9/3/97, amended • 92-0-97 n U AN ORDINANCE Amending Sections 8-4-6-3(B), 8-5-3(E), 8-5-3(F) and 8-5-6(E) Relating to Leaf Collection BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That Section 8-4-6-30 of the Evanston City Code, as amended, is hereby further amended as follows: 8-4-6-3(B) No person shall sweep into or deposit in any gutter, street, alley or other public place in the City the accumulation of litter from any building or lot or from any public or private sidewalk and driveway. Persons owning or occupying property shall keep the sidewalk and parkway in front of their premises free from litter. SECTION 2: That Section 8-5-3(E) of the Evanston City Code, 1979, as amended, is hereby further amended as follows: 8-5-3(E) Yard wastes shall be placed in either 1) thirty (30) gallon (maximum) Kraft paper bags; or 2) ninety (90) gallon roll -out carts purchased through the office of the Director of Public Works and sold at a cost to be established by City Council. SECTION 3: That Section 8-5-3(F) of the Evanston City Code, 1979, as amended, is hereby further amended as follows: 8-5-3(F) No refuse shall be deposited, be thrown away, or be permitted to accumulate or remain in any street, alley or other public place or in any place where its presence would constitute a nuisance to others or a potential or actual hazard to health, sanitation or safety. 1 SECTION 4: That Section 8-5-6(E) of the Evanston City Code, 1979, as amended, is hereby further amended as follows: 8-5-6(E) Kraft paper bags used for yard wastes shall have a maximum capacity of thirty (30) gallons. SECTION 5: That Section 8-5-9 of the City Code of the City of Evanston, as amended, is hereby further amended by adding Section 8-5-9(G) which reads as follows: 8-5-9(G) Commercial landscapers may deliver yard waste to the designated drop off site only on Saturday and Sunday during hours as designated by the Director of Public Works. The Director of Public Works shall determine . the commencement and termination of yard waste drop off based upon the available capacity at the drop off site and the seasonal accumulation of yard waste. SECTION 6: That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 7: That this ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law.
