AN ORDINANCE
Establishing the Property Services Board
WHEREAS, on April 2, 1991, citizens of Evanston passed
a referendum to reduce the size of the City Council from
eighteen to nine members; and
WHEREAS, the reduction in the size of the City Council
will occur effective upon the election of April, 1993; and
WHEREAS, the reduction in the size of the City Council
is a fundamental change in the manner in which the City will
conduct its business and affairs; and
WHEREAS, as a result of the reduction, it is necessary
that the functions and purposes of certain City boards and
commissions be consolidated.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON:
SECTION 1: That Title 4 of the City Code is hereby
amended by adding the following Chapter number 18:
4-18-1 - PROPERTY SERVICES BOARD: The Property Services
Board shall consist of seven (7) members to be
appointed by the Mayor with the consent of the City
Council. All members of the Board shall serve for three
year terms or until their successors are appointed and
qualified. One (1) member of the Board shall be a
representative from the Evanston Property Owners
Association, one (1) member shall be a representative
from the Residential Crime Prevention Association. The
remaining five (5) members shall be either licensed
professional engineers, architects, builders or
superintendents of building construction with at least
ten years experience, five (5) of which have been in
responsible charge of work. Not more than three (3) of
these five (5) members shall be from the same
profession or occupation.
4-18-2 - POWERS AND DUTIES: The••Board shall perform the
following functions and duties:
a) The duties and responsibilities of the BOCA Property
Maintenance Code Appeals Board, as set forth in Section
5-1-3(A) of the Evanston City Code and the BOCA National
Property Maintenance Code;
b) The duties and responsibilities of the BOCA National
Building Code Appeals Board, as set forth in Section 4-
2-1(C) of the Evanston Code and the BOCA National
Building Code;
c) The duties and responsibilities of the Burglary
Prevention Appeals Board, as set forth in Section 5-7-7
of the Evanston City Code.
d) To decide appeals with respect to any action or failure
to act pretaining to the enforcement or application of
Title 4 Chapter 10. The Board may grant time extensions
and/or variations with respect to compliance with the
provisions of Sections 4-10-10-3 and 4-10-10-4. The
Board may also grant contivances and/or stay the
decision of the Director. The decision of the Board
shall be binding on the Director, the appellant and the
applicant.
SECTION 2: All ordinances or parts of ordinances
in conflict herewith are hereby repealed.
SECTION 3: This ordinance shall be in full force
