AN ORDINANCE
Amending Sections 10-8-1 and 10-4-5-2
of the Evanston City Code, 1979
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK
COUNTY, ILLINOIS:
SECTION 1: That Section 10-8-1 of the Evanston City Code,
1979, as amended, be amended to read as follows:
10-8-1: LICENSE REQUIRED: It shall be unlawful for any
person to use, maintain, store for purposes other
• than sale, park or operate within the City any motor vehicle
registered or required to be registered with the Secretary of
State, State of Illinois, to an address within the corporate
limits of the City, unless such vehicle is licensed as provided
in this Chapter. In addition, vehicles not registered or
required to be registered with the Secretary of State to an
Evanston address, as provided in the previous sentence, may be
licensed as provided in this Chapter if the vehicle operator
lives in an "Evanston Resident Only Parking District" as
described in Section 10-4-5-2(C).

A violation of the provisions of this Section shall take place
when a motor vehicle registered or required to be registered
with the Secretary of State to an Evanston address shall not
have been licensed, whether or not said vehicle is actually in
operation on the streets or public ways of the City.
If, at the time of application, a complaint is pending charging
failure to obtain or display said vehicle license, further
prosecution may be avoided by obtaining said license and paying
the sum of ten dollars ($10.00) as a penalty at the time of
such application. Any person violating the provisions of this
Section shall be punished by a fine in the amount of ten
dollars ($10.00) in the event that the violator has secured the
required vehicle license at the time of his court appearance
but has not paid the aforementioned penalty fee.

SECTION 2: That Section 10-4-5-2(B)(1), as amended, be
amended to read as follows:
(B) Residential Permit Parking Areas:
1. The City Manager is hereby authorized to designate, by
and with the consent of the City Council, as hereinafter
provided, streets and other public ways within the City on
which the parking of vehicles may be restricted to
vehicles bearing a valid parking permit issued pursuant to
this Section or to vehicles bearing a valid Evanston
vehicle license issued pursuant to Section 10-4-5-2(C).
SECTION 3: That existing Section 10-4-5-2(C) be renumbered
as Section 10-4-5-2(D).
SECTION 4: That a new Section 10-4-5-2(C) be added to read
as follows:
(C) Evanston Resident Only Parking Districts: The City
Manager is authorized to designate, by and with consent of
the City Council, certain streets or portions of streets
as "Evanston Resident Only Parking Districts." The
streets to be so designated shall meet the criteria for
establishing residents only parking districts as described
in Section 10-4-5-2(B) of the City Code. The means of
identifying vehicles eligible for parking in these
districts shall be a valid Evanston vehicle license issued
pursuant to Section 10-8-1 of the City Code. The penalty
for violating the provisions of this Section shall be
twenty-five dollars ($25.00) for each offense, and if not
paid within ten (10) days from the date of issue of the
violation notice, an additional ten -dollar ($10.00)
penalty shall apply. The streets designated as Evanston
Resident Only Parking Districts shall be listed in Section
10-11-22, Schedule XXII, which shall be created for that
purpose.

SECTION 5: That ordinances or parts of ordinances in

conflict herewith are hereby repealed.
SECTION 6: That this ordinance shall be in full force and
effect from and after its passage, approval and
publication in the manner provided by law.
SECTION 7: That this ordinance shall expire one year from
its effective date.
