HomeMy WebLinkAboutORDINANCES-1994-016-O-943/3/94 3/16/94 3/17/94 16-0-94 AN ORDINANCE Granting a Special Use to Evanston Hospital Corporation for a Child Day Care Center at 1000 Central Street WHEREAS, the Zoning Board of Appeals ("ZBA") held a public hearing on case no. 93-23-SU(R) on March 1, 1994 pursuant to proper notice, wherein the applicant, Evanston Hospital Corporation ("EHC"), sought a special use to permit establishment of a child day center on property owned by EHC at 1000 Central Street; and WHEREAS, 1000 Central Street is in an 01 Office District; and WHEREAS, Ordinance 3-0-94 added child day care centers to 01 Office Districts as a special use, WHEREAS, based upon the testimony, plans, and other evidence presented, the ZBA made written findings of fact, determining that the proposed special use met each of the standards for special uses set forth in section 6-3-5-10 of the Zoning Ordinance. WHEREAS, the ZBA voted to recommend that the City Council grant the application, NOW THEREFORE, be it ordained by the City Council of the City of Evanston, Cook County, Illinois: 1 16-0-94 SECTION 1: That based upon the testimony, plans, and '} other evidence presented to the ZBA, the City Council hereby adopts the findings and recommendation of the ZBA and grants the special use application by EHC in case no 93-23-SU(R) to allow a day care center at 1000 Central Street, on property legally described as: EVANSTON PARTNERS CONSOLIDATION IN THE NORTHWEST FRACTIONAL QUARTER OF FRACTIONAL SECTION 7, TOWNSHIP 41 NORTH, RANGE 14, EAST OF THE THIRD PRINCIPAL MERIDIAN, IN THE CITY OF EVANSTON, IN COOK COUNTY, ILLINOIS. SECTION 2: Pursuant to section 6-3-5-12 of the Zoning Ordinance, which provides that the City Council may impose conditions and limitations on the grant of a special use, these conditions and limitations are hereby imposed: a. The alterations and operation of the proposed child day care center shall be in substantial conformity with the testimony presented and the plans placed on file in connection with this case; and b. Ten off-street parking spaces on the first level of the parking structure, as near to the elevators as possible, shall be reserved for use by the child day care center in connection with the drop-off and pick-up of children attending said center; and C. The operation of said day care center shall be limited to Monday through Friday, between the hours of 6 a.m. and 7 p.m.; and d. EHC shall work closely with the Evanston Police Department, other public safety officials, and their own safety officers to prevent the clients of the child day care center from dropping -off or picking -up children at curbside; and e. Upon request by the City, EHC shall post public safety officer(s) at curbside to prevent pick-up or drop-off of children enrolled in the child day care center; and 2 16-0-94 f. Said child day care center shall serve EHC employees and others, consistent with the testimony presented at the ZBA hearing; and g. Of the total positions available in said child day care center, eight percent (8%) shall be reserved for non - employees who utilize Title XX and who are residents of the City, and eight percent (8%) shall be reserved for EHC employees who utilize Title XX. SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4: This ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
