HomeMy WebLinkAboutORDINANCES-1994-003-O-94• r 4 1/11/94 2/3/94 3-0-94 AN ORDINANCE Amending Section 6-15-2-3 of the Zoning Ordinance to Add Child Day Care Centers as a Special Use in O1 Office Districts WHEREAS, the Plan Commission held a public hearing on December 8, 1993, pursuant to notice published in the manner prescribed by law, regarding case number ZPC 93-4(T), a petition by Evanston Hospital Corporation to amend Section 6-15-2-2 of the Zoning Ordinance to add child day care centers as a permitted use in 01 Office Districts; and WHEREAS, the Plan Commission heard testimony that child day care centers benefit employers, employees, and the entire community and that such centers create job opportunities; and WHEREAS, child day care centers are not provided for under any zoning technique in 01 Office Districts; and WHEREAS, the Plan Commission, finding that the proposed text amendment making child day care centers permitted uses in the 01 Office District is consistent with the goals and objectives of the 01 District and is compatible with the list of permitted and special uses currently listed in 01 Office Districts, recommended approval of the petitioner's request; WHEREAS, section 6-3-4-6(E) of the Zoning Ordinance provides that the Plan Commission shall submit its written recommendations 1 3-0-94 on the petition for a text change to the City Council; and WHEREAS, Section 6-3-4-6(F) of the Zoning Ordinance permits the City Council to adopt or reject the recommendation of the Plan Commission, or to adopt some modification thereof, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That based upon the evidence and testimony presented at the hearing, and upon the deliberations of the Plan Commission, the City Council hereby finds a) that the need for a safe location at each day care center to drop off and pick up the children, and b) the need to not adversely affect traffic congestion at peak times on already -congested City streets, require regulation of child day care centers in 01 Office Districts as special uses as appropriate and in the best interests of the City. SECTION 2: The City Council further finds that said special use technique will allow among other things, a) the evaluation, on a case -by -case basis, of the impact of the proposed child day care center on the ability of City streets and traffic patterns to accommodate any changes in traffic flow caused by the dropping -off and picking up of children during peak travel times, b) determination of whether a day care center in a particular location will have an adverse effect upon neighboring property values, and c) notice to abutting property owners incident to the special use process, so as to afford them an opportunity to participate in the zoning process. 2 3-0-94 • r 40 61 SECTION 3: That based upon the findings herein set forth, the City Council modifies the recommendation of the Plan Commission to add child day care centers as a permitted use in all O1 Office Districts, and hereby adds said centers as a special use in all 01 Office Districts. SECTION 4: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5: This ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
