HomeMy WebLinkAboutORDINANCES-1994-040-O-9411 4/21/94 40-0-94 AN ORDINANCE Granting a Special Use to Robert O'Donnell for a Car Wash at 1212 Chicago Avenue WHEREAS, the Zoning Board of Appeals ("ZBA") held a public hearing on April 19, 1994 pursuant to proper notice in case no. ZBA 94-2-SU(R), wherein the applicant, Robert O'Donnell, as lessee of the subject premises, sought approval for a special use to permit operation of a car wash in the southern portion of the building at 1212 Chicago Avenue a C1 Commercial District; and WHEREAS, based upon the testimony, plans and other evidence presented, the ZBA made written findings of fact, determining ' that the proposed special use met each of the standards for special uses set forth in section 6-3-5-10 of the Zoning • 0 Ordinance; and WHEREAS, the ZBA voted to recommend that the City Council grant the application, NOW THEREFORE, be it ordained by the City Council of the City of Evanston, Cook County, Illinois: SECTION 1: That based upon the testimony, plans and other evidence presented to the ZBA, the City Council hereby adopts the findings and recommendation of the ZBA and grants the special use application of Robert O'Donnell, lessee of the subject premises, for a car wash in the southern portion of the 1 40-0-94 building at 1212 Chicago Avenue, on property legally described as: PARCEL 1: LOT 1 IN TOYOTA IN EVANSTON CONSOLIDATION IN THE NORTHWEST QUARTER OF SECTION,191 TOWNSHIP 41 NORTH, RANGE 14, EAST OF THE THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS, ACCORDING TO THE PLAT THEREOF RECORDED FEBRUARY 18, 1987, AS DOCUMENT NO. 87092542, IN COOK COUNTY, ILLINOIS. PARCEL 2: LOT 4 AND 5 IN FRANKLIN B. BREWER'S SUBDIVISION OF THE SOUTH 137 FT. OF THE NORTH 312 FT. OF BLOCK 1 IN SNYDER'S ADDITION TO EVANSTON, IN THE NORTHWEST QUARTER OF SECTION 19, TOWNSHIP 41 NORTH, RANGE 14, EAST OF THE THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS. SECTION 2: Pursuant to section 6-3-5-12 of the Zoning Ordinance, which provides that the City Council may impose conditions and limitations on the grant of a special use, these conditions and limitations are hereby imposed: a. The special use granted hereby shall be subject to compliance with all applicable provisions of the Zoning Ordinance and other applicable laws; and b. The car wash shall be operated in conformance with the testimony, other evidence presented, and the plans placed on file in connection with this case. SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4: This ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
