, but not limited to, hiring environmental consultants and authorizing an environmental audit. The property owner and operator of the proposed type 2 restaurant shall ensure that the aforesaid area be free of litter and debris, including, but not limited to, that generated by the proposed restaurant; c. Covered refuse receptacles shall be provided on the subject premises for collection of rubbish, litter and debris and said receptacle shall be of the type to allow the tight closing of the cover; d. A contract with a scavenger service shall be entered into which shall provide for the gathering of trash, rubbish and/or garbage from said type 2 restaurant not fewer than two times per week, or more often if necessary; e. Trash containers shall be placed at the points of ingress and egress on Dodge Avenue and on Main Street, and a waste receptacle shall be located at each pedestrian exit from the proposed type 2 restaurant; • f. Conspicuous signage, which shall comply with the Evanston Sign Ordinance, shall be placed within the building and at each waste receptacle location describing the requiremefits and penalties of City ordinance applicably to litter. 7. The hours of operation of said type 2 restaurant shall be limited to 8:00 A.M. to 10:00 P.M. daily. 8. The special use granted herein shall terminate when Dodge Associates Inc. no longer has an ownership interest in the subject property. SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed.
