AN ORDINANCE
Amending Chapter 29 of Title 3 of the Evanston City Code
Establishing an Exempt Transaction Fee for Real Estate
Transfer Tax Exemptions and Exempt Transactions
WHEREAS, Chapter 29 of Title 3 of the Evanston City Code provides for a Real
Estate Transfer Tax; and
WHEREAS, the aforesaid tax is payable on the transfer of title to real property in
the City of Evanston; and
WHEREAS, Sections 3-29-6 and 3-29-7 of the Evanston City Code provide for
numerous exemptions from the Real Estate Transfer Tax which still require the
is processing of forms and review of documents; and
WHEREAS, the City Clerk's Office spends significant time processing
approximately 800 Real Estate Transfer Tax Exemptions and Exempt Transactions per
year pursuant to Sections 3-29-6 and 3-29-7; and
WHEREAS, the City Council has determined it is in the best interest of the -
citizens of Evanston to charge an exempt transaction fee for the processing of such
transactions,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That Chapter 29 of Title 3 of the Evanston City Code, 1979, as
amended, is hereby further amended by adding the following new subsection:

3-29-8-1: EXEMPT TRANSACTION FEE:
An exempt stamp shall be required for all real estate transfers which are
exempt pursuant to Sections 3-29-6 and 3-29-7 of this Chapter. There
shall be a $20.00 fee for any exempt transaction enumerated in Sections
3-29-6 and 3-29-7. The property owner shall be responsible for payment
of said fee.
SECTION 2: That all ordinances or parts of ordinances in conflict herewith are
hereby repealed.
SECTION 3: That this ordinance shall be in full force and effect from and after
October 1, 1998.
