HomeMy WebLinkAboutORDINANCES-1996-106-O-9610/03/96, 12/06/96 1 /14/97, 1 /29/97 106-0-96 AN ORDINANCE Amending Section 10-1-5-4 of the Evanston City Code Regulating the Use of Skateboards, Rollerblades and Other Similar Devices BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS, SECTION 1: That the Evanston City Code, 1979, as amended, be and hereby is further amended by amending Section 10-1-5-4(B) as follows: (B) Any person using or operating roller skates, rollerblades, skateboards, coasters, toy vehicles or similar self-propelled devices, except wheelchairs and other wheeled devices for use by disabled persons: • 1. Shall yield the right of way to any pedestrian, 2. Shall give an audible signal before overtaking or passing a pedestrian, and 3. Shall not use or operate said devices in a reckless manner. SECTION 2: That the Evanston City Code, 1979, as amended, be and is hereby further amended by amending Section 10-1-54(C) as follows: (C) The use of roller skates, rollerblades, skateboards, coasters or similar toy vehicles or self- propelled wheeled devices, except wheelchairs and other wheeled devices for use by disabled persons, is prohibited in the following area: Fountain Square: That area within the City of Evanston bounded on the west by Sherman Avenue, on the east by Orrington Street, on the south by Davis Street and on the north by the southern boundary of the property known as the Fountain Square Building, street address: 1612 Sherman Avenue. 1 106-0-96 SECTION 3: That the Evanston City Code, 1979, as amended, be and is hereby further amended by adding a new Section 10-1-54-(D) as follows: (D) The use of roller skates, rollerblades, skateboards, coasters or similar toy vehicles or self-propelled wheeled devices, except wheelchairs and other wheeled devices for use by disabled persons is prohibited on flower beds, planters, curbs, benches, ramps, rails and other appurtenances as part of the downtown revitalization project in the Downtown Area, defined as that area bounded by Lake Street on the south, Ridge Avenue on the west, Emerson/Elgin Road on the north, and Hinman Avenue on the east. SECTION 4: That the Evanston City Code, 1979, as amended, be and is hereby further amended by adding a new Section 10-1-5-4(E) as follows: (E) The minimum fine shall be fifty dollars ($50.00) and the maximum fine shall be five hundred dollars ($500.00). A penalty of seventy-five dollars ($75.00) shall be assessed if the fine is not paid within thirty (30) days. Any violator may avoid prosecution for violating the provisions of Section 10-1-5-4 before legal action has been brought against him/her by surrendering the ticket or other notice of violation received, and paying to the City of Evanston Collector's Office, 2100 Ridge Avenue, within thirty (30) days from the date appearing on such violation, the sum pertaining to such violation. • SECTION 5: That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 6: That this ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law. Introduced -1u vt 1<°1?)
