AN ORDINANCE
Concerning the Addition of Oakton Street Between
the West City Limits and Asbury Avenue to the
Municipal Street System at a Future Date
WHEREAS, the City of Evanston and the County of Cook wish
to enter into an agreement for; a) the improvement by the County of
Oakton Street from the west City limit to Asbury Avenue and b) the
transfer of jurisdiction of Oakton Street from the west City limit
to Asbury Avenue from the county to Evanston.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That upon notice of a construction starting
• date that the City relinquishes maintenance of Oakton Street from
the west City limit (West Section Line of Evanston Township) to
Asbury Avenue effective that construction starting date; that the
City, following final inspection of the completed project, assume
maintenance of Oakton Street from the west City limit (West Section
Line of Evanston Township) to Asbury Avenue effective the date of
final inspection; and that upon the date the Director of Highways
of the Illinois Department of Transportation affixes his signature
to the LOCAL AGENCY AGREEMENT FOR JURISDICTIONAL TRANSFER, to take
jurisdiction of Oakton Street, in its entirety, from the west City
limit (West Section Line of Evanston Township to Asbury Avenue and
it shall then and thereafter become a municipal street of this nnmicipality.
The City Clerk of the City of Evanston is directed to see that

a certified copy of this Ordinance is attached as Supplemnt #3 of
the agreement being entered into with the County of Cook (three
copies of said agreement) and to return same to County.
SECTION 2: All ordinances or parts of ordinances in •
conflict herewith are hereby repealed.
SECTION 3: That this ordinance shall be in full force
and effect from and after its passage, approval and publication in.
the manner provided by law.

On February 10, 1995 the department executed an agreement which
provides for the jurisdictional transfer of a'portion of CH-A67
from the county to the city, effective February 10, 1995.
Attached is a copy of the executed agreement, which includes the
description of the highway involved.

WHEREAS. the authority to make changes to the Municipal Street System is granted to the Municipality by Section 7-101 of the
Illinois Highway Code.
NOW THEREFORE IT IS AGREED that the corporate authority of said municipality will pass an ordinance providing for the transfer
of the above location and shall attach hereto and make a part hereof a copy of the ordinance. and
WHEREAS, the authority to make changes'to the County Highway System is granted to the County by Se=:ion 5-105 of the Illinois
Highway Cade.
NOW THEREFORE IT IS AGREED that the County Board of said County will pass a resolution providing for the transfer of the
above location and shall attach hereto and make a part hereof a copy of the resolution. and
THE CONVEYOR AGREES to prepare a map of the above location and attach a copy of such location map hereto.
IT IS MUTUALLY AGREED, that this jurisdictional transfer will become effet•ive ueon• the date the Director of
Highways affixes signat»re.

STIPULATIONS
To an agreement between the County of Cook and the City of
Evanston.
This Agreement formalizes responsibilities of Cook County and the
City of Evanston for accomplishing and subsequently operating the
proposed improvement.
The improvements to be built by the County are described as
follows:
Mill and resurface Oakton Street from the west City Limits
(approximately the C&NW Railroad tracks) to- Asbury Avenue with a
three (3) inch bituminous overlay; repair existing deteriorated
pavement with full depth pavement replacement; replace all damaged
curb and gutter, clean and rehabilitate all curb drainage
structures and laterals, adjust Municipal frames and lids;
modernize traffic signals at Dodge Avenue; reconstruct traffic
signals at Asbury Avenue; sign; mark pavement and landscape as may
be required. (County Section: 95-A6730-01-RS)
The obligation of the City of Evanston (hereinafter CITY) and the
County of Cook (hereinafter COUNTY) are as follows:
1. The CITY will:
a. Upon notification of the construction starting date,
relinquish maintenance of Oakton Street from said
starting date for the duration of construction;
b. Following acceptance from final inspection of the
completed improvement, assume maintenance of Oakton
Street from the western CITY Limit to the west edge of
Asbury Avenue pavement; (See Location Map, Supplement #2)
c. Pass the Ordinance, or one substantially like the proposed
.Ordinance attached hereto as Supplement #3, to accept
jurisdiction of Oakton Street from the western CITY Limit
to Asbury Avenue effective the date the Director of
Highways affixes his signature to the attached LOCAL
AGENCY AGREEMENT FOR JURISDICTIONAL TRANSFER; Ordinance is
to be passed at the same City Council meeting as the one
when this agreement is executed by the City, authorized by
enabling minutes of the City Council (to be attached to
the Agreement);

d. Coordinate and control public notification of the project
scope, timing and duration.
e. Promptly review plans submitted by the County;
f. Pay for any new sidewalk, water distribution
appurtenances, street lighting or other municipal
infrastructure to be included in the plans. County will be
responsible for replacing any sidewalk disturbed during
construction;
g. Pay for fifty (50%) percent of the costs associated with
the modernization of traffic signals at the intersection
of Oakton Street and Dodge Avenue.
h. Have the opportunity to observe the project under
construction, bring to the attention of the County's
Resident Engineer any matters of concern with respect to
same, and to have the opportunity to participate in the
final inspection of the completed project;
i. Furnish the COUNTY, in a timely manner, with the
Intersection Design Study (IDS) for the intersection of
Oakton Street and Asbury Avenue for use in preparing
construction plans;
j. Acquire any additional right-of-way which may be required
as determined in the IDS developed under item 1.i; and,
k. Reimburse the COUNTY for seventy-five (75%) percent of the
costs associated with traffic signal reconstruction
developed as a result of the IDS referred to in Item l.i.
2. The COUNTY will:
a. Prepare contract plans, obtain City approval of same,
advertise, let, award, supervise construction and finance
the design engineering, construction costs, and
construction engineering (estimated construction cost
$550,000.00);
b. Prepare traffic signal plans for inclusion in COUNTY
contract plans for the intersection of Oakton Street and
Asbury Avenue from the IDS data provided by the CITY;

c. Pay for the replacement of any existing sidewalk disturbed •
or relocated by the proposed improvement;

d. Pay for twenty-five (.25%) percent of the construction
costs associated with the traffic signal reconstruction
at the intersection of Oakton Street and Asbury Avenue and
pay fifty (50%) percent of the construction costs
associated with traffic signal modernization at the
intersection of Oakton Street and Dodge Avenue;
e. Bill the CITY for its share, 75%, of costs associated with
any traffic signal improvements made from plans developed
as part•of Item 2.b. on the following schedule:.one half
of said costs based upon costs as awarded and the
remainder of the balance as determine by the actual
construction costs;
f. Bill the City for its share, 50%, of the costs associated
with the modernization of the traffic signals at the
intersection of Oakton Street and Dodge Avenue following
the same schedule as in 2.e. above;
g. Pass the Resolution, Supplement #4, concurrently with the
• County's execution of this agreement, to remove Oakton
Street from the West CITY Limit to Asbury Avenue from the
County Highway System, effective 21 days after acceptance
of the improvement from final inspection, notification to
be sent by registered mail; and,
h. Following execution of this agreement (in three copies) by
the City and the County, in that order, submit three
copies to the Illinois Department of Transportation for
requisite approval as to the change of jurisdictional
responsibility of Oakton Street.
3. The COUNTY and The CITY agree that their respective successors
and assigns shall be bound by the terms of this agreement.
4. This Agreement shall remain in effect, with the exception of
COUNTY construction of traffic signal improvements at Oakton
Street and Asbury Avenue, in the event an IDS is not prepared
by the CITY in a timely manner so as to meet the construction
award deadline in Item 5 (below).
5. This Agreement and the covenants contained herein, shall
become null and void in the event a contract for the
construction work as stated herein is not awarded by July 1,
