HomeMy WebLinkAboutORDINANCES-1993-079-O-93• 6/6/93 79-0-93 AN ORDINANCE Amending Section 7-8-2 of the Evanston City Code Regarding Licensure for Tree Trimming WHEREAS, the Illinois Tree Expert Act requiring State licensure of persons engaged in the planting, removal, trimming, spraying or treatment of trees has been repealed; and WHEREAS, the City of Evanston, pursuant to its home rule powers, desires to retain the requirement that persons engaged in the planting, removal, trimming, spraying or treatment of trees obtain a City license, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That Section 7-8-2 of the Evanston City Code, 1979, as amended, be and hereby is further amended as follows: (A) License Required: It shall be unlawful for any person to plant, remove, trim, spray or otherwise treat trees for compensation in any parkway or other public place within the City, unless such person shall obtain a license from the City of Evanston, and be regularly engaged in the business of planting, removing, trimming, spraying or otherwise treating trees. (B) Application, Information Shown; Examination: Applications for the license required herein shall be made directly to the City Manager and shall contain the name and address of the applicant, if an individual, the names and addresses of the principal officers, if a corporation, and the names and addresses of the members, if a partnership, together with a brief statement as to the experience of such person in such business. 1 f The application for a license shall then be submitted for approval to the Superintendent of Parks and Forestry, whose duty it shall be, before approving such application, to require the applicant to submit evidence that sufficient knowledge of technical tree work is possessed, or that sufficient qualifications and fitness are possessed to perform non -technical tree work such as removals. (C) Approval of Application; Issuance; Fee: If the application for a license as required by this Section shall be approved by the Superintendent of Parks and Forestry, upon the payment of a license fee of nineteen dollars ($19.00) per annum by the applicant to the City Collector, the City Collector shall thereupon issue to the applicant a license, attested by the City Clerk, authorizing such applicant to engage in and carry on the business of planting, removing, trimming, spraying, or otherwise treating trees in the City and for the period therein stated. (D) Bond Prerequisite to Issuance: No license shall be issued under the provisions of this Section unless the applicant therefor shall give bond in the sum of ten thousand dollars ($10,000.00), with sufficient surety to be approved by the Superintendent of Parks and Is Forestry conditioned for the faithful performance of the work under the control and supervision of the Superintendent of Parks and Forestry, and to hold the City, its officers, agents and employees harmless of any and all damages or injuries to property, or to any person, or for death resulting, directly or indirectly, from the planting, removing, trimming, spraying or otherwise treating such trees. SECTION 2: That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
