AN ORDINANCE
Pertaining to the Cable
Communications Services within
the City of Evanston
WHEREAS, the City of Evanston has awarded a cable franchise to Cablevision of
Chicago for the ownership, operation and maintenance of a cable communication system
in the City; and
WHEREAS, Cablevision of Chicago has proposed the transfer of ownership of the of
the existing cable franchise to Continental Cablevision by July, 1995; and
WHEREAS, this franchise agreement will expire on April 19, 1996; and
• WHEREAS, the City will negotiate the terms of a new Franchise Agreement; and
WHEREAS, the City, as part of the negotiating process for a new cable franchise
agreement, has appointed a Cable Task Force of citizens, and
WHEREAS, the Cable Task Force will determine the needs within the City for public
cable access and cable services generally, and
WHEREAS, as part of community outreach and citizen input, a series of ten cable
focus group meetings will be held by the Task Force throughout the City to ascertain
generally the services and needs for cable communications within the City; and
WHEREAS, the Cable Task Force will provide information and assistance, on as
needed basis, to the City's negotiating representatives; and
• WHEREAS, the city has retained the services of The Buske Group to assist in the
franchise negotiations,

WHEREAS, the Department of Facilities Management will report to the •
Administration and Public Works Committee of the City Council on all cable matters; and
WHEREAS, the Cable Communications Ordinance, Title 2, Chapter 11 was adopted
in 1986 to address cable concerns then prevalent within the City; and
WHEREAS, the cable communications industry and the federal regulation thereof has
undergone substantial change and modification during the 1980s and 1990s, and
WHEREAS, the City Council will, within the next twelve months, consider the
adoption of a Cable Communication Ordinance which better serves the needs and concerns
of all citizens and which reflects the technological changes and federal regulation within the
cable industry.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EVANSTON, COOK COUNTY, ILLINOIS: •
SECTION 1: That Title 2, Chapter 11 of the Code of the City of Evanston is hereby
repealed in its entirety.
SECTION 2: That ordinance 123-0-85 is hereby amended in pertinent part to read
as follows:
Section 8: Restrictions
"Any person or organization alleging denial of this right may petition the
Administration and Public Works Committee of the Evanston City Council for
review."
Section 9: Governance and Review:
A: Budget
"Copies of any interim budget, the initial -budget and each subsequent annual budget
shall be submitted to the Administration and Public Works Committee of the Evanston
City Council and be made available for public inspection." •
B: Annual Report and Evaluation
"On March 1st each year commencing 1987 ECTC shall submit a report detailing its

• activities, progress in meeting its responsibilities set forth herein, and an audited
financial statement covering the previous calendar year to the Administration and Public
Works Committee for submittal thereafter to the Evanston City Council."

SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby
repealed.
SECTION 4: This ordinance shall be in full force and effect from and after its
passage, approval, and publication in the manner provided by law.
