HomeMy WebLinkAboutORDINANCES-1993-119-O-9310/19/93 11/8/93 119-0-93 AN ORDINANCE Vacating a Portion of Linden Place East of Custer Avenue NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the portion of Linden Place within the public right of way east of Custer Avenue and legally described as follows: THAT PART OF THE LINDEN PLACE, LYING EAST OF THE EAST LINE OF CUSTER AVENUE AND WEST OF THE WESTERLY RIGHT OF WAY LINE OF THE CHICAGO AND NORTHWESTERN RAILROAD ALL IN THE WEST 1/2 OF THE SOUTH EAST 1/4 OF SECTION 19, TOWNSHIP 41 NORTH, RANGE 14 EAST OF THE THIRD PRINCIPAL MERIDIAN IN COOK 40 COUNTY, ILLINOIS, DESCRIBED AS FOLLOWS: PARCEL 1: THE NORTH 26.00 FEET OF THE EAST 219.00 FEET OF LINDEN PLACE. PARCEL 2: THE NORTH 19.00 FEET OF THE SOUTH 30.00 FEET OF THE EAST 72.00 FEET OF THE WEST 77.00 FEET (BETWEEN EAST LINE OF CUSTER AVENUE AND THE PUBLIC ALLEY IN THE SAID BLOCK). PARCEL 3: THE NORTH 19.00 FEET OF THE SOUTH 30.00 FEET OF THE EAST 88.00 FEET OF THE WEST 190.00 FEET (BETWEEN THE PUBLIC ALLEY IN THE SAID BLOCK AND WESTERLY LINE OF CALLAN AVENUE). as cross hatched and indicated by the words, "Hereby Vacated" on the Plat hereto attached, and made a part of this ordinance, is hereby vacated and closed, inasmuch as the Corporate Authorities of the City of Evanston have determined that the best interests of the public will be served by the aforesaid vacation. 1 119-0-93 SECTION 2: The adjoining property owners R & F Development, Inc. who shall receive the benefits of this vacation shall pay to the City of Evanston the sum of One Dollar and No/100 Dollars ($1.00) in consideration for said vacation. SECTION 3: The City of Evanston hereby reserves to itself and to all public utilities owning public service facilities such rights of way, license and easement rights to equipment presently installed and located on those portions of the public way hereby closed, and further reserves the right of ingress and egress for the maintenance, renewal, and reconstruction thereof. SECTION 4: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5: This ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law.
