HomeMy WebLinkAboutORDINANCES-1997-099-O-97E 9/29/97 99-0-97 AN ORDINANCE ADDING A NEW SECTION 1-4-2 TO TITLE 1, CHAPTER 4 OF THE CITY CODE TO CREATE COMPLIANCE CITATIONS WHEREAS, The City of Evanston, in the exercise of its constitutional home rule authority, desires to implement a system of compliance citations to process certain ordinance violations, without court action; and • WHEREAS, The City desires to allow persons cited with said certain violations to settle same by payment of a fee in lieu of litigation; and WHEREAS, Resolution of certain citations in the aforedescribed manner is convenient to all parties to the citation and is in the best interests of the citizens of Evanston, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the Evanston City Code of 1979, as amended, be and it hereby is, further amended by creating a new Section 1-4-2 and renumbering existing sections 1-4-2 through 1-4-4 as Sections 1-4-3 through 1-4-5, respectively, to read as follows: SECTION 1-4-2: COMPLIANCE CITATIONS.: • (A) Not withstanding any other provisions of the City Code, any person, pursuant to the issuance of a compliance citation, who, if accused of any of the below -stated violations may settle and compromise the claim against him or her, by paying the sum shown in parenthesis after the • section number, to the City within fourteen (14) days of the day the citation was issued: 1) Section 7-10-2, Park Hours Operation ($75.00) 2) Section 9-4-7, Restraint of Animals ($75.00) 3) Section 9-5-10, Alcoholic Beverage Consumption/Possession ($75.00), provided that compliance tickets are not to be used for a violation of Section 9-5-10 in the case of an alleged offender who is under the age of twenty-one (21) years at the time of the offense; 4) Section 9-5-13, Trespass ($75.00) 5) Section 9-6-1, Curfew ($75.00) 6) Section 9-5-23 (A) (4) (a), Car Alarms ($25.00) 7) Section 9-5-23 (D) (4), Leaf Blowers ($25.00) (B) The issuance of a compliance citation is a courtesy to first-time violators of the City Code • Section(s) alleged to have been violated. Compliance citations are not appropriate when circumstances warrant a court appearance or when another complaint(s) not eligible for a compliance citation is/are issued to the violator. (C) Any compliance citation which remains unpaid or upon which the alleged violator has not appeared within a fourteen- (14) day period from the date of issuance to request a court date, will be converted to a court complaint and a court date issued. SECTION 2: That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
