HomeMy WebLinkAboutORDINANCES-1992-045-O-9245-0-92 AN ORDINANCE Authorizing the City :Manager to Negotiate a Sale of Certain Real Estate and Authorizing the Publication of a Notice of Intent to Sell Certain Real Estate WHEREAS, the City of Evanston is desirous of selling, as owner, the real property described in Exhibit A and located approximately between Cleveland Street and Washington Street, west of Pitner Avenue, and consisting of a portion of the former :Mayfair Rail Line Spur and Marquette Fuel Site, in the City of Evanston and hereinafter referred to as the "Property"' and WHEREAS, in the opinion of the corporate authorities of the City of Evanston, use of said Property is no longer necessary, appropriate, required for use of, profitable to, or in the best interest of said City; and WHEREAS, the corporate authorities of the City of Evanston have determined that the best interests of the City of Evanston would be served by the sale of said Property; and WHEREAS, said property is located in the City of Evanston Southwest Tax Increment Finance District established by the City of Evanston to encourage redevelopment of the property and adjoining parcels; and iWHEREAS, sale of said property shall assist toward implementing area redevelopment in accordance with the adopted Tax Increment Financing Redevelopment Plan and Redevelopment Project; and WHEREAS, the corporate authorities of the City of Evanston have deemed that the sale of said Property is to take place as the result of negotiation, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the City Manager be and is hereby authorized and directed to negotiate the sale of the real estate legally described in Exhibit A and commonly known as vacant land located approximately between Cleveland Street and Washington Street, west of Pitner Avenue consisting of a portion of the old Mayfair Rail line spur and Marquette Fuel Site. Pursuant to Section 1-17-4-2(B), an affirmative vote of two-thirds (2/3) of the elected aldermen is required to accept the recommendation of the City Manager on the negotiation authorized herein. The City of Evanston reserves the right to reject any and all negotiations. • • SECTION 2: The City Manager is hereby authorized and directed to give notice of intent to sell the aforementioned real estate. Such Notice of Sale must be published at least once in a daily or weekly newspaper in general circulation in the City. The publication must not be less than 15 nor more than 30 days before the date on which the City Council shall consider the adoption of the ordinance approving the sale of the property. SECTION 3: That the Notice of Intent to sell the Property shall be in substantially the following form: NOTICE OF INTENT TO SELL Public notice is hereby given that the City of Evanston proposes to sell the real estate legally described in Exhibit A and commonly known as vacant land located approximately between Cleveland Street and Washington Street, West of Pitner Avenue, and consisting of a portion of the old Mayfair Rail line Spur and Marquette Fuel Site. The property proposed to be sold is at the present time vacant land. SECTION 4: All ordinances or parts of ordinances in conflict herewith are • hereby repealed. SECTION 5: This ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law. Approved: 1992 Mayor -PYo -Te M EXHIBIT A • ORDINANCE 45-0-92 Legal Description of Subject Property: That part of the Southwest quarter of Section 24, Township 41 North, Range 13, East of the Third Principal Meridian described as follows: Beginning at the intersection of the centerline of Cleveland Street and the West line of Pitner Avenue as said roadways are located in said Southwest quarter of Section 24; thence South 89 degrees 49 minutes 35 seconds West, along the extention to the West of said centerline of Cleveland Street, 365.02 feet; thence North 24 degrees 26 minutes 16 seconds East, 831.52 feet; thence South 65 degrees 33 minutes 44 seconds East 60.0 feet to the former Easterly right of way of the Chicago and Northwestern Transportation Company, said point being 617.82 feet Southwesterly of the South line of Main Street (being 33 feet South of the North line of said Southwest quarter of Section 24) as measured along said Easterly right of way; thence South 24 degrees 26 minutes 16 seconds West, along said Easterly right of way, 691.30 feet, to a point of curve; thence Southeasterly along a curve to the left, having a radius of 30.0 feet, 60.01 feet to a point of tangency; thence North 89 degrees 49 minutes 35 seconds East, 227.59 feet to the West line of Pitner Avenue; thence South 02 degrees 29 minutes 30 seconds West, 60.06 feet to the point of beginning, in Cook County, Illinois. 0
