Granting a Variation and a Special Use
at 820 Foster Street
WHEREAS, the Evanston Zoning Board of Appeals (ZBA)
conducted public hearings on March 17, 1992 and April 21, 1992,
upon the application by Mather Health Care, Inc. for a variation
from the off-street parking and loading berth regulations of the
Zoning Ordinance to permit installation of off-street parking
spaces and a loading berth in the required east side yard, and
for a special use to permit remodeling and construction of an
addition to the existing nursing home, and installation of
planters in excess of eighteen inches in height on property
located at 820 Foster Street in an R6 General Residence
District; said public hearings having been conducted pursuant to
notice and publication thereof in the manner prescribed by law;
and

WHEREAS, the Zoning Board of Appeals has recommended
that the application for said variation and special use be
granted;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That, based upon the evidence and
testimony presented at the hearings, and
upon deliberations and findings of fact contained in the
transcript of the Zoning Board of Appeals Case No. 91-36-V&SU(R),

upon the application by Mather Health Care, Inc. for a variation
from the off-street parking and loading berth regulations of the
Zoning Ordinance to permit installation of off-street parking
spaces and a loading berth in the required east side yard, and
for a special use to permit remodeling and construction of an
addition to the existing nursing home, and installation of
planters in excess of eighteen inches in height on the property
located at 820 Foster Street, located in an R6 General Residence
District; and legally described as follows:
"LOT 1 OF PLAT OF CONSOLIDATION OF LOT 18 (EXCEPT THE
SOUTH 25 FEET THEREOF) AND ALL OF LOTS 19 AND 20 IN
HUSE AND POWERS ADDITION TO EVANSTON, BEING A
SUBDIVISION OF LOT 17 IN ASSESSOR'S DIVISION OF THE
NORTHWEST 1/4 OF SECTION 18, TOWNSHIP 41 NORTH, RANGE
14 EAST OF THE THIRD PRINCIPAL MERIDIAN, ALSO: LOT 1
AND THE EAST 41 FEET OF LOT 2 (EXCEPT THE WEST 9 FEET
OF THAT PART OF SAID EAST 41 FEET LYING NORTH OF THE
isSOUTH 80 FEET THEREOF) IN PAUL PRATT'S ADDITION TO
EVANSTON, A SUBDIVISION OF THE SOUTHWEST 8 1/2 ACRES OF
THE SOUTH 1/2 OF THE NORTHEAST 1/4 OF THE NORTHWEST 1/4
OF SECTION 18, TOWNSHIP 41 NORTH,- RANGE 14 EAST OF THE
THIRD PRINCIPAL MERIDIAN, ALL IN THE CITY OF EVANSTON,
IN COOK COUNTY, ILLINOIS." '.0
is granted, subject to compliance with all other provisions of
the Zoning Ordinance, other applicable laws and the following
condition:
1. The proposed construction shall be in substantial
compliance with the testimony presented and the plans
placed on file in connection with this case, except
that the patio depicted on said plan shall not be
installed.
SECTION 2: All ordinances or parts of ordinances
in conflict herewith are hereby repealed.
SECTION 3: This ordinance shall be in full force
and effect from and after its passage,
