HomeMy WebLinkAboutORDINANCES-1995-001-O-95u • 12/16/94 1-0-95 AN ORDINANCE Amending Section 9-5-23(A) of the Noise Ordinance to Provide for Police Removal of Certain Vehicles NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That section 9-5-23(A) of the Evanston City Code of 1979, as amended, is further amended by making existing section 9-5-23(A)(1) a part of section 9-5-23 (A) (5), with lettered paragraph designations, and by renumbering the revised section 9-5- 23 (A) (5) to 9-5-23 (A) (4) , to read as follows: • Section 9-5-23 (A) (4) A. Motor Vehicle Alarms: The use of a continuous, audible signal device which acts as a vehicle burglar alarm, when such device is not limited in operation to four (4) minutes after activation, and is capable of further activation without being reset to become active again. (Ord. 29-0-88) B. Horns, Signaling Devices: The sounding of any horn or signaling device on any automobile, motorcycle, or other vehicle on any street or public place of the City, except as a danger warning; the creation by means of any such signaling device of any unreasonably loud or harsh sound; the sounding of any such device for an -.a necessary and unreasonable period of time; the use of any horn, whistle, or other device operated by engine exhaust; and the use of any signaling device when traffic is for any reason held up. C. In addition to the general penalty provided in Section 1-4-1 of the Evanston City Code, any violation of this subsection (A)(4) will automatically give the Evanston Police Department the authority to take reasonable measures to abate -he noise or tow the vehicle to a City vehicle pound, and impose towing charges which shall be paid by the registered owner of the . vehicle. 1 • • 0 C 1-0-95 I • • • D. Owners who violate this subsection shall assume the risk of any damage which may be caused by efforts of the City to abate the nuisance. (Ord. 66-0-86) SECTION 2: That existing sections 9-5-23 (A) (2) , (3) , and (4) are renumbered as 9-5-23 (A) (1), (2), and (3), respectively, with the texts unchanged. SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4: This ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
