HomeMy WebLinkAboutORDINANCES-1994-044-O-94• ' 4-29-94 • 44-0-94 AN ORDINANCE AUTHORIZING THE ACQUISITION OF PROPERTY THROUGH CONDEMNATION OR OTHERWISE FOR A NEW MUNICIPAL FIRE STATION WHEREAS, the City of Evanston is responsible for providing fire protection for its residents; and WHEREAS, the City desires to acquire certain property so that it may continue to meet those responsibilities; and WHEREAS, it is deemed to be advisable and necessary to acquire the property legally described in Exhibit A (Subject Property) and commonly known as 1332 Emerson Street, Evanston, and in the best interests of the City of Evanston to provide a new municipal fire station. • NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That under the authority vested in the corporate authorities of the City of Evanston through the statutes of the Sate of Illinois and the home rule powers and ordinances of the City of Evanston, it is hereby necessary and desirable that the City shall acquire title to and possession of the real property legally described in Exhibit A for the purpose constructing thereon, a new municipal fire station. SECTION 2: That the City Manager of the City of Evanston and/or his/her designee is hereby authorized, empowered, and directed to negotiate for and on behalf of the City of • Evanston with the owner or owners of the hereinabove described 0 real property for the purchase thereof by the City of Evanston. SECTION 3: That, in the event that the City Manager'` • and/or his/her designee is unable to agree with the owners of the • real property hereinabove described as to the compensation to be paid therefore, then the Corporation Counsel of the City of Evanston and/or the designee of the. City Manager is hereby authorized to institute condemnation proceedings in the name of the City of Evanston for.the purpose of acquiring title to and possession of said real property hereinabove described in accordance with the eminent domain laws of the State of Illinois. SECTION 4: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5: This ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
