HomeMy WebLinkAboutORDINANCES-1996-025-O-96• 3/14/96 25-0-96 AN ORDINANCE Authorizing Interim City Manager to Enter Into an Easement Agreement With the Metropolitan Water Reclamation District (MWRD) For Certain Property Along McDaniel Avenue Between Main Street and Dempster Street and For Other Property at Greenleaf Street and the North Shore Channel WHEREAS, the City as grantee and the MWRD, as grantor, have a twenty -five-year non-exclusive Easement Agreement whereby the MWRD granted the City certain surface and subsurface rights in a fifteen -foot wide strip of land westerly of McDaniel Avenue between Main Street and Dempster Street and for other property along Greenleaf Street extended into the North Shore Channel; and • WHEREAS, the purpose of the rant is to allow for operation of a City storm sewer p P g p h' • under the surface of said strip of land; and WHEREAS, the aforesaid Easement Agreement is due to expire on April 5, 1997; and WHEREAS, the MWRD is willing to grant, and the City desires, a twenty-five year non-exclusive easement to construct, reconstruct, operate, maintain, repair and remove paving for a 15-foot strip of land westerly of McDaniel Avenue, between Main and Dempster Streets, and to construct, reconstruct, operate, maintain, repair and remove a storm sewer within an 18-inch foot wide strip of land along McDaniel Avenue, between Main and Dempster Streets, and a 30-inch diameter storm water outfall, within a 10-foot wide strip of land, into the North Shore Channel at Greenleaf Street extended; and 1 WHEREAS, said Easement Agreement is in the best interest of the citizens of Evanston, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the Interim City Manager is hereby authorized and directed to sign the Easement Agreement marked as Exhibit A, attached hereto and incorporated herein by reference. SECTION 2: That the Interim City Manager is hereby authorized and directed to negotiate any additional terms and conditions as are in the best interest of the City. SECTION 3: That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4: That this ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
